החלטה
עיינתי בהחלטתה של כב' הנשיאה ביניש מיום 2.4.09, שלא לעכב את המשך שמיעת המשפט בעניינו של המבקש בבית משפט השלום בפתח-תקוה.
נתתי דעתי לפרטי בקשתו של ב"כ המבקש מיום 7.4.09 לעיון חוזר בהחלטה זו ולנתונים העובדתיים הכלולים בה. מנתונים אלה עולה, בין היתר, כי נכון לעת הזו הוגשו סיכומי טענות הצדדים, וכי הכרעת הדין צפויה להינתן ביום 19.4.09. נתונים אלה לא היו ידועים בעת מתן החלטתה של כב' הנשיאה ביום 2.4.09.
מנגד, ערעור הפסלות קבוע לדיון בפני כב' הנשיאה ביום 26.4.09, מועד המאוחר לתאריך שנקבע למתן הכרעת הדין.
בנסיבות אלה, אני מקבלת את הבקשה לעיון חוזר במובן זה שמתן הכרעת הדין בהליך זה יעוכב עד להכרעה בערעור הפסלות ובכפוף לה.
