המבקש מחזיק במניה אחת בחברת היכלי נוי בע"מ, המקנה לו זכות בעלות בדירת מגורים בת חדר ברחוב ארבע ארצות 4 בתל אביב (להלן: הדירה ). סבתו המנוחה של המשיב (להלן: המנוחה ) הייתה דיירת מוגנת בדירה מכוח הסכם שכירות שנחתם ביום 1.7.1975. ביום 9.6.2008 נפטרה המנוחה והמשיב המשיך להתגורר בדירתה. המבקש הגיש תביעה לסילוק ידו של המשיב ולתשלום דמי שימוש ראויים בטענה שעם פטירת המנוחה הפך המשיב, שהוסיף להתגורר בדירה, לפולש ולמחזיק בה שלא כדין. להגנתו טען המשיב כי הוא בא בגדר "קרוב אחר" של דיירת מוגנת כמשמעותו בסעיף 20(ב) לחוק הגנת הדייר, התשל"ב-1972 (להלן: חוק הגנת הדייר או החוק ) בהיותו עומד בשני התנאים המנויים בסעיף זה המזכים אותו לבוא בנעלי המנוחה כדייר מוגן: האחד , מגורים משותפים של ששה חודשים לפחות עובר לפטירתו של הדייר המוגן; והשני , העדר דירה אחרת למגורים במועד הפטירה. המשיב טען כי לפני שעבר להתגורר עם המנוחה בשנת 2003, הוא התגורר עם הוריו בדירה ברחוב אמסטרדם (להלן: דירת אמסטרדם ), שאותה שכרו האחרונים בשכירות חופשית. הורי המשיב עזבו דירה זו בסוף שנת 2003 ועברו להתגורר בדירה ברחוב יהודה גור (להלן: דירת
יהודה גור ), שבה התגוררו גם בזמן פטירת המנוחה.

בית משפט השלום (כב' השופטת ע' ברקוביץ ) קיבל את תביעת המבקש וקבע כי על אף שעלה בידי המשיב להוכיח את התנאי הראשון, הוא לא הוכיח את התנאי השני. זאת מהטעם שיש באפשרות המשיב לגור בדירת הוריו כבר רשות, ומכאן שהייתה לו דירה אחרת למגורים בזמן פטירת המנוחה. על כן קבע בית משפט השלום כי אין להכיר במשיב כדייר מוגן חלף המנוחה; וכי עליו לסלק ידו מן הנכס ולשלם למבקש דמי שימוש ראויים.

המשיב ערער על פסק הדין, ובית המשפט המחוזי (כב' השופטים י' ענבר , י' שבח ו ש' שוחט ) קיבל את הערעור. נקבע כי אין להתערב בקביעתו של בית משפט השלום באשר להתקיימות התנאי הראשון המנוי בסעיף 20(ב), היינו שהמשיב התגורר עם המנוחה לפחות ששה חודשים סמוך לפטירתה, שכן מדובר בממצא עובדתי מובהק. לעומת זאת ביטל בית המשפט המחוזי את קביעת בית משפט השלום בנוגע לתנאי השני. הוטעם כי יש לבחון את קיומו של תנאי זה בהתאם למבחן " הזכות החוקית " למגורים בדירה אחרת כפי שנוסח בע"א 712/76 צ'רני נ' מורד , פ"ד לא(2) 99 (1977) (להלן: עניין צ'רני ) ולפיו אין די בקיומה של אפשרות תיאורטית למגורים בדירת ההורים. נקבע כי בנסיבות דנן לא הייתה למשיב דירה אחרת למגורים בזמן פטירת המנוחה, שכן
אף אם נשמרה זיקה בין המשיב לבין דירת הוריו באופן המאפשר לו לשהות בה לעתים, אין בכך כדי להצביע על "זכות חוקית" להתגורר בה באורח קבע.

מכאן הבקשה שלפניי. המבקש טוען כי בית המשפט המחוזי שגה בכך שקבע כי למשיב לא הייתה דירה אחרת למגורים בזמן פטירת המנוחה, שכן האחרון יכול היה להתגורר בדירת הוריו. לשיטתו, הפרשנות שנתן בית המשפט המחוזי למבחן הזכות החוקית שגויה בהיותה מצמצמת מדי; ועל הפרשנות הראויה לכלול גם זכות בדירה שכורה של הורי המשיב. המבקש מוסיף וטוען כי אין להכיר במשיב כדייר מוגן מהטעם שמדובר בנכד של דיירת מוגנת שנולד שנים לאחר שהמנוחה רכשה את הזכות
ואינו בקרבה ראשונה; כי בבעלות משפחת המשיב נכסים רבים היכולים לשמש למגוריו; כי לנוכח חוק יסוד: כבוד האדם וחירותו המגן על זכות הקניין יש לפרש את חוק הגנת הדייר בצמצום ולבחון מחדש את מבחן הזכות החוקית; וכי מכל מקום מבחן זה הוא עמום ועל כן נדרשת הבהרתו.

לאחר שעיינתי בבקשת רשות הערעור על צרופותיה, באתי לכלל מסקנה שדינה להידחות. כידוע, רשות ערעור לבית משפט זה תינתן כשמתעוררת שאלה משפטית בעלת חשיבות ציבורית החורגת מעניינם של הצדדים הישירים למחלוקת (ר"ע 103/82
חניון חיפה בע"מ נ' מצת אור (הדר חיפה) בע"מ , פ"ד לו(3) 123 (1982); רע"א 4193/11 כראדי נ' נרקיס , פסקה 7 (14.6.2011)). חרף ניסיון המבקש להציג את המחלוקת בענייננו ככזו, הבקשה דנן תחומה כולה בנסיבות המקרה הקונקרטיות. כאמור, סעיף 20(ב) לחוק הגנת הדייר קובע כי "קרוביו האחרים" של דייר מוגן שנפטר יהיו לדיירים מוגנים בעצמם בהתקיים שני תנאים: (1) הם התגוררו עמו במשך ששה חודשים בסמוך לפני הפטירה; ו-(2) שלא הייתה להם בזמן פטירתו דירה אחרת למגורים. הבקשה שלפנינו מכוונת לקביעת בית המשפט המחוזי לגבי התנאי השני בלבד, ולגביה נקבע כי למשיב לא הייתה בזמן פטירת המנוחה זכות חוקית למגורים בדירה אחרת. בית המשפט השעין את מסקנתו על ממצא עובדתי שלפיו הוריו של המשיב עזבו את דירת אמסטרדם (שבה התגורר עמם לפני שעבר לבית סבתו), ועברו להתגורר בדירת יהודה גור . בדירה זו המשיב מעולם לא התגורר; לא היה לו בה חדר; ולא הושארו בה רהיטים או חפצים שלו. על כן קבע בית המשפט המחוזי כי לא קמה למשיב זכות חוקית בדירה זו (ראו והשוו: רע"א 4015/08 כהן נ' מזרחי , פסקאות 11-9 (2.9.2008)). קביעה זו תחומה בנסיבותיו הקונקרטיות של המקרה, ואינה מגלה עילה למתן רשות ערעור לפי אמת המידה האמורה.
הבקשה נדחית אפוא. משלא נתבקשה תשובה, אין צו להוצאות.
