בקשה לקביעת ערבות אישית/להפחתת הערבון
החלטה
לפניי "בקשה לקביעת ערבות אישית" ולחלופין להפחתת סכום העירבון שנקבע בתיק זה על-ידי המזכירה הראשית (בסך 25,000 ₪). הבקשה הוגשה במסגרת בקשת רשות ערעור על פסק-דין של בית המשפט המחוזי מרכז, שדחה את ערעורו של המבקש על פסק-דין של בית משפט השלום בנתניה, אשר דחה את תביעתו הכספית כנגד המשיבים.
החובה להפקיד עירבון בהליך של ערעור או בקשת רשות ערעור קבועה בתקנות סדר הדין האזרחי, התשמ"ד-1984, ומטרתה העיקרית להגן על זכותו של בעל הדין שכנגד לגבות הוצאות שתפסקנה לזכותו, אם תפסקנה. מתן פטור (מלא או חלקי) מהפקדת עירבון חושף את בעל-הדין שכנגד לסיכון כי יתקשה לגבות את הוצאותיו. לפיכך, מתן הפטור מותנה בהוכחת שני תנאים מצטברים: הראשון, חוסר יכולת כלכלית, והשני, קיום סיכויים טובים להצלחת הערעור (ראו למשל בש"א 1528/06 ורנר נ' כונס הנכסים הרשמי (טרם פורסם, 17.10.2007)).
הנה כי כן, תנאי היסוד למתן פטור (מלא או חלקי) מהפקדת עירבון הוא הוכחת חוסר יכולת כלכלית. הכלל בעניין זה ידוע ומושרש: "המבקש פטור מהפקדת עירבון צריך לפרוש בפני בית המשפט תשתית עובדתית מלאה ביותר ועדכנית בדבר מצבו הכלכלי ויכולתו לגייס את סכום העירבון" (דברי כבוד השופט ס' ג'ובראן ב בש"א 4807/11
מזרחי נ' פקיד שומה פתח-תקוה (טרם פורסם, 29.6.2011)). לאמור: בעל-דין החפץ בפטור מהפקדת עירבון נדרש להציג פירוט מלא לעניין מצבו הכלכלי, לצרף אסמכתאות מלאות ועדכניות, ולהתייחס לכלל הנתונים הרלוונטיים לרבות האפשרות להסתייע בסביבה הקרובה (אף זאת בצירוף מסמכים מתאימים – ראו בש"א 6411/11 שני נ' עו"ד חבר, נאמן לנכסי החייב (טרם פורסם, 3.10.2011); בש"א 9998/09

עיון בבקשה שלפניי מגלה כי אין בה תשתית עובדתית מלאה לעניין המצב הכלכלי. הטענות בה כלליות, ויותר מכך: פרט לשני אישורים הנוגעים לקבלת קצבאות נכות מהמוסד לביטוח לאומי, אין הבקשה נתמכת באסמכתאות (כגון דפי חשבון, חשבונות שוטפים וכד'). אף אין בבקשה התייחסות לאפשרות להסתייע בסביבה הקרובה, או לאופן מימון הייצוג המשפטי. ראוי לציין גם כי בבית המשפט המחוזי הופקד עירבון, ואין לכך כל התייחסות בבקשה שלפניי. הוסיפו לכך את העובדה שמדובר בהליך ב"גלגול שלישי", שסיכוייו על פני הדברים אינם נחזים להיות גבוהים במיוחד, והמסקנה המתבקשת היא כי נדרש עירבון הולם בהליך זה.
כאן המקום להבהיר כי התחייבות עצמית ("ערבות אישית") כלל אינה נחשבת חלופת עירבון (ראו בש"א 5385/09 עיריית חיפה נ' עמותת העדה היהודית הספרדית בחיפה (טרם פורסם, 16.7.2009)), מה עוד שאם המבקש מסוגל להצהיר כי ישלם הוצאות שתפסקנה לחובתו, יש להניח כי הוא מסוגל גם להפקיד עירבון לצורך הבטחת תשלום ההוצאות.
סוף דבר: אין מקום למתן פטור מלא או חלקי מהפקדת עירבון בהליך זה. עם זאת, בנסיבות העניין ובשים לב לסכום ההוצאות בבית המשפט המחוזי מצאתי לנכון להפחית קמעא את סכום העירבון ולהעמידו על סך של 17,000 ₪. סכום זה יופקד תוך 14 ימים מעת המצאת החלטה זו (ימי הפגרה במניין), שאם לא כן יירשם ההליך לדחייה ללא הודעה נוספת.
