המערער הורשע על פי הודאתו בהסדר טיעון בכתב אישום על פיו, במהלך החודשים ינואר-פברואר 2013 רכש חומר נפץ במשקל 133 גרם המיועדים להרכבת מטען חבלה שהכיל חומר נפץ מרסק מסוג ציקלוניט, וכן נפצים וחוט חשמל (להלן: מרכיבי מטען החבלה ). עובר ליום 5.3.2013 קשרו אלירן וקנין (להלן: אלירן ) ואפי ג'רבי (להלן: אפי ) קשר להרכיב מטען חבלה ולפגוע באמצעותו בנכס במזיד. בהמשך פנו אלירן ואפי למערער במטרה לרכוש ממנו חלק ממרכיבי מטען החבלה. ביום 5.3.2013 מכר המערער לאלירן ואפי חלק ממרכיבי מטען החבלה, ולבקשתם סיפק רכיבים נוספים לצורך הרכבת המטען: שתי מאפרות מתכת, רסיסים מתכתיים, שקית וניירות. השלושה פנו לביתו של אפי ושם הרכיבו מטען חבלה בעל מערכת חשמלית המיועדת להפעלת המטען מרחוק (להלן: מטען החבלה ). בתמורה קיבל המערער מאפי ואלירן הסך של 6000 ₪.
עובר ליום 12.3.2013 וללא ידיעת המערער, הטמינו אלירן ואפי או מי מטעמם את מטען החבלה בסניף "טיב טעם" ברחוב אבן גבירול בתל אבי ב. ביום 12.3.2013 הוצת הסניף, ומספר ימים לאחר מכן התגלה מטען החבלה מבלי שהופעל.
בית משפט קמא העמיד את מתחם הענישה על 7-3.5 שנים, והשית על המערער 46 חודשי מאסר בפועל בניכוי ימי מעצרו, וכן 18 חודשי מאסר על תנאי למשך 3 שנים מיום שחרורו ממאסר בגין כל עבירה לפי סעיף 144 לחוק העונשין.

על חומרת העונש נסב הערעור שבפנינו.
המערער טען, בין היתר, כי העונש שהושת עליו סוטה מרמת הענישה המקובלת והראויה בעבירות דומות. בנוסף, מיקד המערער את טיעונו באחידות הענישה, באשר גם על אלירן ואפי – נגדם הוגש כתב אישום נפרד – הושת עונש של 46 חודשי מאסר בפועל. לטענת המערער אין להשוות בינו לבין אלירן ואפי, באשר חלקו קטן באופן משמעותי ביחס לחלקם; המערער הינו צעיר נטול עבר פלילי, בעל סביבה משפחתית תומכת, ששיתף פעולה במהלך חקירתו ומשפטו, בניגוד לאלירן ואפי שאף שמרו על זכות השתיקה בחקירה וכפרו בפתח משפטם; אלירן ואפי היו הגורמים הדומיננטיים בפרשה, והם שהטמינו את המטען ללא ידיעת המערער; המערער הביע חרטה עמוקה, עבר תהליך שיקום ומתנהג ללא רבב במהלך מאסרו.

דין הערעור להידחות.
לכאורה יש ממש בטענת המערער לגבי השוואת עונשו עם העונש שהושת על אלירן ואפי, נוכח העבר הפלילי של השניים ודרך התנהלותם. אלא שלהבדיל מהמערער, העונש של 46 חודשי מאסר שהושת על אלירן ואפי מקורו בהסדר טיעון "סגור" הנובע מקשיים ראייתיים שעמדו בפני התביעה, וכידוע אין להקיש מהסדר טיעון לגבי העונש הראוי.
משהזכרנו את העונש הראוי, הרי שהעונש שהושת על המערער אינו מצדיק התערבות ערכאת הערעור. הפסיקה בעבירות נשק היא מחמירה, תוך מתן משקל לשיקולי הרתעה וגמול, וזאת בשל פוטנציאל הפגיעה הרב הגלום בעבירות אלה:
"סחר בלתי חוקי בנשק סולל את הדרך לפעילות אלימה ובלתי חוקית והדבר חמור שבעתיים במציאות הישראלית בה קיים חשש תמידי כי נשק המוחזק באופן בלתי חוקי יתגלגל לא רק לידים עברייניות, עניין חמור לעצמו, כי אם לידיהם של אלה המבקשים להוציא אל הפועל פעילות חבלנית עוינת" (ע"פ 2251/11 נפאע נ' מדינת ישראל , פסקה 5 (4.12.2011)).
ענייננו במטען חבלה, וגם אם המערער לא ידע על השימוש המדוייק שאלירן ואפי התכוונו לעשות במטען, הרי שאין צורך בדמיון מפותח כדי להבין כי מטען החבלה לא נועד לצרכים תמימים. מטעני חבלה מתפוצצים ומסכנים עוברי אורח תמימים ברחובותינו, פגיעתם ברכוש ובנפש קשה והם מביאים להסלמת הפעילות העבריינית. גם אם העונש שהושת על המערער אינו מן הקלים, הרי שכחלק ממלחמת החורמה שמנהלים גורמי אכיפת החוק בכל חוליה וחוליה בשרשרת רכישת המטען – הכנתו – הטמנתו, על בית המשפט לתרום תרומתו בענישה מכאיבה בעבירות כגון דא.

אשר על כן, הערעור נדחה.
