החלטה

מונחת לפניי בקשה לעיכוב ביצועו של עונש מאסר בפועל של 24 חודשים שהושת על המבקש בגזר דין שניתן על ידי בית המשפט המחוזי בנצרת (כב' השופט ת' כתילי ) בת"פ 16890-07-12.

על פי המתואר בכתב האישום, רכש המבקש 100 כדורי תחמושת לאקדח בקוטר 9 מ"מ
ובהמשך מכר אותם ברווח לאחר. כשבועיים לאחר מכן שב ורכש המבקש 200 כדורי תחמושת. במטרה למכור את הכדורים, קבע המבקש מפגש עם הקונה אך כח משטרתי שהגיע למקום עצר את המבקש ובכך סוכלה העסקה.
בגין מעשים אלה הורשע המבקש בעבירות של סחר בנשק לפי סעיף 144(ב2), ניסיון לסחר בנשק לפי אותו סעיף בצירוף סעיף 25, רכישה והחזקת נשק לפי סעיף 144(א), נשיאת נשק לפי סעיף 144(ב) וקשירת קשר לביצוע פשע לפי סעיף 499(א)(1) – כל הסעיפים לפי חוק העונשין, התשל"ז-1977. הרשעתו של המבקש התבססה בעיקרה
על הודאתו במשטרה בדבר המעשים שמיוחסים לו, אף שבעדותו חזר בו מהודאתו ככל שהדבר נגע למעשיו הקשורים בעסקה המוקדמת. לטענתו, הוא בדה את הסיפור עקב חששו "להסתבך" כאשר השוטרים שאלו אותו האם הוא מחזיק ברשותו אקדח. חרף חזרתו מהודאתו, הרשיע בית המשפט המחוזי את המבקש גם במעשים המיוחסים לו בעניין העסקה המוקדמת, בקובעו כי יש בתחמושת שנמצאה ברכבו של המבקש וכן בעדותו לפיה הוא מאשר את פרטי העסקה המאוחרת כדי לשמש "דבר מה נוסף" המאמת את הודאת המבקש.
לאחר הרשעתו, גזר בית המשפט המחוזי את דינו של המבקש והשית עליו: 34 חודשי מאסר, מתוכם 24 חודשי מאסר בפועל בניכוי כחודש וחצי ימים בהם היה במעצר (מיום 3.7.2012 ועד 17.8.2012) ויתר החודשים על תנאי לבל יעבור במהלך 3 שנים כל עבירת נשק, וכן קנס כספי בסך 5,000 ₪.
על הכרעת הדין וגזר הדין כאמור הגיש המבקש ערעור לבית משפט זה ולצידו הבקשה שלפניי.

לטענת המבקש סיכויי הערעור טובים. טענתו המרכזית בערעור – אשר לגביה סבור המבקש כי סיכויי קבלתה גבוהים – היא בדבר העדר תוספת ראייתית שתתמוך בהודאתו של המבקש ביחס לביצוע העסקה המוקדמת שבגינה הורשע. בתוך כך טוען המבקש כאמור כי הוא בדה את סיפור המעשה שמסר בהודאתו ביחס לעסקה זו. עוד מציין המבקש כי בתסקיר שירות המבחן בעניינו הומלץ על עונש של ששה חודשי מאסר שירוצו בדרך של עבודות שירות וכי ערעורו מבוסס גם על המלצה זו.
המשיבה טוענת כי אורך המאסר שהוטל על המבקש אינו מצדיק את עיכוב ביצוע העונש. לטענתה, הערעור ממוקד לעסקה המוקדמת בה הורשע המבקש וגם אם יתקבל ערעורו של המבקש בעניין זה, הרי שעדיין תיוותר הרשעתו בגין העסקה המאוחרת שהעבירות הרלוונטיות לגביה חמורות כשלעצמן. די בכך, לשיטתה, כדי להביא לדחיית הבקשה.

לאחר שמיעת הצדדים ועיון בחומר הגעתי לכלל מסקנה כי דין הבקשה להידחות. בבסיסה של הלכת שוורץ (ע"פ 111/99א שוורץ נ' מדינת ישראל , פ"ד נד(2) 241) עומד הצורך לאזן בין האינטרס הציבורי בריצוי מיידי של עונש שהוטל על מי שהורשע בפלילים לבין שמירה על זכותו לערער על עונשו, מבלי שריצוי עונש המאסר ייתר הדיון בערעור. מכאן, שבית המשפט צריך לבחון את סיכויי קבלתו של הערעור, הגם שמדובר בבחינה ראשונית שהאומדן בה הוא לכאורי בלבד.
במקרה שלפניי, גם אם טענתו המרכזית של המבקש בערעור בדבר העדרה של תוספת ראייתית להודאתו תתקבל – ואינני מביע עמדה בעניין זה – הרי שצודקת המשיבה בטענתה כי המעשים בגינם הורשע המבקש הסובבים את העסקה השנייה חמורים דיו. אם יתקבל ערעורו של המבקש בעניין העסקה הראשונה – ושוב מבלי להביע כל עמדה בדבר סיכוייה של הטענה להתקבל בערעור – לא נראה על פני הדברים כי הדבר עשוי להוביל להפחתה בעונשו עד כדי המרת עונש המאסר בעבודות שירות, או לביטול עונש המאסר בפועל כלל. כמו כן, גם אין די בתסקיר חיובי הממליץ על ריצוי המאסר בדרך של עבודות שירות כדי להביא בנסיבות העניין לעיכוב עונש המאסר בפועל שהוטל על המבקש.

הבקשה נדחית. המבקש יתייצב לריצוי מאסרו בבימ"ר קישון ביום 28.7.2013 עד השעה 10:00, או על פי החלטת שב"ס, כשברשותו תעודת זהות או דרכון. על המבקש לתאם את הכניסה למאסר, כולל האפשרות למיון מוקדם, עם ענף אבחון ומיון של שב"ס, טלפונים: 08-9787377, 08-9787336.
