החלטה
המבקשת 1 רכשה רכב משומש, שבוטח על-ידי המבקשת 2. כעבור שבוע נמסר הרכב למשיבה 1 – להלן: המוסך – לצורך תיקון הלקויים שאותרו על-ידי מכון הבדיקה. עוד באותו היום, בגמר הטיפול, הוחזר הרכב למנהלה של המבקשת 1. כעבור יומיים, דקות ספורות לאחר שהוחנה הרכב ומנועו כובה, פרצה אש מאזור תא המנוע. האש התפשטה לרכב סמוך, שהיה בבעלות המשיבה 3 ובוטח על-ידי המשיבה 2. אלה האחרונות הגישו תביעה כנגד המבקשות 1 ו- 2 וכנגד המוסך. בית משפט השלום קיבל את התביעה וחייב את המוסך באחריות. בית המשפט המחוזי הפך את הקערה על-פיה ופטר את המוסך. מכאן בקשת רשות הערעור שבפני.
יאמר מיד: סיבת ההתלקחות לא נתבררה. על אף שהוגשו חוות-דעת מטעם מומחים, והועלו השערות והערכות שונות, נותרה הסיבה לפרוץ הדליקה עלומה. משלא הוכיחו הנתבעות היעדר התרשלות מצדן, כנדרש מהן בנסיבות העניין לפי סעיף 39 לפקודת הנזיקין [נוסח חדש], נתקבלה תביעתן של המשיבות 2 ו- 3. אשר ליחס בין הנתבעות – המבקשות 1 ו- 2 מזה והמוסך מזה – עמדתו של בית משפט השלום, לפיה יש להטיל אחריות על המוסך, התבססה על כך שמיום רכישתו של הרכב ועד כניסתו למוסך – שבוע ימים – הוא נסע מרחק של 1,655 ק"מ – ללא כל תקלה; ואילו לאחר הטיפול במוסך, נסע הרכב 100 ק"מ , במשך כיומיים, ואז, עלה באש. "סמיכות זמנים זו והמרחק הקצר יחסית שהספיק הרכב לנוע עד לשריפתו מצביעים, ולו נסיבתית, על קשר כלשהו בין טיפולו של נתבע מס' 3 ל'בעיה' שגרמה לשריפה ומטים את הכף לחובת נתבע מס' 3 הגם שלא ניתן להצביע על הבעיה או מהותה כל שכן לפרטה". מנגד, הטעים בית משפט השלום, מנהל המבקשת 1 פעל באופן סביר ושגרתי, בהכניסו את הרכב למוסך תוך שהוא מצרף את דו"ח הליקויים.
בית המשפט המחוזי, לעומת זאת, סבר כי המבקשות 1 ו- 2 צריכות היו להראות, פוזיטיבית, שהמוסך הוא האחראי להבערת האש, וזאת לא עשו. לפיכך, הוסיף בית המשפט ופסק, אף לא הועבר אל שכם המוסך הנטל להראות היעדר התרשלות מצדו. לעניין סעיף 41 לפקודה – כלל "הדבר מעיד על עצמו" – הבהיר בית המשפט כי לא התקיים תנאי השליטה. "הרכב" – כך כתב בית המשפט לעניין זה – "שהה במוסך פעם אחת בלבד כיומיים לפני התרחשות הנזק ולמשך מספר שעות בלבד. הטיפו לשערכה המערערת ברכב אינו כה מהותי ומקיף המקנה לה שליטה ברכב". התוצאה היא שהמבקשות 1 ו- 2 נמצאו כמי שעליהן לשאת, לבדן, בפיצוי המשיבות 2 ו- 3.
כנגד פסק-דינו של בית המשפט המחוזי מופנית בקשת רשות הערעור שבפני. עיינתי בטענות הצדדים ולא ראיתי עילה להתערב ב"גלגול שלישי", בהכרעתו של בית המשפט המחוזי. ניסיונן של המבקשות להצביע על שאלה משפטית בעלת חשיבות כללית המתעוררת במקרה זה לא צלח, והדברים אמורים גם באשר לטענה כאילו בית המשפט המחוזי כלל בפסק-דינו נימוק חדש שלא הושמע קודם לכן.
אסתפק אפוא בהתייחסות קצרה לנושא החלת כלל "הדבר מעיד על עצמו" במקרה שלפנינו. לגבי תנאי השליטה, קבעה הפסיקה כי "לתנאי זה מטרה כפולה; הראשונה - זיהוי האחראי לתאונה... או אם תרצו, יש בתנאי זה כדי ליחד את המסקנה ההסתברותית הכללית למקרה המיוחד של התובע - ובכך להתיר לו את ההסתמכות על אותה הסתברות, ובלשונם של המלומדים פורת ושטיין - לעשות 'אינדיווידואליזציה' של הכלל... והשניה - עדות על כך שהסיבה להתרחשותה של התאונה נתונה בידיעתו המיוחדת של הנתבע, או כי מכל מקום היה לו יתרון בכל הקשור לברור סיבת התאונה והוכחתה במשפט" (ע"א 8151/98 שטרנברג נ' ד"ר צ'צ'יק , פ"ד נו(1) 539 (2001)). אין לראות בפסיקה שהגמישה או הרחיבה את תחום פרישתה של השליטה, כמאיינת את עצם הצורך בשליטה המקיימת את התכליות האמורות (לפסיקה מרחיבה ראו ע"א 241/89 ישראליפט (שרותים) תשל"ג בע"מ נ' הינדלי , פ"ד מט(1) 45; ע"א 206/89 רז נ' בית חולים אלישע בע"מ , פ"ד מז(3) 805). אכן, כדברי המבקשות, משך הזמן שבו נמשכה השליטה אינו בהכרח נתון מכריע, אך ספק אם בית המשפט המחוזי התכוון לומר אחרת, ונראה כי הנקודה העיקרית היא שבנסיבות העניין לא הוכחה שליטה אפקטיבית של המוסך, נקודתית או נורמטיבית, במועד הרלבנטי, בנכס שגרם לנזק. אכן, עצם העובדה שרכב שוהה במוסך אינה מקנה בהכרח, למוסך שליטה בכל מרכיביו של הרכב ובכל היבטי תקינותו. השאלה תלויה בנסיבות העניין, ובכלל זה, יש לבחון לשם מה נכנס הרכב למוסך, מהן הפעולות שבוצעו בו ומהי הזיקה בין הפעולות הללו לבין אירוע הנזק.
יצוין כי גם לגבי התנאי השלישי לתחולת כלל "הדבר מעיד על עצמו" מתעורר במקרה זה קושי. תנאי זה עניינו קיומה של הנחת התרשלות, המבוססת על ראיות סטטיסטיות גרידא – ראיות שכל פועלן בכך שהן מסווגות את המקרה לקטגוריה כללית של רשלנות. אכן, כפי שהסבירו Porat ו- Stein בספרם Tort
Liability Under Uncertainty (2001) 84-100 , כלל "הדבר מעיד על עצמו" מאפשר סטייה מן הכלל הרגיל של הוכחה אינדיבידואלית, ומתיר הוכחת "התרשלות סטטיסטית". זאת עושה הכלל, בכך שהוא מתיר שימוש בראיות, המלמדות כי במרבית המקרים, תאונה מן הסוג שאירע לא היתה מתרחשת בלא התרשלות כלשהי (עוד על הכלל כפתח להוכחה סטטיסטית בדיני נזיקין, ראו ע"א 4152/03 חסונה נ' בית החולים ביקור חולים (טרם פורסם); ע"א 9313/03 חביבאללה נ' בית חולים נצרת

חשוב להבהיר: התרשלות סטטיסטית אין משמעותה ניחוש, תחושת בטן או השערות בלתי-מבוססות. באופן מסורתי התבסס כלל "הדבר מעיד על עצמו" על ניסיון החיים הכללי, ועם השנים השתרשה הגישה כי ניתן להסתמך גם על חוות-דעת מומחים. מכל מקום, על בית המשפט להשתכנע, על בסיס הראיות הרלבנטיות לעניין זה (ועל כך ראו עניין אלעבד הנ"ל), כי אמנם קיימת עדיפות הסתברותית-סטטיסטית לאפשרות של התרשלות מצד הנתבע. בענייננו, לאור מהות העניין, נדרש בית המשפט לחוות-דעת מומחים, אך דא עקא, נקבע כי "כל אחד מהמומחים הצליח רק להפריך את סברתו של המומחה הנגדי ובכך הסתיימה תרומתו להבהרת התעלומה שכן איש מהמומחים לא הצליח לאתר במידה מספקת של סבירות את הגורם הממשי להתלקחות האש". אכן, הערכאה המבררת התקשתה לחלץ מחוות-דעת המומחים מידע באשר לגורמים האפשריים לתאונה, ובנוסף יש לציין, כי לא הוכח קשר בין הליקויים שנכללו בדו"ח של מכון הבדיקה לבין הדליקה. על כן, ספק אם במקרה זה קיימת תשתית ראייתית לקביעת התרשלות סטטיסטית (השוו רע"א 1607/04 אס.או.אס שירותי רכב בע"מ נ' אנקווה , תק-על 2004(2) 1451, שם הוכנס רכב למוסך בשל בעיה בבלמים, ולמחרת היום נפגע בתאונה בשל אובדן הבלמים).
התוצאה היא שהבקשה נדחית. עם זאת, בנסיבות העניין, החלטנו שלא לעשות צו להוצאות.
