פסק -דין
לאחר הדיון הודיע המערער על משיכת ערעורו, והוא נמחק בנסיבות. אשר לערעור המדינה, במצב שנוצר איננו רואים להכריע בו, אך נציין כי באופן עקרוני דעתנו שונה – בכל הכבוד – מן העמדה שהובעה בבית המשפט המחוזי, במובן המסגרת הדיונית הראויה בכגון דא. נאמר רק, כי בסוגיה הכללית של הדרך לטיפול במצבים מעין זה שעלה כאן, קרי, משאלת נאשם להשגת חומר ראיות להגנתו באופן שיטופל במעמד צד אחד, נראה לנו כי דרך המלך להשגת חומר נוסף במהלך המשפט היא סעיף 108 לחוק סדר הדין הפלילי (נוסח משולב), תשמ"ב-1982, ועל דרך הכלל לא יהא זה סעיף 43 לפקודת הפרוצדורה הפלילית (מעצר וחיפוש) או סעיף 3 לחוק סדר הדין הפלילי. השאלה הטעונה ליבון היא בעיקרה הגמישות הנתונה לבית המשפט הדיוני בהידרשו לבקשות לפי סעיף 108, והכרעה בכך תבוא לעת מצוא.
