השופט א' א' לוי:
המערער נקרא לתת את הדין על כך שבשלושה מועדים סמוכים – שניים מהם בחודש דצמבר 2005 והשלישי בחודש ינואר 2006 – הוא מכר לסוכן משטרה סם מסוכן מסוג גראס, במשקל כולל של כ-5.2 ק"ג, תמורת סכום של 3750 ש"ח. כמו כן, נטען בכתב האישום כי המערער החזיק ביחד עם שניים אחרים ביער עילוט סם מאותו סוג במשקל כולל של 7700 גרם .
המערער הודה בעובדות האמורות, והורשע בביצוע עבירות של החזקת סם מסוכן שלא לצריכה עצמית, אספקת סם וסחר בו - עבירות לפי סעיפים 7(א)+(ג) ו-13 ביחד עם סעיף 19(א) לפקודת הסמים המסוכנים [נוסח חדש], התשל"ג-1973. כאן המקום להוסיף, כי הודאת המערער בעובדות שיוחסו לו היתה חלק מהסכם טיעון אותו גיבשו הצדדים, ומכוחו עתרה המשיבה לגזור למערער 4 שנות מאסר, מאסר על-תנאי, קנס, פסילה מלנהוג ברכב מנועי, פסילה על-תנאי, וכן לחלט את רכבו מסוג וולוו. המערער שמר לעצמו את הזכות לטעון בשני עניינים כהבנתו – אורכה של תקופת המאסר ושיעור הקנס.
לאחר שבפני בית המשפט המחוזי הונח תסקיר של שרות המבחן והצדדים טענו לעונש, נדון המערער ל-24 חודשי מאסר, 18 חודשים מאסר על-תנאי, קנס בסך 10,000 ש"ח, ופסילה מלהחזיק ברישיון נהיגה במשך 12 חודשים. בית המשפט הוסיף וחילט סכום של 11,000 ש"ח שנתפס ברשות המערער וכן חולט רכבו.
בערעור המכוון כנגד העונש נטען, כי בית המשפט המחוזי לא נתן משקל הולם לכל אחד מאלה: הודאת המערער, חרטתו ועברו הנקי מהרשעות קודמות; נסיבותיו האישיות – נשוי ואב לשני תינוקות; העבירות בוצעו תוך תקופה קצרה ועקב מצוקה כלכלית; הסם בו מדובר מוגדר כסם-קל. כן נטען, כי לא ניתן משקל ראוי לאמור בתסקירו של שרות המבחן, ולחשש כי כליאתו של המערער עלולה לסכל כליל את סיכויי שיקומו. לבסוף נטען, כי בית המשפט המחוזי החמיר מעבר לרמת הענישה הנוהגת בנסיבות דומות, ותוך חריגה בולטת מרמת הענישה שננקטת נגד שני המעורבים האחרים בפרשה.
לא מצאנו בכל אלה עילה להתערבותנו בעונש. המערער בחר מדעת ומרצון, ועקב הרווח הקל שצפה לגרוף לכיסו, לעסוק בהפצתו של נגע הסמים הפוגע קשות בחברה בישראל. אכן, העובדה שמדובר בסמים המוגדרים כ"קלים" ראוי היה להביאה בחשבון, אולם אין להפריז במשקלה, הואיל ורבים מהמשתמשים שדרכם החלה בסמים "קלים", מתגוללים לאחר זמן לא רב
ברחובות כתוצאה משימוש בסמים קשים. זאת ועוד, כמות הסם שנתפסה בחזקתם של המערער ושותפיו, מלמדת כי הוא מכיר את מקורות הסם ויודע כיצד להגיע אליהם, וככזה סכנתו לציבור גדולה שבעתיים. אמנם, נסיבותיו האישיות של המערער אינן פשוטות, אולם אין באלה כדי להוות עילה לסטייה החמורה של המערער מהנורמות התנהגות מקובלות. למערער, כמו לאחרים בשולחם ידם באותו עיסוק בזוי, נהיר כי אם יילכדו יכביד בית המשפט עליהם את ידו, ואם חרף זאת הם מוכנים ליטול עליהם את הסיכון, מה להם כי ילינו עתה שעה שהם נקראים לתת את הדין על רוע מעלליהם.
לאור חלקו המרכזי בפרשה, לא ראינו מקום לשנות מעונשו של המערער גם נוכח העונשים שהושתו על שותפיו, ומכאן החלטתנו לדחות את הערעור.
