מונחים לפנינו ערעורים מטעם שתי נאשמות – אחיות – על חומרת גזר דינו של בית המשפט המחוזי תל אביב – יפו (השופט ג' נויטל ) מיום 26.10.2010 בת"פ 7926-01-10. המערערות הורשעו על פי הודאתן בשני אישומים של קשירת קשר לביצוע פשע של עבירות על פקודת הסמים לפי סעיף 499(א)(1) לחוק העונשין התשל"ז-1977 (להלן: החוק ) יחד עם סעיף 13 לפקודת הסמים המסוכנים (נוסח חדש), התשל"ג-1973 (להלן: הפקודה ), ייצוא וייבוא סם מסוכן לפי סעיף 13 לפקודה והחזקת סם מסוכן שלא לצריכה עצמית לפי סעיף 7(א) ו-7(ג) לפקודה. עמן הורשעה בעברות אלו גם אימן (להלן: האם ). המערערת בע"פ 8031/10 (להלן: איולנדה ) הורשעה על פי הודאתה באישום נוסף של קשירת קשר כנ"ל. דינן של שתי המערערות נגזר לשש וחצי שנות מאסר בפועל כל אחת, בעוד שעל האם נגזרו שלוש שנות מאסר בפועל. בנוסף נגזרו על שלושתן 18 חודשי מאסר על תנאי לבל תעבורנה עבירה מסוג פשע לפי הפקודה או עבירה לפי סעיף 499 לחוק, לרבות ניסיון, במשך 3 שנים מיום שחרורן ממאסר; וכן 6 חודשי מאסר על תנאי לבל תעבורנה עבירה מסוג עוון לפי הפקודה, לרבות ניסיון, במשך 3 שנים מיום שחרורן. המערערת בע"פ 9136/10 תיקרא להלן גבריאלה .

המערערות ואמן (להלן: הנאשמות ) הן אזרחיות ותושבות בוליביה. על פי כתב האישום המתוקן, הנאשמות שימשו בלדריות להעברת סם מסוג קוקאין מבוליביה לישראל. ביום 31.5.2009 הגיעה גבריאלה לישראל וקיבלה מגורם עברייני סכום של כ-70,000 יורו כתשלום עבור הסם, ואת הסכום היא העבירה לגורם אחר בבוליביה, שיכונה להלן טיו . ביום 13.11.2009 קיבלו הנאשמות כשני ק"ג סם קוקאין, בלעו אותו ארוז לגופן והביאו אותו לישראל. במהלך שהותן בתל אביב הן פלטו את הסם מגופן. הן מסרו את הסם לבלדרי סם בתל אביב וקיבלו עבורו 60,000 יורו בקירוב, שאותם העבירו לטיו. בהמשך חודש נובמבר 2009 תדרכה איולנדה בלדרים נוספים כיצד לייבא לישראל קוקאין. ביום 19.12.2009 בלעו שלוש הנאשמות כשלושה ק"ג סם קוקאין ארוזים, הביאו אותם ארצה ונפגשו עם גורמים עברייניים לשם העברת הסם. ההעברה סוכלה בידי שוטרי המשטרה.
הגורם הישראלי המרכזי עמו תיאמו הנאשמות את מעשיהן והעבירו לו את הסמים הוא דוד גמזו (להלן: גמזו ), שנידון בת"פ 7897-01-10 לשמונה וחצי שנות מאסר. התביעה עתרה להטיל על שתי המערערות עונש הפחות במעט מעונשו של גמזו ולהטיל עונש מתון יחסית על האם, מתוך התחשבות בילדיה שבבוליביה.

בית המשפט המחוזי הדגיש את חומרת העבירות המתוארות, את הישנותן ומידת התכנון הגלומה בהן ואת הצורך הציבורי בהרתעה מעבריינות סם. מאידך נשקלו, בין היתר, שיקולים לקולא כגון הודיית הנאשמות בכתב האישום, העדר עבר פלילי, מצבן הנפשי והכלכלי הקשה, שיתוף פעולתן עם המשטרה ומקומן הנמוך יחסית בפירמידה העבריינית בפרשה הנידונה.
כמו כן נלקחו בחשבון נסיבותיהן האישיות של הנאשמות, ובהקשר זה נערכה הבחנה ביניהן. צוין כי גבריאלה היא בת כ-22 שנה, ולה ילד בן 5. איולנדה היא בת כ-21 שנה, ולה שני ילדים, בני 3 ו-4 שנים. לאם – ילידת 1968 – יש, מלבד המערערות, שני ילדים בני 17 ו-11 שנים. הילדים נאלצו לעזוב את הבית ולברוח כדי שמי שהנאשמות מסרו את שמו לא יתנקם בהן דרכם. המערערות גדלו בבית עם אב אלכוהוליסט, שנהג להכות אותן ואת האם, ולבסוף נטש אותן. גבריאלה הרתה כבר בגיל 17. אביהן של ילדי איולנדה נפטר, ומצבה הכלכלי דחוק. נקבע שחלקה של האם בעברות קטן מזה של בנותיה. לאור זאת ולאור הדאגה לילדיה שבבוליביה התקבלה עמדת התביעה שמוצדק להטיל עליה עונש נמוך יותר. מכאן גזר הדין דלעיל והערעורים שלפניי, המופנים כנגד משך המאסר בפועל.

בא כוחה של איולנדה טוענים ששגה בית משפט קמא בכך שלא נתן משקל ראוי לשיתוף הפעולה שלה בחקירתה שהביא הן להפללתה והן להפללת שולחיה. כמו כן, הוא מוסיף, מתבקש פער גדול בהרבה בין העונש שאיולנדה קיבלה לבין זה של גמזו – ראש הפירמידה שאף שמר על זכות השתיקה בחקירתו, ולא די בשלושים חודשים. עוד נטען שהפער בין העונש שקיבלה איולנדה לזה שקיבלה האם רחב יתר על המידה. לסיום, צוין שחומרת העונש היחסי שהוטל על איולנדה מעביר מסר שלילי לעבריינים מחו"ל, שמוטב להם שלא לשתף פעולה עם רשויות החקירה בישראל.
באת כוחה של גבריאלה סבורה שלא ניתנה שימת לב מספקת לנסיבותיה האישיות הקשות, לכך שלא הייתה ממארגני עסקת הסמים והמארגנים ניצלו את מצוקתה, לשיתוף פעולתה בחקירה ולהעדר עבר פלילי. עוד נטען כי בית המשפט המחוזי חרג מעיקרון אחידות הענישה, הן בהשוואה לפסיקות במקרים דומים והן בפער המוגזם בין העונש שגבריאלה קיבלה לעונש שקיבלה האם.
מנגד, בא כוח המדינה סומך ידיו על גזר הדין, ומדגיש את חומרת המעשים, את כמויות הסם הגדולות ואת מידת התחכום והתכנון שמאפיינת את האירועים המדוברים. באשר ליחס בין האם למערערות, המדינה סבורה שחלקן במסכת האירועים גדול יותר, שכן גבריאלה הגיעה לארץ עוד לפני הייבוא על מנת להעביר כספים, ויולנדה תדרכה בלדרים אחרים כיצד לבצע את העברות הסם. עוד צוין שיקול ההגנה על טובת ילדיה של האם, שאינם מטופלים על ידי סבתם. באשר למסר המועבר, הודגש שהמסר שאותו חשוב להעביר הוא שייבוא סמים לישראל אינו משתלם.
הכרעה

חומרת מעשיהן של המערערות גלויה וברורה. החדרת סמים למדינה למטרות מסחריות משולה להפצת רעל, ועל החברה להיאבק בהתנהגות כעין זו בנחישות רבה. ככל הנוגע לעברות סמים, כמות היא גם איכות – הכנסת 5 ק"ג קוקאין לישראל היא פגיעה שונה במהותה מאשר הכנסת משקל קטן, מבלי להקל ראש באחרונה.
יובהר, כי מבחינת המעשה והעושה, העונש כפי שניתן אינו מצדיק התערבות על בסיס הטענה שהתוצאה חמורה מידי. את נגע הסמים יש לעקור, ומתפקידו של בית המשפט לתרום את חלקו תוך הטלת עונשים מחמירים ומרתיעים. עם זאת, יש מקום להקלה מסוימת בעונש, בשל שני נימוקים מצטברים. האחד , עיקרון אחידות הענישה. כידוע, עיקרון זה תקף במיוחד כאשר עסקינן בנאשמים שהורשעו באותו מקרה. יש לזכור, כי הענקת משקל לעיקרון אחידות הענישה משמעותה שלעתים יש להעניק לו השפעה על אף פגיעה מסוימת במטרות ערכיות אחרות של הפנולוגיה. עיקרון אחידות הענישה הוא במידה רבה עיקרון של שוויון, ובתור שכזה – במובן האריסטוטלי – משמעותו יחס שווה לשווים ויחס שונה לשונים. בענייננו, הסנגורים נאחזים בעיקרון של אחידות הענישה בשני כיוונים. כלפי מעלה נטען כי הפער הקטן שבין העונש שנגזר על המערערות לבין זה שנגזר על גמזו אינו מידתי. כלפי מטה נטען כי הפער הגדול שבין העונש שנגזר על המערערות לבין זה שנגזר על האם אינו ראוי. לדעתנו, אין בנתונים שהוצגו בכדי לבסס פער כה קיצוני בין רמת הענישה של האם לזו של בנותיה. הנימוק בדבר הצורך לטפל בילדי האם, שצוין על ידי בית המשפט המחוזי, במידה שיש לקבלו, נכון גם כלפי המערערות. בכל מקרה, הפער שבין שלוש שנות מאסר לבין שש וחצי שנות מאסר מעורר קושי.
האחר , על רקע האמור היה מקום להתחשב בשיתוף הפעולה של המערערות, שהביא להפללת המעורבים האחרים, בניגוד לאלה שעמדו בראש הפירמידה. ושוב יודגש, כי נימוקים אלה הינם מצטברים, וללא הפער בין המערערות לבין האם לא היה מקום להתערב בעונש.
המסקנה היא שאין מקום לקבל את עמדת המערערות לפיה יש להפחית בצורה ממשית מהעונש שנגזר, אך גם אין מקום לקבל את עמדת המדינה ולהשאיר את התוצאה על כנה. כך דרכה של הביקורת הערעורית – לעתים אין בכוחם של נימוקים מסוימים להביא להקלה של ממש ביחס לעונש הכולל שנגזר על נאשם, אך יש בהם כדי להביא להקלה מתונה שלה משמעות בראייה מקיפה.
הננו מורים על הפחתת עונש המאסר בפועל של שתי המערערות ל-5 וחצי שנים. יתר חלקי גזר הדין ייוותרו בעינם.
