השופט א' א' לוי:
בית המשפט המחוזי בתל-אביב הרשיע את המערער בעבירות של עסקה אחרת בסם וסחר בסם מסוכן. נטען, כי בחודש יולי 2004 ביקש המערער לקנות מאחר 100 גרם של סם מסוכן מסוג קוקאין. באישום נוסף נטען, כי בשלושה מועדים בחודשים אפריל עד יולי 2004, הוא מכר לאחר סך מסוכן מסוג קוקאין בכמויות לא ידועות. בגין כל אלה נדון המערער לשנתיים וחצי מאסר, שנתיים מאסר על-תנאי, קנס בסך עשרים וחמישה אלף ש"ח, פסילה מלהחזיק ברישיון נהיגה במשך שנתיים, ופסילה על-תנאי במשך שנה. בית המשפט הורה על ניכוי תקופת מעצרו של המערער (22.11.04 עד 22.12.05) מתקופת המאסר בה חויב לשאת.
הערעור שבפנינו מופנה כנגד העונש. נטען כי בית המשפט המחוזי החמיר עם המערער בהשוואה לעונשים שנגזרו למעורבים אחרים בפרשה. כן נטען, כי לא ניתן משקל לעובדה שהמערער היה נתון במעצר בית ממושך; למצב בריאותו הלקוי; ולאמור בתסקירו של שירות המבחן. באשר לקנס – נטען כי מצבו הכלכלי של המערער בכי רע, הוא אינו יכול לעבוד עקב מצב בריאותו, ולפיכך אין בידו לעמוד בחיוב הכספי שהוטל עליו. לבסוף, נטען כי לא היה מקום לפסול את המערער מלהחזיק ברישיון נהיגה,
הואיל ולא פעל במסגרת ארגון פשיעה, וממילא לא עשה שימוש ברכב לצורך בלדרות.
לא שוכנענו כי הוכחה בפנינו עילה לשנות מן העונש. עניינו של המערער הוא חלק מפרשה מסועפת בה היו מעורבים אחרים, וגם לאחר שעיינו בעונשים שהושתו על אלה האחרונים והיקף מעורבותם בפלילים, לא מצאנו כי בעונשו של המערער גלומה חומרה יתרה. מאידך, נראה כי יש ממש בטענות בא-כוח המערער בדבר מצב בריאותו הבעייתי, אם לא למעלה מכך, של שולחו. ברם, לא ניתן להתעלם מן העובדה שמחלת המערער לא מנעה ממנו לבצע את העבירות שיוחסו לו, אף שאנו מוכנים להניח כי מצבו הוסיף להתדרדר מאז. כך או כך, סוגיה זו של מצב בריאותו של המערער עתידה להיבדק על ידי גורמי הרפואה בשרות בתי הסוהר, וככל שיימצא כי הוא אינו יכול לשהות בתנאי כליאה, תהיה פתוחה בפניו הדרך לפנות לועדת השחרורים, מכוח סעיף 7 לחוק שחרור על-תנאי ממאסר, התשס"א-2001, ולעתור לשחרור מטעמים רפואיים. לא ראינו מקום להקלה גם בסוגיות הקנס ואורכה של הפסילה.
התוצאה היא כי הערעור נדחה, והמערער יתייצב לשאת בעונשו במזכירות בית המשפט המחוזי בתל-אביב, ביום ח' בסיון התשס"ט (31.5.09), עד לשעה 10:00.
