השופט א' א' לוי:
המערער הוא תושב רפיח שברצועת עזה, וביום 30.5.06 הוא הסתנן לישראל מתוך כוונה לעבור להתגורר באזור יהודה ושומרון. זמן קצר לאחר שחצה את הגבול, נעצר על ידי כוחות הביטחון ונמצא מחזיק בסכום של 10,400 ש"ח ו-2000 דולר. בגין מעשה זה יוחסה למערער עבירת הסתננות, לפי סעיף 2 לחוק למניעת הסתננות (עבירות ושיפוט), התשי"ד-1954. כתב האישום שהוגש לבית המשפט המחוזי בבאר-שבע כלל שלושה אישומים נוספים, שעניינם בהצטרפות המערער בשנת 2001 לארגון הטרור הג'האד האיסלאמי, ופעילותו במסגרתו. נטען, כי חבר הארגון לימד את המערער להכין חומר נפץ לצורך השימוש בו במטעני חבלה, ובעקבות כך הכין המערער כ- 150 ק"ג של החומר, אותם מסר לפעילי הארגון.
המערער הודה בכל אלה, ובעקבות כך הורשע בעבירות נוספות – אימונים צבאיים אסורים, עבירות בנשק וחברות בארגון טרור. בגין כל אלה נדון המערער לעשר וחצי שנות מאסר ושנים עשר חודשים מאסר על-תנאי. כנגד עונש זה מופנה הערעור. נטען, כי העונש נוטה לחומרה יתרה, ולא ניתן בו משקל הולם לזמן שחלף מאז ביצוע העבירות, להחלטת המערער להפסיק את פעילותו בארגון מיוזמתו, לנסיבותיו האישיות ולהודאתו. כן נטען, כי גזר-הדין חורג מרמת הענישה הנוהגת.
אין בידינו לקבל את הערעור. המערער הצטרף מדעת ומרצון לארגון טרור רצחני, ובעקבות כך הודרך כיצד להכין חומר נפץ, ואף עשה שימוש בידע זה. למערער היה נהיר היטב מהו השימוש הפוטנציאלי בחומר הנפץ שהכין, ומכאן סכנתו המופלגת לביטחונם של חיילי ישראל ותושביה. אם תוסיף לכך את עבירת ההסתננות בה חטא המערער, והעובדה שתופעה זו אינה נחלתו בלבד, נדמה כי העונש שהושת עליו, חרף חומרתו, הנו מידתי וראוי.
אי-לכך, הערעור נדחה.
