החלטה
לצורך הדיון אני נכון לצאת מנקודת הנחה כי סיכויי הערעור מעולים בכל הקשור לשאלה המשפטית המרתקת לגבי היסוד הנפשי הנדרש לצורך סעיף 329 לחוק העונשין, התשל"ז – 1977. אלא, שבסופו של יום, בהתחשב בכך שהמבקש הורשע בעבירה של גניבת רכב, התחמק משוטרים ונערך אחריו מרדף שבמהלכו נפצע שוטר, ולאחר מכן ניסה להימלט מהשוטרים שנאלצו לירות באויר, ואף נאבק עם השוטרים והתנגד למעצר – בהתחשב בכל אלה קשה להניח כי תהא לתוצאת הערעור בנקודה זו השלכה של ממש על רמת הענישה. המבקש נדון ל-24 חודשי מאסר בפועל, ובהתחשב ברף הענישה הנהוג במקומותינו לגבי מרדפים, הרי שמדובר בעונש מתון ביותר. אשר על כן, אני דוחה את הבקשה.
