המעשים המיניים שבהם הודה המערער (יליד 1992) ובהם הורשע, שנעשו כלפי אחיותיו, בעת היותו קטין בגילים שבין 15 ל-17 (2009-2007) הם חמורים. על כך אין חולק. אין גם חולק שהוא עצמו היה נתון לתקיפה מינית בתקופה שקדמה במקצת למעשים הללו. הוא נדון ל-8 שנות מאסר שראשיתן מיום מעצרו – 7.9.09. כן הוטל על המערער במועד מאוחר יותר, בעבירות אחרות שבהן חטא (תקיפה, איומים ושבל"ר), מאסר בחופף לתיק דנא. ערעורו נסב על שניים – טענה כי המותב שהן בתיקו בבית המשפט קמא דן גם במי שתקף אותו (בתיקו שלו), ולא היה מקום לכך; וטענה כי העונש שניתן חמור בהתחשב בפסיקה בכגון דא.
בדיון קודם (19.7.12) הביעה המ דינה
בהגינותה נכונות לשקול הסכמה להפחתה בעונש ככל שהמערער יקבל טיפול, וכך הצענו למערער. לדאבוננו לא צלח הדבר, המערער לא שיתף פעולה ולשיטתו (באמצעות חוות דעת של פסיכיאטר מטעמו) הטיפול לו הוא זקוק אינו מתאים לשהות במאסר, דבר שאיננו מביעים דעה עליו. שירות המבחן לא בא בנסיבות בהמלצה. באת כוח המ דינה בהגינותה, חרף אי הנחת מתוצאת הדחיה, מסכימה כי הנסיבות המיוחדות של המקרה, ובהן העובדה שהמדובר במי שנתקף מינית לפני המעשים שבתיק דנא, ראויות להיות מובאות בחשבון אם תישקל הפחתה. כן ציינה במענה לשאלתנו, כי לא נמצאה פסיקה בנסיבות כאלה ברמת ענישה זו.
סבורים אנו כי יש מקום להפחית מעונשו של המערער. באשר לטענה הראשונה, אמנם, ככלל ראוי לטעמנו להימנע, ולוא בשל מראית העין, מדיון באותו מותב בתקופה קרובה בתיקים של תוקף ונתקף, ואולם לא ראינו לומר כי נסיבה זו כשלעצמה תרמה לעונש. נידרש איפוא לעונש לגופו. לא יתכן חולק כי המדובר בעבירות חמורות, אך גם לא יתכן חולק כי המערער היה קטין בעת המעשה ולמחוקק גישה מיוחדת לגבי קטינים. מצרים אנו על כך שהמערער לא נתן ידו לאפשרויות הטיפול, אך מתוך עיון בפסיקה הקיימת ומתוך ייחוד הנסיבות המוסף שבענייננו, קרי, התקיפה המינית הקשה שחוה המערער עצמו, נראה לנו כי בית המשפט קמא החמיר. החלטנו איפוא להעמיד את עונש המאסר בפועל על חמש וחצי שנות מאסר. המאסר על תנאי שנגזר בבית המשפט קמא יישאר בעינו. הערעור מתקבל לפי האמור. אנו חוזרים וממליצים בפני המערער לקבל את הטיפול המוצע לו; חבל שייצא לחיים בלא שיצויד בכלים להתמודדות עם בעיותיו; ולעניין הטיפול יפה שעה אחת קודם.
