בקשת רשות ערעור על החלטת בית המשפט המחוזי בבאר-שבע מיום 6.7.2014 (כב' הנשיא י' אלון ) בתיק רע"א 59728-03-14, בגדרה ניתנה למשיבה רשות ערעור על החלטת בית משפט השלום באשדוד (כב' השופט א' ברגנר ) למנות מומחה מטעמו בתחום הנוירולוגיה והתקבל הערעור על החלטה זו.
רקע והליכים קודמים

המבקש הגיש נגד המשיבה תביעה לפי חוק הפיצויים לנפגעי תאונות דרכים, התשל"ה-1975 בגין נזקי גוף, שלטענתו נגרמו לו בתאונת דרכים מיום 11.4.2008. במסגרת תביעתו עתר המבקש למינוי מומחים רפואיים בתחומים הבאים: אף-אוזן-גרון (להלן: א.א.ג ), אורתופדיה ונוירולוגיה. בית משפט השלום נעתר בהחלטתו מיום 21.5.2012 למינוי מומחים בתחומי האורתופדיה והא.א.ג בלבד, אך ציין בהחלטתו כי מומחים אלה "יחוו דעתם בדבר הצורך במינוי מומחה בתחום הנוירולוגי". שני המומחים ציינו בחוות דעתם כי אינם סבורים שיש צורך במינוי מומחה בתחום הנוירולוגיה.

ביום 6.2.2014 הגיש המבקש בקשה נוספת למינוי מומחה בתחום הנוירולוגיה. בהחלטתו מיום 5.3.2014 קבע בית משפט השלום "כי בכדי לא לחסום בפני התובע הדרך להוכחת תביעתו, אני מורה על מינוי מומחה בתחום הנוירולוגי". כלפי החלטה זו הגישה המשיבה בקשת רשות ערעור לבית המשפט המחוזי בבאר-שבע, אשר קיבל את הבקשה ואת הערעור, באופן שהורה על ביטול מינוי המומחה בתחום הנוירולוגיה. בהחלטתו ציין בית משפט קמא, כי בית משפט השלום הורה על מינוי המומחה בלי שפירש "איזו 'ראשית ראיה', ולו בדוחק, מצא בבקשה החוזרת למינוי המומחה הנוירולוגי". בית משפט קמא ציין, כי הנימוק שעמד בבסיס החלטת בית משפט השלום ("בכדי לא לחסום בפני התובע הדרך להוכחת תביעתו") אין בו כדי להצדיק את מינוי המומחה הנוסף, בפרט נוכח חוות דעתם של המומחים האחרים. נוכח האמור, ובהתחשב בכך שבית משפט קמא לא מצא כי קיימת ראשית ראיה למינוי מומחה בתחום הנוירולוגיה, הורה בית המשפט על ביטול מינוי המומחה בתחום זה.
כלפי החלטה זו הוגשה הבקשה שלפניי.
הבקשה

בבקשה נטען, כי היא מעוררת "שאלה משפטית, חדשה, אשר טרם נדונה בפני בית משפט נכבד זה" שעניינה במשקל המלצתו של מומחה רפואי על מינוי של מומחה רפואי בתחום אחר, שאינו קרוב לתחום מומחיותו שלו, וזאת כאשר בתיק קיימת ראשית ראיה למינוי מומחה בתחום המבוקש. לטענת המבקש, לאחר התאונה התלונן, בין היתר, על כ אבי ראש, סחרחורות ועייפות והדבר קיבל ביטוי בתיעוד הרפואי בעניינו ולכן אין לקבוע כי בתיק לא קיימת ראשית ראיה למינוי מומחה בתחום הנוירולוגי. עוד טוען המבקש, כי מאחר שהמומחים האחרים שמונו אינם קרובים בתחום מומחיותם לתחום שבו התבקש מינוי מומחה, הרי שאין ליתן להמלצתם משקל מכריע.
דיון והכרעה

לאחר העיון בבקשה באתי לכלל מסקנה כי דינה להידחות אף בלי שתתבקש תשובה. המבקש בענייננו מבקש כי תינתן לו רשות ערעור ב"גלגול שלישי" וזאת על החלטת ביניים ("החלטה אחרת"). כידוע, מתן רשות ערעור בנסיבות אלה שמור למקרים המעוררים שאלה בעלת השלכות כלליות או עקרוניות, והמקרה דנא אינו נמנה עליהם. הבקשה ממוקדת בעניינו הפרטני של המבקש ובעיקר בשאלה האם עלה בידיו להראות כי קיימת בעניינו ראשית ראיה אשר יהיה בה להצדיק מינויו של מומחה בתחום הנוירולוגי. מן המתואר לעיל עולה, כי בית משפט השלום אמנם מצא כי יש מקום למנות מומחה בתחום זה, אך לא הצביע על ראשית הראיה שבגינה הגיע להחלטה זו. מנגד, בית משפט קמא, לאחר שעיין בתיק, קבע כי לא עלה בידי המבקש להצביע על ראשית ראיה שתצדיק את מינוי המומחה ומצא חיזוק למסקנתו זו בחוות דעתם של המומחים בתחומים האחרים. ודוק: בית משפט קמא לא ביסס את החלטתו על חוות דעתם של המומחים האחרים, אלא על מסקנתו כי לא נמצאה ראשית ראיה למינוי המומחה. ברי, כי קביעות אלה תחומות לדלת אמותיו של המקרה הספציפי והן אינן מעוררות שאלות עקרוניות.
בנסיבות אלה, ומשמדובר בהחלטה שאינה יוצרת מצב בלתי הפיך עבור המבקש, ויהיה באפשרותו לערער על הקביעה בעניין זה במסגרת ערעור על פסק הדין בעניינו, ככל שערעור כאמור יוגש, הרי שאין מקום להיעתר לבקשתו.
סוף דבר, הבקשה נדחית. משלא התבקשה תשובה, לא ייעשה צו להוצאות.
