החלטה

בעקבות אירוע אלים שהתרחש בליל ה- 9.3.2019 במחנה פליטים שועפט בירושלים, בו היו מעורבים המשיבים מצד אחד ופארס עוודתאללה (להלן: פארס ) מצד שני במהלכו התנהלו חילופי ירי בין הצדדים הניצים, נפצעו מהירי ההדדי פארס, המשיב 1 והמשיב 2 ונגרמו להם חבלות חמורות.

בעקבות אירוע זה הגישה המדינה (להלן: המדינה/המבקשת ) שני כתבי אישום נפרדים בבית משפט המחוזי בירושלים, האחד נגד פארס והאחר נגד המשיבים. בכתב האישום נגד המשיבים ייחסה המדינה להם עבירות של חבלה בכוונה מחמירה, החזקת נשק, נשיאת נשק וירי מנשק חם. בתמצית, בכתב האישום נגד המשיבים נטען כי המשיבים טמנו לפארס מארב, חסמו את נתיב נסיעתו, המשיב 6 ניגש לחלון רכבו של פארס, ניפץ אותו בעזרת חפץ, פארס יצא מהרכב ובמקום התפתח קרב יריות בין פארס לבין מי מהמשיבים, שכתוצאה ממנו נפצעו המשיבים 1 ו- 2 ופארס. כתב האישום נגד פארס משקף תמונת ראי לכתב האישום שהוגש נגד המשיבים.

ביום 19.5.2019 תיקנה המדינה את כתב האישום נגד פארס, בכך שהשמיטה ממנו רק את העבירה של חבלה בכוונה מחמירה. כתב האישום נגד המשיבים נותר כשהיה.

הסיבה לתיקון כתב האישום נגד פארס לקולא נבעה מידיעה מודיעינית מספר 109 (להלן: הידיעה המודיענית ), לפיה המשיבים היו אלה שארבו לפארס ופתחו לעברו ראשונים באש, ופארס "החזיר" להם בירי. יוער, כי תוכנה של הידיעה המודיענית נמסר במלואו למשיבים, ומה שנחסה בתעודת החסיון היה זהותו של מוסר הידיעה.

בעקבות התפתחות זו הגיש בא כוח המשיבים בקשה להסרת חיסיון לפי סעיף 45 לפקודת הראיות [נוסח חדש], התשל"א-1971, בה ביקש לחשוף את זהותו של מוסר הידיעה בנימוק שהדבר חיוני להגנת המשיבים שמא בחקירת מוסר הידיעה על דוכן העדים, לאחר שתיחשף זהותו, יצליחו המשיבים לבסס הגנתם ביחס לעבירה של חבלה בכוונה מחמירה המיוחסת להם.

המדינה התנגדה להסרת החיסיון וטענה כי לידיעה המודיענית היתה אך תרומה חלקית להחלטתה לתיקון כתב האישום נגד פארס, וכי על פי סרטון שתיעד את האירוע נראה פארס כמי שנקלע למארב, אך לא ניתן לראות מי פתח ראשון באש ותוכן הידיעה המודיעינית לפיה המשיבים הם שירו תחילה ופארס רק "החזיר" להם, סייע להחלטתה לתקן את כתב האישום בעניינו של פארס.

ביום 12.7.2019 החליטה כב' השופטת זנדברג בבע"ח 19757-06-19 להורות על הסרת החיסיון על זהותו של מוסר הידיעה המודיעינית (להלן: ההחלטה ).

ביום 22.7.2019 זיכה בית המשפט המחוזי בירושלים (כב' השופט א' דראל ) את המשיבים מהעבירות שיוחסו להם בכתב האישום שבת"פ 57474-03-19: חבלה בכוונה מחמירה – עבירה לפי סעיף 329 בצירוף סעיף 29(א) לחוק העונשין, התשל"ז-1977 (להלן:
החוק ); החזקת נשק – עבירה לפי סעיף 144(א) בצירוף סעיף 29(א) לחוק; נשיאת נשק – עבירה לפי סעיף 144(ב) בצירוף סעיף 29(א) לחוק וירי מנשק חם –
עבירה לפי סעיף 340א(ב) בצירוף סעיף 29(א) לחוק. זיכוי המשיבים נעשה על פי בקשת המבקשת, שחזרה בה מכתב האישום, וזאת בעקבות החלטה שחייבה אותה בחשיפת זהותו של מוסר הידיעה המודיעינית .

בו ביום הורה בית המשפט המחוזי לבקשת המדינה על מעצר המשיבים 1, 2 ו- 6, על מעצר המשיב 3 בפיקוח אלקטרוני ועל המשך שהות המשיבים 4 ו- 5 בתנאי מעצר בית מלא בתנאים, וזאת למשך 72 שעות.

ביום 23.7.2019 הגישה המבקשת הודעת ערעור על פסק הדין ובמסגרתה על ההחלטה בטענה כי שגגה נפלה מלפני בית המשפט בקובעו כי חשיפת זהותו של המקור הינה חיונית להגנתם של המשיבים. בד בבד עם הודעת הערעור הגישה המבקשת בקשה דחופה למעצר המשיבים עד לתום הליכי הערעור וזאת מכוח הוראת סעיפים 21 ו- 22(ב) לחוק סדר הדין הפלילי (סמכויות אכיפה-מעצרים) התשנ"ו-1996. בהמשך לבקשה הנ"ל הוריתי על מעצר המשיבים בתנאים כמפורט לעיל, עד להחלטה אחרת של בית משפט זה.

ביום 25.7.2019 התקיים דיון בבקשת המבקשת. בדיון חזרה המדינה על בקשתה למעצר המשיבים עד להחלטה בערעור, ואילו בא כוח המשיבים ביקש לאור זיכויים לשחררם ולו בתנאים עד למתן פסק דין בערעור, כשעיקר טיעונו התמקד בחיוניות הראיה ובפוטנציאל הזיכוי הטמון בה. עוד ביקר את התנהלותה של המדינה, שהפלתה בין מעורבים באותה פרשה, בכך שתיקנה את כתב האישום נגד פארס והותירה את כתב האישום נגד המשיבים כמות שהוא.

השאלות שעמדו במרכז הדיון היו: מידת חיוניות חשיפת זהותו של מוסר הידיעה המודיעינית להגנת המשיבים וסיכויי הערעור, כשההכרעה בראשונה משליכה על השניה.
הסמכות להכריע בשאלת חיוניות הראיה להגנת המשיבים נתונה להרכב שישמע את הערעור. כאשר בשלב זה של הדיון כל שנדרש הוא הערכתם של סיכויי הערעור וככל שיוערך כי סיכויי הערעור טובים, תיטה הכף לעבר המשך מעצרם של המשיבים ולהיפך.
" לפיכך בבואנו לבחון אם יש הצדקה להאריך את מעצרו של מי שזוכה עד להכרעה בערעור – הגוברת על זכותו לצאת לחופשי – יש לתת את הדעת, בעיקר, על טיב הטענות המועלות בערעור ועל '...הפוטנציאל הגלום בהן להשפיע על תוצאות הערעור' ( ע"פ 111/99א שוורץ נ' מדינת ישראל
(להלן – פרשת שוורץ [11] ), בעמ' 280 ). לעניין זה יש לבחון, לדוגמה, אם דברים אמורים בהשגות על מימצאי מהימנות או בהשגות על פרשנות משפטית של הוראות דין. השיקול המרכזי שיש להביא אפוא בחשבון הוא סיכויי הערעור. ככל שסיכוייו הלכאוריים של הערעור גדולים יותר, תגבר הנטייה לצוות על מעצרו של מי שזוכה. כמו כן יישקלו גם מסוכנותו של הנאשם, חומרת העבירה, משך הזמן שבו היה נתון במעצר, החשש של הימלטות מן המעצר ושיקולים נוספים (לעניין זה השוו, אמנם לעניין עיכוב ביצוע עונש מאסר בערעור, ע"פ 3601/01 זגורי נ' מדינת ישראל [12]).

בהחלטתו מיקד בית המשפט קמא את עיקר הנמקתו לחשיפת זהות מוסר הידיעה המודיעינית בכך:
"משהמדינה עצמה סברה כי הראיה היא חיונית להגנתו של פארס, ולאחר שעיינתי בחומר החסוי, אזי אין מנוס מן המסקנה שהראיה חיונית גם להגנת המשיבים. בהקשר זה נראית לי טענת ב"כ המשיבים לפיה אין מקום להניח מראש כי מכיוון שבידיעה נמסר שהמשיבים הם שפתחו בירי אזי זה יהיה בהכרח תוכן עדותו של מוסר הידיעה בבית-המשפט. הידיעה שנמסרה היא קצרה מאד, וקשה להעריך את מלוא משמעותה, ובוודאי שלא ניתן לומר – אך בשל תוכנה הקונקרטי הנוכחי של הידיעה – כי הראיה אינה חיונית להגנת המשיבים ובעת ובעונה אחת לומר כי היא חיונית להגנתו של פארס".
מסקנה חד משמעית זו של בית המשפט קמא, היוצרת סימטריה בחיוניות הראיה הן להגנת המשיבים והן להגנת פארס, אינה נקיה מספקות.
לאחר ששמעתי את טענות באי כוח הצדדים ובחנתי את הנמקת בית המשפט קמא, ולאחר שזהות המקור נחשפה לעיני בית המשפט כאן, לרבות אופן שרשור הידיעה המודיעינית לידי היחידה החוקרת, ועובדת היות המקור אדם שאינו עד במשפט, התקשיתי לקבל את מסקנתו של בית המשפט קמא, מסקנה שהתקבלה על ידו בעיתוי מוקדם, בטרם נפרשה לפניו יריעת המחלוקת במלואה וקו הגנתם של המשיבים טרם נחשף. זאת, כאשר המותב שקיבל את ההחלטה אינו המותב השומע את התיק העיקרי ויכולתו, בשלב מוקדם זה של המשפט לאתר את מקום השתבצותה של הראיה החסויה במכלול הראייתי העומד לחובת המשיבים והשלכתה על הגנתם, מוגבלת.
"רוצה לומר, כי עתירה לגילוי ראיה, המוגשת על ידי הסנגוריה עוד לפני שהנאשם הציג את קו הגנתו היא עתירה מוחלשת מיניה וביה. כפי שנאמר לא אחת בפסיקה, השאלה אם חיסוי ראיות מסוימות עלול לפגוע בזכותו של הנאשם למשפט הוגן אינה שאלה תיאורטית והיא נבחנת, בין היתר, על רקע מיקומה של הראיה בשדה המריבה בין הצדדים ולאחר שבקעת המחלוקת נגלתה לעיני בית המשפט (בש"פ 6392/97 בלביסי נ' מדינת ישראל , פ"ד נא(5) 176, 181 והאסמכתאות שם)".
מבלי לטעת מסמרות ובזהירות המתחייבת מטיב ההליך שלפניי, ניתן להעריך כי סיכויי הערעור אינם מופרכים כלל. העובדה שהמבקשת שקלה בין יתר שיקוליה את תוכן הידיעה המודיעינית כשיקול שהכריע את הכף לעבר תיקון כתב האישום שהגישה נגד פארס בדרך של השמטת העבירה של חבלה חמורה בכוונה מחמירה שיוחסה לו מלכתחילה בכתב האישום שבמקור, אין בה כדי ללמד מניה וביה על קיומה של סימטריה בחיוניות הראיה ועל כך שטמון בה פוטנציאל מזכה לגבי המשיבים, שלעת הזו קיימת נגדם מסכת ראיות לכאורית גלויה המבססת את אשמתם.
אין באמור כדי למנוע מהמשיבים להעלות כל טענה אחרת הקשורה בהתנהלות המדינה בכל הנוגע לתיקונו של כתב האישום נגד פארס על כל המשתמע מכך.

לאור כל האמור סיכוייו הלכאוריים של הערעור חומרת המעשים והמסוכנות הנשקפת מהמשיבים, לא מצאתי לשנות מתנאי מעצרם כפי שהורה עליהם בית המשפט בהחלטתו מיום 22.7.2019.
יומן בית המשפט יקבע את שמיעת הערעור בהקדם האפשרי.
