רשמת ההוצאה לפועל בנתניה קיבלה טענת "פרעתי" שהגישה המבקשת וסגרה את תיק ההוצאה לפועל שנפתח נגדה לבקשת המשיבה, לאחר שנקבע כי קיים השתק פלוגתה בין הצדדים, על רקע החלטה קודמת שבה נקבע כי החוב המדובר מקוזז עם חוב אחר שבעניינו קיים תיק נוסף בהוצאה לפועל. ביום 25.9.2011, הגישה המשיבה ערעור על החלטת הרשמת לבית משפט השלום בנתניה, שבו נטען כי הפלוגתה האמורה נידונה אך לא הוכרעה בהחלטה הקודמת במסגרת התיק הנוסף. לגופם של דברים, נטען כי הקיזוז האמור כבר בוצע במסגרת התיק הנוסף, ואין מקום לקזז בשנית בין החובות.

בית משפט השלום בנתניה (כב' השופטת ג' ציגלר ) קבע כי כתב הערעור שהוגש אינו עומד בתקנות ההוצאה לפועל, התש"ם-1979, משום שלא צורף לו תצהיר. בהחלטה מיום 25.10.2011, קבע בית משפט השלום כי "אם מבוקש לצרף תצהיר חדש, יש לנמק הבקשה, ולצרף תצהיר מתאים". המשיבה הגישה בקשה לצירוף תצהיר לכתב הערעור, אך בית המשפט דחה את הבקשה בקבעו כי "הערעור הוגש ללא תצהיר, ובקשה זו הוגשה באיחור ולא בדרך הקבועה בתקנות. בנסיבות אלו אין בפני הליך שניתן לדון בו".

בית המשפט המחוזי מרכז (כב' השופטת ו' מרוז ) קיבל בקשת רשות ערעור שהגישה המשיבה על החלטה זו, והורה על החזרת הדיון לבית משפט השלום, לאחר שסבר כי יכול שנפלה שגגה מתחת ידיו, וההחלטה הקודמת (שבמסגרתה הנחה את המשיבה להגיש בקשה לצירוף תצהיר) לא עמדה לנגד עיניו כשניתנה ההחלטה האחרונה (שבמסגרתה נדחה ההליך). בית המשפט המחוזי קבע כי בית משפט השלום יקיים דיון במעמד הצדדים ויכריע בערעור המשיבה לגופו. עם זאת, ועל אף קבלת הערעור, חייב בית המשפט המחוזי את המשיבה בהוצאות הערעור, על רקע אחריותה לתקלות הדיוניות שנפלו בהליך.

מכאן הבקשה שלפניי. המבקשת טוענת כי בפסק הדין של בית המשפט המחוזי ובהליך שקדם לו נפלו פגמים רבים המחייבים מתן רשות ערעור וביטול קביעותיו. לדבריה, בית המשפט המחוזי הפך את החלטת בית משפט השלום, שנתקבלה על יסוד טעמים דיוניים מוצקים, והתעלם מסדרי הדין. עוד נטען כי בית המשפט המחוזי לא נהג אף הוא לפי סדרי הדין, שכן הוא קיבל את בקשת רשות הערעור ודן בערעור לגופו, ללא קבלת הסכמת הצדדים או מתן הזדמנות להביע את התנגדותם בהתאם לתקנה 410 לתקנות סדר הדין האזרחי, התשמ"ד-1984. עוד נטען כי הדיון בבקשת רשות הערעור שהוגשה לבית המשפט המחוזי לא הותנה בהפקדת עירבון, וזאת בניגוד להוראות הדין.

דין הבקשה להידחות. רשות ערעור לבית משפט זה ב"גלגול שלישי" תינתן במשורה, מקום שבו מעלה הבקשה שאלה כללית שחשיבותה חורגת מן העניין שיש לצדדים הישירים בהכרעה במחלוקת (ר"ע 103/82 חניון חיפה בע"מ נ' מצת אור (הדר חיפה) בע"מ , פ"ד לו(3) 123 (1982)). הבקשה דנן אינה מעלה שאלה מעין זו. זאת ועוד, פסק-דינו של בית המשפט המחוזי הוא החלטה דיונית שתכליתה היא המשך בירור ההליך לגופו, תוך פסיקת הוצאות לחובת הצד שהתנהלותו הביאה לסיום ההליך ללא הבירור הנדרש. בהחלטות מעין אלה, אין זה מדרכה של ערכאת הערעור להתערב (רע"א 10540/08 נציבות מס הכנסה נ' שחם (לא פורסם, 9.2.2009); שלמה לוין
