המערער, קטין בן 17 ושלושה חודשים במועד הרלוונטי לביצוע העבירה, הורשע על פי הודאתו בעבירה לפי סעיף 333 + 335(א)(1)+(2) לחוק העונשין, התשל"ז-1977 (להלן: החוק ). בנוסף הורשע המערער בארבע עבירות של ניסיון לגניבת רכב לפי סעיף 413(א) + סעיף 25 לחוק, בעבירה של גניבת רכב לפי סעיף 413(א) לחוק וכן בנהיגת רכב מנועי ללא רישיון וללא ביטוח – עבירות לפי סעיפים 10(א) + 38(1) לפקודת התעבורה, וסעיף 2(א) לפקודת ביטוח רכב מנועי, תשל"א-1970. בגין כל אלה נגזרו על הקטין 12 חודשי מאסר בפועל.

מעובדות כתב האישום עולה, כי בין החודשים אוקטובר-נובמבר 2007 המערער והמתלונן נעצרו בחשד לביצוע עבירות של גניבת רכב וניסיון לגניבת רכב. על רקע מעצר זה התגלע סכסוך בין הנאשם לבין המתלונן. כשנה מאוחר יותר, בתאריך 22.10.08, הבחין המערער במתלונן והחל לרדוף אחריו כשהוא מחזיק בידו סכין, אך המתלונן נמלט ממנו. לאחר מספר דקות הגיע המערער עם אדם אחר, כששניהם רכובים על קטנוע. האחר תפס את המתלונן מאחור והמערער דקר את המתלונן חמש דקירות בחלקי גופו השונים, תוך שהוא מקלל אותו וקורא לו "מלשין". המתלונן, שנגרמו לו מספר חתכים בשכם, בגב תחתון, בבית השחי ובמותן, הובהל במצב בינוני לבית החולים, שם הוכנס צינור לבית החזה ולקרומי הריאה לצורך ניקוז אויר, והוא אושפז למשך שלושה ימים.

כתב האישום המקורי ייחס למערער עבירה של חבלה בכוונה מחמירה לפי סעיף 329(א)(1) לחוק העונשין, אך בעקבות הסדר דיוני תוקן כתב האישום והוא הורשע בעבירה דלעיל. המערער הודה בעבירה המיוחסת לו וצירף תיק נוסף בו יוחסו לו מספר עבירות הקשורות לגניבות רכב ונהיגה ברכב ללא ביטוח. שירות המבחן לנוער נמנע מהמלצה טיפולית בעניינו של המערער, ו בית משפט קמא השית עליו עונש מאסר של 12 חודשים בפועל.
על גזר הדין נסב הערעור שבפנינו.

המערער טען כי הוא עובר כיום הליך שיקומי, כי שהה במעצר כחודש ולאחר מכן שהה במעצר בית מוחלט משך שמונה חודשים, וכי תיקן את דרכיו ומאז מעצרו בתיק זה לא נפתחו נגדו תיקי חקירה מכל סוג שהוא. בעת ביצוע העבירה המערער היה קטין, ואת העבירות שקשורות לגניבות הרכב ביצע כאשר היה כבן 16. במהלך הדיון בפנינו, הדגיש ב"כ המערער כי כאשר בקטינים עסקינן, בית המשפט יעדיף את הגישה השיקומית, כפי שעולה מע"פ 49/09 מדינת ישראל נ' פלוני (לא פורסם, 8.3.09).

אקדים ואזכיר כי אין דרכה של ערכאת ערעור להתערב בענישה אלא במקרים חריגים בלבד, כאשר נפלה בגזר הדין טעות מהותית או שהעונש שנגזר על ידה חורג באופן קיצוני מרמת הענישה המקובלת בנסיבות דומות (ראו, לדוגמה, ע"פ 4629/09 פלוני נ' מדינת ישראל (לא פורסם, 18.11.09) פסקה 33 והאסמכתאות שם). במקרה דנן, העונש שהושת על המערער מופלג לקולא, גם בהתחשב בקטינותו בעת המעשה. בין המערער לבין עונש של מאסר ממושך, שמא דו-ספרתי, הפרידו מספר סנטימטרים, שהרי אם אחת מתוך חמש הדקירות שדקר את המתלונן הייתה פוגעת בלב או באיבר חיוני אחר, יכול היה המערער למצוא עצמו מורשע בעבירת רצח או הריגה.

מתסקיר קצין המבחן לנוער עולה כי המערער עשוי להפיק תועלת מטיפול ויש לו נתונים התומכים בסיכוייו לשיקום. עם זאת, אין להתעלם מכך שבשורה התחתונה נמנע קצין המבחן ליתן המלצה בעניינו. דקירת המתלונן, מעשה חמור כשלעצמו, נעשתה על ידי המערער מתוך תכנון, לאחר שהצטייד בסכין וחזר לזירה במיוחד כדי לדקור את המתלונן. המעשה בוצע כאשר המערער היה מעל גיל 17, וכפי שציין בית משפט קמא, אין דינו של קטין בגיל זה דומה לדינו של נער בן 14 או 15. לכך יש להוסיף את העבירות הרבות הקשורות בגניבת רכב, מה שמעיד על כך שהמערער סטה זה מכבר מהמסלול הנורמטיבי. המערער אופיין בבעיות התנהגותיות משך שנים רבות, החל מבית הספר היסודי, וכפי שנמצאתי למד מתסקיר שירות המבחן, יש לו גם רישום קודם ללא הרשעה, בגין עבירה של תקיפה.

בהתחשב בכל אלה, חסד עשה בית משפט קמא בכך שהטיל על המערער עונש מאסר של שנה אחת בלבד. פעמים רבות נאמר בפסיקה כי הקטינות אינה מהווה חסינות והקטינות אינה חזות הכל. איני סבור כי ההלכה שנקבעה בע"פ 49/09 הנ"ל, באה להפוך סדרי עולם בענישת קטינים. אכן, אין חולק כי בענישת קטינים ניתן משקל נכבד ומיוחד לרכיב הטיפולי והשיקומי, אך יש נקודה ברצף הפעילות העבריינית של קטין, שבתי המשפט אמורים להניף כנגדו "כרטיס אדום" בדמות מאסר בפועל. זאת, לא רק בשל מטרות הענישה המקובלות, כהרתעה וגמול, אלא גם כחלק מהליך כולל שנועד להחזיר את הנער למסלול, בבחינת התחנה הלפני אחרונה טרם התדרדרות. כך נעשה מעשה של יום ביומו בבתי משפט לנוער על ידי שופטי נוער האמונים על המלאכה, ששיקולי הטיפול והשיקום עומדים תמיד נגד עיניהם.
אשר על כן, נוכח מכלול הנסיבות כפי שפורטו לעיל, אמליץ לחברי לדחות את הערעור. לבקשת המערער, תחילת ריצוי העונש נדחית עד ליום 1.6.10 שעה 09:00, אז יתייצב המערער במזכירות בית המשפט המחוזי תל אביב-יפו.
