ערעור על העונש שגזר בית המשפט המחוזי בחיפה (השופט אליקים) על המערער ביום 4.4.11 בת"פ 21499-07-10. עניינו של התיק עבירות סמים שנעברו על-ידי המערער ושניים נוספים. על המערער הושתו 30 חודשי מאסר בפועל ו-6 חודשים נוספים בעקבות הפעלת תנאי מתיק אחר, ובסך הכל 36 חודשי מאסר לריצוי, וכן מאסר על תנאי.
רקע והליכים קודמים
ב.
המערער, יליד 1980, הורשע ביום 4.4.11 על פי הודאתו, יחד עם שניים אחרים (להלן נאשם 1 ו נאשם 3 ), בעבירות של יצוא, יבוא, סחר והספקת סמים, לפי סעיף 13 לפקודת הסמים המסוכנים (נוסח חדש), התשל"ג – 1973; והחזקת סם מסוכן שלא לצריכה עצמית, לפי סעיף 7 לפקודה. לפי המתואר בכתב האישום, סיפק נאשם 1 למערער 100 גרם קוקאין תמורת התחייבותו להעביר לו 33,000 ש"ח. לאחר הספקת הסם, ביקש המערער מנאשם 1 להחזיר לו את הסם, ואילו האחרון הציע לו סכום של 28,000 ש"ח כדי שיותיר את הסם בידו. המערער סירב והוסכם כי הסם יוחזר, ואילו המערער ישלם לנאשם 1 על הכמות החסרה 330 ש"ח לכל גרם קוקאין. בהמשך לכך, שלח נאשם 1 את נאשם 3 למערער, כדי להחזיר את הסם ולגבות את הסכום האמור. נאשם 3 נסע לביתו של המערער, וקיבל את כמות הסם שנותרה – 91.3 גרם קוקאין.

במסגרת הסדר הטיעון בין הצדדים הוסכם על טווח ענישה בין שנתיים מאסר בפועל לארבע שנים, ונאמר כי המשיבה תעתור לעונש המירבי ובנוסף להפעלת שנת מאסר מותנית במצטבר; כן הוסכם על חילוט הכספים שנתפסו. בית המשפט ציין, כי השתכנע שחרטת המערער והנאשמים האחרים היא כנה, וכי בנסיבות התיק יש לבכר את עקרון אחידות הענישה. על כן, השית בית המשפט על כל אחד מן הנאשמים, לרבות המערער בענייננו, עונש של 30 חודשי מאסר בפועל ושנה מאסר על תנאי. בנוסף, הפעיל בית המשפט את המאסרים המותנים שעמדו לחובת המערער ונאשם 3, והשית על המערער 6 חודשי מאסר נוספים במצטבר, ו-6 חודשי מאסר בחופף - סך הכל 36 חודשי מאסר בפועל; על נאשם 3 הושתו 4 חודשי מאסר נוספים במצטבר, ו-4 חודשי מאסר בחופף - סך הכל 34 חודשי מאסר בפועל. כן הושתו מאסרים על תנאי.
הערעור
ד.
נטען, כי יום אחד בלבד לאחר קבלת הסם, ביקש המערער להחזיר את הסם לנאשם 1; מכאן, שהמבקש התחרט על מעורבותו אף טרם נפתחו ההליכים נגדו. בהמשך לכך נטען, כי בית המשפט לא שיקלל נתון זה בעת גזירת עונשו של המערער. עוד נאמר, כי היה מקום להבחין בין חלקיהם השונים של כל אחד מן הנאשמים בעבירות: החלק העיקרי הוא - כנטען - של נאשם 1, שהניע את העסקה, סיפק את הסם, ניסה למנוע את החזרתו, תיווך בין הגורמים הרלבנטיים ושלח את נאשם 3 להחזיר את הסם. עוד נטען, כי עברו הפלילי של נאשם 1 מכביד בהרבה מזה של המערער, באשר לראשון שש הרשעות קודמות בעבירות של אלימות וחבלה בגינן וריצה מספר מאסרים, בעוד המערער ריצה מאסר אחד, ואילו עבירותיו הקודמות הן של עריקה ונפקדות משירותו הצבאי, ואינן רלבנטיות לענייננו. עוד נטען, כי היה מקום ליתן משקל ממשי לנסיבותיו האישיות של המערער בגזירת העונש - עברו הנורמטיבי, היותו מאורס ורצונו להשתקם, המתבטא גם בקשר עם עובדת סוציאלית במאסר.
הדיון
ה.
באת כוח המערער שבה וטענה בראש וראשונה, כי היה מקום להתחשב בחלקו הפחות בביצוע העבירה המשתקף מכתב האישום, וכן לכך שביקש להשיב את הסם יום לאחר קבלתו; לטעמה לא ניתן ביטוי מספיק לאלה בגזירת הדין, כשהושוו העונשים בין הנאשמים בתיק.

באת כוח המשיבה טענה, כי לכל אחד מן הנאשמים בפרשה היו נסיבות שונות לקולה או לחומרה; למשל, נאשם 1 אינו בעל עבר פלילי בעבירות סמים, להבדיל מן המערער, ואילו המערער, בשונה מהאחרים, ביצע את העבירות בעודו אסיר ברישיון. על כן אין מקום לקבוע - כך נטען - כי נסיבותיו של המערער מצדיקות חריגה מעקרון אחידות הענישה, ואין מקום להפחית בעונשו ביחס לאחרים.
הכרעה

לאחר העיון לא ראינו מקום להיעתר לערעור. ראשית, הצדדים בחרו לערוך הסדר טיעון משותף (הגם שהנאשמים היו מיוצגים בנפרד), והענישה מצויה במובהק בגדרי ההסדר (שהיה הסדר טווח). אכן, בפרשה הספציפית היה חלקו של המערער קטן משל חבריו, בודאי משל נאשם 1. ואולם, עסקינן בקוקאין, לא פחות, שחלקו לא הוחזר על-ידי המערער לאחרים, ולמערער עבר לא פשוט כל עיקר בעבירות סמים ברמת סחר, עליהן ריצה מאסר בפועל של 34 חודשים, גם אם עבירותיו האחרות הן עבירות צבאיות של היעדר מן השירות בלא רשות. איני סבור כי את היותו של המערער אסיר ברישיון בשעת המעשה אין לזקוף לחובתו, כטענת הסניגורית; יש מחיר גם לתעוזתו של מי שאך לא מכבר יצא מכלאו והוא אץ לעבירות חדשות. הנאשם 1 צבר הרשעות רבות יותר, לרבות הריגה ועבירות אלימות אחרות, וריצה מספר מאסרים בפועל, ומבחינה זו עברו מכביד יותר, אך זו הפעם הראשונה שבה שלח ידו בעבירות סמים; עניינו אינו לפנינו, אך גם אם אולי הקל עמו בית המשפט קמא במידה מסוימת, בלא שאטע כל מסמרות, אי אפשר לבדוק את הדברים במלקט (פינצטה בלע"ז). עברו של מערער 3 מכביד במעט פחות, למצער באשר למאסר, אך גם הוא לא בחל בעבירות סמים לפני כן. סוף דבר, עסקינן בשלושה עבריינים מועדים, לפחות עד הנה, והתמונה הכוללת אינה כזו המצדיקה התערבות בית משפט זה. על כן איננו נעתרים לערעור. נוכח גילו של המערער שהוא עדיין צעיר (31), יש תקוה כי יתעשת, ואם אכן התנהגותו במאסר טובה כאמור בכתב הערעור, עשוי הדבר לעמוד לזכותו בעתיד, בלא שניטע מסמרות.

כאמור, לא נוכל להיעתר לערעור.
