פסק-דין
ערעור על גזר הדין שהושת על המערער (יליד 1985), והוא מאסר בפועל ל-85 חודשים, 28 חודשי מאסר על תנאי וקנס בסך 50,000 ₪ או 300 ימי מאסר תמורתו. המערער הורשע לפי הודאתו בעבירה של החזקת סם מסוכן שלא לצריכה עצמית, עניינה קשר ליבוא סם מסוכן ממצרים לישראל, שבגדרה הוא ואחרים קיבלו מגורמים מצריים 2 שקי יוטה של הסם מריחואנה במשקל כולל של לא פחות מאשר 589.6 ק"ג , שומו שמים. בנסיון המעצר נהרג אחד השותפים לקשר.
בית המשפט קמא נדרש לכמות יוצאת הדופן של הסם, וקבע כי גם אם – כטענתו – היה המערער בלדר, ראוי הוא לעונש מחמיר, מה גם שלא ברור מי בעלי הסם. בפנינו טענה עו"ד בר ציון כל הניתן, ועיקר טענותיה כי המערער לא היה מודע לכל כמות הסם, וכי כשהמדובר בבלדר, אף כשעסקינן בכמות סם גדולה, אין להחמיר כל כך. נטען גם לגבי הקנס הכספי, שהוא גבוה מדי בנסיבות ומוסיף עשרה חודשים למאסר.
בא כוח המ דינה
טען כי כמות הסם מופיעה בכתב האישום בו הודה המערער; ואין כל ראיות שהמערער היה בורג קטן בפרשה, משלא הוכח אחרת; וכן כי הפסיקה תומכת בענישה מעין זו. נטען עוד, כי נושא הקנס והמאסר תמורתו אינו חריג.
איננו רואים מקום להתערבות בעונש, בכפוף לנושא המאסר חלף הקנס. הנתון המרכזי הוא הכמות המבהילה של הסם; נזכיר לעניין זה את ע"פ 8939/08 מוזס נ' מדינת ישראל
(לא פורסם) שם הושתו בעבירה של מאות ק"ג חשיש שש וחצי שנים (ובמצטבר שבע). נאמר שם לעניין טענה כי לא היה ידוע למערער במה הוא משתתף, כי "גם לשכל הישר מקום בפרשנות הראיות ובהערכתן, ומי יקבל טענה כי המערער היה כשלושת הקופים הנודעים הסוכרים את פיהם, אוזניהם ועיניהם". בשינויים המחויבים יפים הדברים כאן. עבירה של החזקת סם מסוכן שלא לצריכה עצמית (סעיף 7 לפקודת הסמים המסוכנים (נוסח חדש), תשל"ג-1973) היא אחותה התאומה – מבחינת רמת הענישה שבדין – של עבירת הסחר בסמים, אשר עונשה (לפי סעיף 19א לפקודה) עשרים שנה. כשעסקינן ב- 589.6 ק"ג סם מסוכן, יהא אשר יהא חלקו של המערער, אין הענישה יכולה להיות ברף נמוך במשרעת העונשין. על כן לא ראינו דופי בגדר הדין קמא לעניין זה. עם זאת מצאנו להקל על המערער קמעא במובן אחד, והוא כי תמורת הקנס תעמוד על 150 ימי מאסר (במקום 300). בנתון לתיקון זה בגזר הדין, איננו נעתרים לערעור.
