בקשה לפטור מעירבון
החלטה
לפניי בקשה לפטור מהפקדת עירבון או להפחתת סכום העירבון שנקבע (15,000 ₪). בקשת הפטור הוגשה במסגרת בקשת רשות ערעור על פסק דין של בית המשפט המחוזי שבו נדחה ערעור המבקשים על פסק-דין של בית משפט השלום. בית משפט השלום דחה את ערעורם של המבקשים על החלטת המשיבה – ועדת הזכאות (מינהלת סל"ע) – שלא לראות בשטח מסוים בכניסה לביתם ביישוב נווה דקלים משום "שטח עיקרי" לצורך חישוב הפיצוי לפי חוק יישום תכנית ההתנתקות, התשס"ה-2005.
בבקשת הפטור טוענים המבקשים כי מאז פינוי גוש קטיף במסגרת תכנית ההתנקות הם אינם עובדים ומתקשים לשוב לשוק העבודה. כספי הפיצויים ששולמו להם, כך הם טוענים, משמשים לצורך הקיום היום-יומי ולצורך בניית ביתם החדש. המבקשים סבורים כי סיכוייהם להצליח בהליך העיקרי – גבוהים. מן התצהיר המשלים שהגישו המבקשים, לפי החלטתי מיום 9.3.2010, עולה כי המבקש מקבל גמלה חודשית בהיותו גמלאי של משטרת ישראל, וכי המבקשת מקבלת גם כן גמלה חודשית בהיותה גמלאית של המועצה האזורית חוף עזה. עוד פורטו הכנסות מעבודתה של המבקשת במשרה חלקית ומקצבת ביטוח לאומי. אל-מול אלה פורטו הוצאות המשפחה וכן הפעולות שבוצעו על-ידה לצורך גיוס כספים לבניית הבית (לרבות נטילת הלוואות). צוין בבקשה כי אין למבקשים נכסים פיננסיים וכי רכבם הוא בבחינת צורך חיוני, בין היתר בשל שהמבקש הוא בעל מוגבלות.
ראוי לציין כי גם לתצהיר המשלים לא צורפו מלוא האסמכתאות – למשל חשבונות שוטפים – אולם צורפו דפי חשבון בנק. המדינה טוענת בצדק כי מדפי החשבון עולה שאין מקום לפטור את המבקשים מהפקדת עירבון. דפי החשבון מצביעים על הפקדות ומשיכות בסכומים לא מבוטלים ועל יתרות זכות; גם פירוט הכנסותיהם של המבקשים מוביל למסקנה כי מצבם הכלכלי אינו מצדיק את ניהול ההליך ללא הפקדת עירבון. זאת ועוד, המבקשים אינם מציינים ניסיונות לגייס את סכום העירבון מסביבתם הקרובה, כנדרש. עוד יצוין כי בבית המשפט המחוזי הושתו על המבקשים הוצאות בסכום של 5,000 ₪, וכי ההליך בערכאה זו הוא "גלגול שלישי" לאחר שעמדת המבקשים נדחתה בשתי ערכאות קודמות.
בהתחשב בטענות המבקשים לגבי מצבם הכלכלי, במהות ההליך והיקפו, בהוצאות שנפסקו בערכאה הקודמת ובהסכמת המשיב להפחתה מסוימת מסכום העירבון, יופקד בהליך זה ערבון בסך 7,500 ₪. העירבון יופקד תוך 21 ימים שאם לא כן – יירשם ההליך לדחייה ללא התראה נוספת.
