החלטה

לאור עמדת המשיב, ובשים לב להתארכות ההליכים בין בעלי הדין, הריני מורה כי הערבון יופקד עד ליום 1.10.08. אכן לא שוכנעתי כי קיים במקרה זה יסוד לפטור מחובת הפקדת הערבון החלה על המערער עם פתיחת ההליך (ראו עוד והשוו בר"ם 1454/06 רטושניק נ' רשם האגודות השיתופיות (לא פורסם, 5.3.06)). כך הדבר, בייחוד בשים לב להליכי הביניים המתקיימים בתיק זה ולחשיפת המשיב להוצאות בשל כך.

אשר לסיווג ההליך, הרי שמקובלת עלי עמדת המשיב לפיה מדובר בהשגה על "פסק דין בערעור" שדינה כדין בקשת רשות ערעור (ולא ערעור אזרחי, כפי שהוגש). אמת, המדובר בפסק דין בו נדחה ערעור על החלטת רשם בית המשפט המחוזי, אולם אין זה מסוג המקרים בהם פסק הדין בערעור מוביל לתוצאה לפיה הערעור לבית המשפט זה מתבקש כערעור בזכות (ראו עוד, רע"א 1102/04 וולך נ' עמירן סיטי אל מימון והשקעות בע"מ (לא פורסם, 3.7.05); בש"א 7338/08 י' וינברג דורון נ' כהנא , פ"ד נו(2) 913)).

התוצאה היא כי יש למחוק ההליך שבכותרת ולפתחו כבקשת רשות ערעור. הפרש האגרה יושב למערער. הערבון
יועמד על סך של 15,000 ₪ ויופקד כאמור עד ליום 1.10.08. אין צו להוצאות בהליך זה. החלטה זו תתויק בתיק השופט שישב בדין.
