בתאריך 26.6.09, בסמוך לשעה 04:00, נהג המערער ברכב פרטי מכיוון קציר לצומת ברטעה. כ- 300 מ'
לפני הצומת בעקומה שמאלה, איבד המערער את השליטה על רכבו, חצה את הנתיב הנגדי והשול
השמאלי, והתנגש עם דופן שמאלית עליונה של הרכב בקיר של תעלת ניקוז. בהמשך, התהפך הרכב מספר פעמים, עלה בחזרה לשול השמאלי והחליק עד שנעצר על גגו. כתוצאה מהתאונה נפצע באופן אנוש אמין קבהא (להלן: המנוח) שישב ברכבו של המערער, וכן נחבלו המערער ונוסע נוסף.
בכתב אישום שהוגש לבית המשפט המחוזי, מנתה המשיבה לחובת המערער את אלה:
בשעת התאונה הוא היה נתון להשפעתם של משקאות משכרים; מהירות נסיעתו היתה לפחות 140 קמ"ש ; הוא נהג ברכב מנועי אף שאותה עת נשא בעונשי פסילה; הוא לא נקט באמצעי הזהירות המתחייבים על אף שתנאי הזירה אפשרו לו לעמוד על הסכנה המתקרבת ממרחק ניכר.

המערער הודה בכל אלה, ובעקבות כך הרשיעו בית המשפט המחוזי במספר עבירות – הריגה, נהיגה בשכרות, נהיגה בזמן פסילה, נהיגה ללא רישיון וללא בטוח תקפים, נהיגה במהירות מופרזת, סטיה מנתיב נסיעה, אי-האטה בקרבת עקומה, גרימת נזק לאדם ורכוש, גרימת חבלה של ממש ונהיגה בקלות ראש. לאחר שקוימו ההליכים לעניין העונש נדון המערער ל-4 שנות מאסר, 18 חודשים מאסר על-תנאי, פסילה לצמיתות מלקבל או להחזיק ברישיון נהיגה, וקנס בסך 5000 ש"ח. כמו כן, הופעל, במצטבר, מאסר על-תנאי בן 3 חודשים שעמד נגדו.

שני הערעורים המונחים בפנינו עוסקים בעונש אותו גזר בית המשפט המחוזי. באחד (ע"פ 2983/10) מבקש המערער כי נפחית מעונשו, בעוד שבאחר (ע"פ 2516/10) מבקשת המדינה כי נחמיר בו. המערער סבור כי הערכאה קמא החמירה עמו מעבר למתחייב, תוך שהיא נמנעת מליתן משקל הולם להודאתו שחסכה את העדתם של עדים וכן לחרטה הכנה שהביע. מנגד, סבורה המדינה כי אין בעונש ביטוי הולם לחומרה הגלומה בדרך נהיגתו של המערער, לעברו הפלילי ולצורך להרתיע את הרבים.

נקדים ונאמר כי לא מצאנו ממש בהשגות המערער נגד גזר הדין, ומאידך, אנו שותפים להשקפת המדינה לפיה אין בעונש אותו גזר בית משפט המחוזי מענה הולם וראוי לחומרת המעשים.
קודם שנעסוק בהתנהגות המערער שגרמה את התאונה, נזכיר את עברו הפלילי. בחודש יוני 2007 נמצא המערער נוהג בשכרות, ועל כך ועבירות אלימות אחרות אותן ביצע הוא נדון, בין היתר, לשלושה חודשי מאסר. בחודש פברואר 2008 שב המערער ונתפס כשהוא נוהג בשכרות, והפעם נפסל מנהיגה למשך שנתיים. בחודש נובמבר 2008 נמצא המערער, בשלישית, נוהג במצב של שכרות, והפעם נדון למאסר ולפסילה נוספת של 3 שנים. הנה כי כן, כתב האישום נושא הערעור שבפנינו מעלה כי בעודו נושא בעונשי פסילה קודמים ובמאסר על דרך של עבודות שירות, שב המערער ונהג ברכב תוך שהוא נתון להשפעתם של משקאות משכרים, אולם הפעם נדרשו לשלם את מחיר התנהגותו המופקרת, גם אחרים – המנוח שפתיל חייו קופד, ונוסע נוסף שנפצע. אם תוסיף לאלה את הנסיבה הנוספת שתרמה אף היא לתאונה – נהיגה בעקומה שמאלה במהירות של 140 קמ"ש ,
שוב אין ספק כי בפנינו נאשם פורק עול, שככל הנראה אינו רואה את עצמו נתון למרות החוק, וככזה נשקפת ממנו סכנה מוחשית לציבור.
בנסיבות כה קשות איננו סבורים כי בגזר-דינו של בית המשפט המחוזי ניתן מענה הולם למעשיו של המערער. לפיכך, ולאחר ששמנו לנגד עינינו את ההלכה לפיה אין בית המשפט שלערעור ממצה את הדין עם נאשמים, אנו מקבלים את ערעור המדינה ומעמידים את תקופת המאסר בה ישא המערער על שש שנים. יתר חלקיו של גזר הדין, ובהם המאסר על-תנאי והפסילה מנהיגה לצמיתות – יעמדו בעינם.
