בקשת רשות ערעור על פסק דינו של בית המשפט לעניינים מינהליים בבאר-שבע (כב' השופט ש' פרידלנדר ) מיום 12.7.11 בעת"א 12462-07-11 בגדרו נדחתה עתירת המבקש לצאת לביקור בקבר אביו.

המבקש הוא אסיר המרצה עונש מאסר של למעלה משמונה שנים בגין עבירות של שוד גניבה וחבלה בנסיבות מחמירות. לחובתו של המבקש רצף של עבירות משמעת לרבות מעשי אלימות וכוחניות כלפי אסירים אחרים ומעורבות שלילית בתוך כותלי בית הכלא. המבקש מסווג בקטגוריה ב1 לעניין חופשות וכל היתר ליציאה לחופשה מותנה בקבלת חוות דעת משטרתית.
ביום 7.7.11 הגיש המבקש עתירה דחופה ל בית המשפט לעניינים מינהליים לצאת להלווית אביו. בדיון שנערך באותו היום התנגד המשיב לבקשה בשל מסוכנותו הגבוהה של המבקש וכן מאחר שמקום הלוויה במזרח ירושלים ואין אפשרות לשלוח לשם ליווי. בהחלטתו מאותו יום הורה בית המשפט על דחיית הדיון על מנת לתת למשיב שהות לבחון האם וכיצד ניתן להוציא את המבקש לחופשה מיוחדת במהלך ימי האבל.

בדיון שנערך ביום 12.7.11, התנגדה באת כוח המשיב ליציאתו של המבקש לאור התנהגותו השלילית בבית הכלא, וטענה כי לא ניתן להצמיד לו ליווי לבית הקברות. בית המשפט קבע כי לאור התנהגותו השלילית של המבקש בין כותלי בית הכלא, החלטת המשיב אינה בלתי סבירה בגדרו של איזון האינטרסים בין זכותו ההומניטרית של המבקש לבין הסכנה לשלום הציבור, ומשכך דחה את העתירה. יחד עם זאת נקבע, כי איזון האינטרסים עשוי להשתנות בחלוף חודשיים מיום ההחלטה אם לא יווסף מידע שלילי אודות המבקש.

על החלטה זו מלין המבקש בבקשתו. נטען כי אין כל בסיס נורמטיבי לטענה שאין מוציאים ליווי לאסירים למזרח ירושלים, מה עוד שפקודת נציבות שירות בתי הסוהר אינה מבחינה בין אזורים שונים לעניין הליווי. עוד נטען כי אין מדובר בחופשה מיוחדת, אלא בנסיבות חריגות של אבל וכי בקשתו של המבקש מצטמצמת כיום ליציאה לבית הקברות בליווי אבטחה והתייחדות של מספר שעות על קבר אביו, והמבקש אף נכון שהדבר לא יתואם עמו ולא יוודע לו או לאחרים מראש. לאור זאת, עתר המבקש ליתן רשות ערעור על החלטתו של בית משפט קמא שאינה נוגעת רק לעניינו הפרטי של המבקש אלא לנושאים עקרוניים הצריכים הכרעה. לגופו של עניין נטען כי אמנם התנהגותו של המבקש לא היתה תמיד חיובית, אולם בית המשפט ביסס את החלטתו על סמך חומר מודיעיני ולמשיב אף לא ניתנה פארפרזה של החומר.

לאחר שעיינתי בתגובת המשיב, נחה דעתי כי דין הבקשה להידחות.
בתגובה לבקשה הבהיר המשיב כי אין הנחיה כללית שלא לאפשר יציאת אסירים עם ליווי למזרח ירושלים וכי כל מקרה נבחן לגופו. בכך מתייתר הנושא העקרוני והכללי של העתירה, וענייננו מצטמצם לנושא הפרטני של המבקש. די בכך כדי לדחות את הבקשה על הסף.

מעבר לנדרש ולגופה של בקשה, המבקש צמצם את בקשתו ליציאה לקבר אביו למספר שעות באבטחה. על פי סעיף 7 לפקודת הנציבות "הוצאת אסיר באבטחה מחוץ לכותלי בית הסוהר תעשה רק לאחר שנבדקו ההיבטים והסיכונים הביטחוניים הכרוכים בכך" כאשר במסגרת שיקול הדעת אם לאשר היציאה באבטחה ניתן משקל גם ל"אופן תפקודו של האסיר (תפקוד לקוי או חיובי)" (סעיף 7ב(1) לפקודת הנציבות).

על איזון האינטרסים בין השיקולים הנוגדים בבקשות כגון דא, עמדה בהרחבה כב' השופטת פרוקצ'יה ברע"ב 844/07 בנימין רביזדה נ' ש רות בתי הסוהר (לא פורסם, 29.1.2007) (להלן: עניין רביזדה ) שם נדחתה בקשה דומה של המבקש לעלות לקבר אביו ביום השלושים לפטירתו, בליווי אבטחה.
על רקע השיקולים המפורטים בעניין רביזדה בחנתי את עניינו של המבקש. הנימוק המרכזי העומד בבסיס ההחלטה שלא להיעתר לבקשת המבקש, הוא בשל מסוכנותו כפי שמשתקף מהתנהגותו גם בין כתלי בית הכלא, לרבות מעשי אלימות וכוחניות כלפי אסירים אחרים ומעורבות שלילית בין כותלי בית הכלא. כפי שצויין בתגובת המשיב, גם לאחר הדיון המשיך המבקש בהתנהגותו השלילית ואף תקף לאחרונה איש סגל, ובשל כך הועבר לבית סוהר אחר.
מעיון בחומר המודיעיני עולה תמונה שלילית לגבי המבקש כמי שמטיל אימה על אסירים אחרים בין כתלי הכלא וכמי שמעורב בתקריות אלימות. אציין כי מהחומר עולה כי הרקע לתקיפתו של איש הסגל קשור לבקשתו של המבקש לצאת לחופשה עקב מות אביו. על המבקש להבין ולהפנים כי בכוח הזרוע הוא לא ישיג תוצאות, וכל עוד הוא מתנהג באלימות מבוקשו לא יינתן לו, נהפוך הוא.

על רקע האמור לעיל, ועל רקע נקודת המוצא כי התערבותו של בית המשפט בהחלטת רשויות הכלא היא מצומצמת (עניין רביזדה והאסמכתאות שם), הבקשה נדחית.
