פסק-דין
דעתנו היא שאין בסיס לערעור המופנה נגד החלטתו של בית המשפט המחוזי בנצרת מיום 2.6.2014. בהחלטה השית בית המשפט על המערערים קנס של 1,000 ש"ח ליום לפי פקודת ביזיון בית משפט בשל הפרתו של פסק-דין מיום 19.8.2013 שחייב את המערערים להשיב 104 תבניות לייצור מוצרי פלסטיק לידי המשיבים. יצוין, כי המערערים הגישו ערעור על פסק-הדין מיום 19.8.2013 לבית משפט זה (ע"א 7114/13). הערעור קבוע לשמיעה בסוף שנה זו. בקשה של המערערים לעיכוב ביצועו של פסק-הדין מיום 19.8.2014 – נדחתה.
אף שהגענו למסקנה כי דינו של הערעור דנא להידחות, נראה לנו לנכון ליתן למערערים ארכה של 45 יום מהיום (כשהפגרה תבוא במניין הימים) לשם השבתן של התבניות לידי המשיבים. היה והתבניות יוחזרו תוך התקופה הנזכרת יתבטל החיוב בקנס. לעומת זאת, אם 104 התבניות לא יוחזרו כאמור, יעמוד על כנו החיוב בקנס של 1,000 ש"ח ליום, וזאת החל מן המועד שקבע בית משפט קמא (15.6.2014).
המערערים ישאו בכל מקרה בהוצאות בסכום של 20,000 ש"ח.
