המערער הורשע בבית המשפט המחוזי בתל-אביב-יפו (פ 40244/07), על פי הודאתו, בעבירה של חבלה חמורה בנסיבות מחמירות, לפי סעיפים 333(א)(1) ו-335(א)(1) לחוק העונשין, התשל"ז-1977 (להלן: חוק העונשין ) ועבירה של איומים, לפי סעיף 192 לחוק העונשין.
על פי המתואר בכתב האישום, המערער והמתלוננת הינם בעל ואישה הנשואים מזה 25 שנים ולהם שלושה ילדים משותפים. בני הזוג פרודים מזה כשנתיים ומתגוררים בדירות נפרדות. במועד שאינו ידוע למשיבה, בתקופה הרלוונטית לכתב האישום, נודע למערער מחברו כי המתלוננת נראתה רוקדת בחברתו של גבר אחר במועדון. למחרת היום הגיע המערער לבית מגורי אשתו (להלן: הבית ) וקרא לאחד מבניהם למכוניתו וצעק בפניו "אתה יודע שאמא שלך זונה, היא מביאה אנשים הביתה". בתגובה לדברים אלו יצא הבן מהרכב והמערער נסע מהמקום. בהמשך, נטען כי בתחילת חודש אוגוסט 2007, במועד שאינו ידוע למשיבה במדויק, הגיע המבקש לבית, נכנס לחדר השינה בו שהתה המתלוננת, אחז בידה ואיים עליה באומרו "זה עוד לא נגמר תגידי לבן שלך שיהיה חזק כי אני הולך לגמור את הכול, אני הולך לעשות משהו". ביום 13.8.2007 בשעה 17:00 או בסמוך לכך, הגיע המערער לבית ובמהלך ויכוח בינו לבית המתלוננת דרש את אלבום חתונתם כדי לקרוע את התמונות. משלא מצא את האלבום, נעל את דלת הבית וזרק את המפתח מאחורי הכורסא בסלון, כדי למנוע כניסתם של שכנים. בהמשך לכך, הוציא המערער מכיסו סכין יפנית (להלן: הסכין ), ניגש למתלוננת ותפסה בשערותיה, משך אותה בכוח בידו האחת ובשנייה החל לחתוך אותה בעזרת הסכין בפניה, בצווארה ובידיה תוך שהוא צועק לעברה "זונה, כך מגיע לזונה ששוכבת עם גברים". לא עזרו תחנוניה של המתלוננת, המערער לא הרפה ממעשיו עד שנתקעה הסכין במזרון המיטה שבחדר השינה ונשברה, אז חדל המערער ממעשיו. כתוצאה ממעשיו של המערער נגרמו למתלוננת חתכים עמוקים בפניה, בגב ידה השמאלית, באוזנה ובקרקפת והיא הובלה לבית החולים שם נזקקה לניתוח במהלכו נתפרו פניה.
ביום 18.2.2008 גזר בית המשפט המחוזי על המערער עונש של עשר שנות מאסר בפועל; שנתיים מאסר על תנאי למשך שלוש שנים והתנאי הוא שלא יעבור עבירה שיש בה יסוד של אלימות והיא פשע; ותשלום פיצוי למתלוננת בסכום של 75,000 ש"ח.
על גזר דינו של בית המשפט המחוזי ערער המערער בפנינו.
לטענת המערער, בית המשפט החמיר שלא בצדק עימו שכן לא נתן משקל ראוי לנסיבות לקולא בעניינו, בהן נסיבותיו האישיות, לרבות העובדה שהוא סובל ממחלת הסכרת וכי מצבו הרפואי התדרדר בצורה ניכרת מאז שהוא שוהה במאסר, העובדה כי נאלץ לפרנס את משפחתו מגיל צעיר נוכח קשיים כלכליים אליהם נקלעו הוריו וכן העובדה כי הוריו נפטרו בשנות העשרים לחייו ואחיו נפטר בדמי ימיו. על אף רצף אירועים אלה, מציין המערער, הרי שהוא מילא את חובתו למדינה ושירת שירות צבאי מלא כחייל ביחידת נ"מ בחיל האוויר. עוד מונה המערער לקולא את הודאתו והחיסכון בזמן השיפוטי וכן חרטתו ואת העובדה כי הוא בעצמו זימן את המשטרה וכן את העזרה הרפואית מיד כשעזב את הבית. זאת ועוד, מדגיש הוא כי לא מדובר באירוע שתוכנן מראש וכי לא היה בכוונתו לגרום למתלוננת נזק חמור כלשהו. עוד מציין המערער את סיכויי שיקומו הממשיים שכן מ דובר באירוע אלימות חד פעמי וכי עברו הפלילי הנקי. לבסוף טוען המערער כי שגה בית המשפט המחוזי משגזר עליו עונש מאסר כה כבד ופיצויים למתלוננת בשיעור גבוהה ביותר, עונשים אשר חורגים מנורמת הענישה הנהוגה בעבירות דומות.
לעומתו סוברת המשיבה כי גזר דינו של בית המשפט המחוזי לקח בחשבון את כל הנסיבות לקולא אשר מנה המערער וכי העונש מבטא את האיזון הנכון בין נסיבותיו האישיות של המערער לבין חומרת מעשיו והשפעתם העצומה על המתלוננת פיזית והן נפשית, בנוסף לתסקיר שירות המבחן שלא נתן כל המלצה בעניינו של המערער.
לאחר עיון בהודעת הערעור על נספחיה ובתסקיר שנערך מטעם שרות המבחן בעניינו של המערער ולאחר ששמענו את טיעוני הצדדים, הגענו למסקנה כי דין הערעור להידחות.
התמונה המצטיירת מעובדות כתב האישום היא חמורה במיוחד. המערער תקף בחמת זעם את המתלוננת, הלא היא אשתו, אך בשל החשש כי בגדה בו עם גבר אחר ותוך שהוא נועל אותה בביתה, כל זאת על אף היותם פרודים למעלה משנתיים.
כידוע, הלכה היא כי ערכאת הערעור תתערב בחומרת העונש שהוטל על ידי הערכאה הדיונית במקרים חריגים בלבד (ראו למשל ע"פ 9097/05 מדינת ישראל נ' ורשילובסקי (לא פורסם, 3.7.2006)). איננו סבורים כי מקרה זה נמנה על אחד מאותם מקרים חריגים המצדיקים את התערבותה של ערכאת הערעור בעונש שהוטל על ידי הערכאה הדיונית. מעבר לכך, אנו סבורים שבית המשפט המחוזי איזן כראוי את כלל השיקולים הרלוונטיים וכי העונש שהוטל על המערער הינו עונש ההולם את המעשים שביצע, אשר אין צורך להכביר במילים בנוגע לחומרתם. בית המשפט בבואו לגזור את דינו של המערער הביא בחשבון את נסיבותיו האישיות, את הודאתו וכן את העובדה כי הוא זה שטלפן למשטרה ולמגן דוד אדום מיד כשעזב את הבית, אך מנגד התייחס לחומרת מעשיו של המערער ולתופעה של אלימות במשפחה במיוחד במערכות יחסים בין בעל אלים לבין בת זוגו, תופעה המצריכה תגובות עונשיות מרתיעות. טענותיו הרבות של המערער, בהן כי האירוע לא תוכנן מראש וכי לא היתה לו כוונה לגרום למתלוננת נזק חמור ונסיבותיו המשפחתיות לא יועילו לו, שכן מעשיו החמורים מצביעים על הסכנה הנשקפת ממנו ועל הצורך בהרחקתו מן הציבור והחזקתו מאחורי סורג ובריח משך שנים ארוכות.
בנסיבות אלו הגענו למסקנה כי העונש שהוטל על המערער הינו ראוי ועל כן לא מצאנו עילה להתערב בגזר דינו של בית המשפט המחוזי.
סוף דבר, אנו דוחים אפוא את הערעור.
