בקשת רשות ערעור על פסק הדין של בית המשפט המחוזי בבאר-שבע (השופט י' פרסקי ) בשבתו כבית משפט לעניינים מנהליים בעת"א 21147-07-13 מיום 17.9.2013 בגדרו נדחתה עתירת המבקש שטען על טיפול רפואי רשלני שניתן לו.
המבקש עתר לבית המשפט המחוזי לקבלת פיצוי כספי בגין טיפול רפואי רשלני שקיבל לטענתו מרופא במרפאת השיניים בכלא שקמה, כשזה עקר לו שן לא נכונה. בית המשפט המחוזי דחה את העתירה וקבע כי "שמורה לו זכות תביעה עקב טיפול רשלני נטען... דרכו אינה פשוטה שכן עליו להציג לבית המשפט האזרחי חוו"ד רפואית" . בית המשפט המחוזי הוסיף כי "משאין ביהמ"ש דן בהחלטה צופת פני עתיד, אני מורה על דחיית העתירה". נגד פסק דין זה הגיש המבקש את בקשת רשות הערעור שלפנַי בה ביקש פיצוי כספי בגין השן שנעקרה לו.
דין הבקשה להידחות על הסף. הבקשה אינה מעלה שאלה עקרונית , אלא נושא פרטני של המבקש. הלכה פסוקה היא כי רשות ערעור על פסק דין של בית משפט לעניינים מנהליים בעתירת אסיר תינתן רק מקום שבו הבקשה מעלה שאלה משפטית עקרונית או כאשר היא מעלה נושא בעל חשיבות כללית החורגת מנסיבותיו הפרטניות של האסיר הספציפי (ראו: רע"ב 7/86

(18.7.2012)). לא מצאתי כי הבקשה שלפני באה בגדר המצבים הללו. זאת ועוד: כפי שציין בית המשפט המחוזי, זהו אינו ההליך המתאים לבירור טענותיו של המבקש, שעניינן בתביעה לפיצויים בגין עילה נזיקית. מבלי לנקוט עמדה לגופו של עניין, יצויין כי הדרך הדיונית המתאימה לבירור טענות כגון דא היא בתביעה אזרחית שבגדרה על המבקש להוכיח את נזקו ואת אחריות המשיב לנזק.
אשר על כן, הבקשה נדחית.
