בעקבות הודאתו בעובדותיו של כתב אישום מתוקן, הורשע המערער בעבירות של גניבת רכב, שוד מזוין, נהיגה ללא רשיון, סיכון חיי אדם בנתיב תחבורה, החזקת נכס החשוד כגנוב והחזקת סם לצריכה עצמית. בית המשפט המחוזי השית עליו ארבע שנות מאסר וכן שני מאסרים מותנים. הערעור מופנה נגד חומרת העונש.

המערער השתמש בסם מסוג אקסטזי. בעודו נתון תחת השפעת הסם החל הוא במסע בו ביצע סדרה של עבירות. תחילה הוא התפרץ לכלי רכב וגנב ממנו פריטים שונים. בהמשך הוא גנב מכונית אחרת ונסע לתחנת דלק שם שדד מן המתדלק סכום של 850 ש"ח. השוד בוצע תוך שהמערער מחזיק בידו מברג באורך 24 ס"מ . המערער החזיק באותה עת סם מסוג חשיש וכן פריטים מסוימים - רדיו טייפים ומגבר - החשודים כגנובים. לאחר מכן נתקל המערער באנשי משטרה, אשר דרשו ממנו לעצור. המערער נמלט ברכב הגנוב, תוך שהוא נוהג בצורה פראית. במהלך הבריחה הוא אף התנגש ברכב אחר.

התיאור של המסע רצוף העבירות בהחלט מסביר מדוע הושת עונש של ארבע שנות מאסר. מדובר במצבור של עבירות, שבוצעו תוך זמן קצר, והכל שעה שהמערער נתון להשפעת סמים. יצוין, כי בעבר הורשע המערער בעבירת סם. כמו כן, לאחר גזר הדין הנוכחי הוא נדון בהליך אחר בגין עבירות אלימות לשישה חודשי מאסר, אשר שלושה מהם הושתו במצטבר למאסר הנוכחי.

אכן, המערער עבר בכלא תהליך גמילה לעניין התמכרותו לסם. ראוי הוא בהחלט לעידוד. אך אין מתחייב מכך קיצור עונש המאסר. מדובר בעונש הולם. ניתן להניח שאם המערער ימשיך בהתנהגותו הטובה בין כותלי הכלא, כי אז יינתן לכך משקל בבוא היום.
5.
הערעור נדחה.
