החלטה
ביום 10.6.2007 הוציא מר יצחק בן דוד, סמנכ"ל בכיר לאכיפה במשרד לאיכות הסביבה, צו מינהלי כנגד המבקש, אחד מבעלי מסעדה בשם "מסעדת הטרסה" הממוקמת על חוף ימה של נהריה, מכוח חוק שמירת הסביבה החופית, התשס"ד-2004 (להלן: חוק שמירת הסביבה החופית ) בו נתבקש המבקש להסיר את בימת העץ, המצויה מערבית לטיילת הציבורית על רצועת החוף החולי בנהריה. על פי הצו בימת העץ נבנתה שלא כדין וללא היתר, ופגעה בסביבה החופית.
ביום 17.6.2007 הגיש המבקש לבית המשפט השלום, בקשה לביטול הצו המנהלי, וכן בקשה לעיכובו. ביום 25.6.2007 התלה בית המשפט השלום בנהריה את הצו המנהלי עד למתן החלטה בבקשה גופה (ב"ש 997/07).
ביום 16.7.2007 דחה בית משפט השלום בנהריה (כבוד השופט א' שחורי ) את הבקשה.
על החלטתו של בית משפט השלום ערער המבקש לבית המשפט המחוזי בחיפה (ע"פ 2488/07).
בית המשפט המחוזי (כבוד השופטים ר' שפירא
מ' פינקלשטיין
ו צ' קינן ) דחה בפסק דינו מיום 27.12.2007 את ערעור המבקש בקובעו, כי הקמת הבמה מצמצמת את רצועת החוף, ועל פניו מ דובר בשינוי ניכר בסביבה החופית המאפשר הוצאת צווים מנהלים מכוח סעיף 9 לחוק שמירת הסביבה החופית. עוד קבע בית המשפט כי בימת העץ פוגעת באזורי המחיה של צבי הים, פגיעה המהווה עילה נוספת להוצאת הצווים. כן קבע בית המשפט המחוזי כי נוכח אופיו של צו ההפסקה המנהלי מחויבת הרשות המנהלית בנקיטה בהליכים עיקריים, וכי על המשיבה להגיש כתב אישום כנגד המבקש על ליום 1.3.2008 ולא יפקע תוקפו של הצו המנהלי.
מכאן בקשת רשות הערעור שבפניי, בגדרה טוען המבקש כי שגה בית המשפט המחוזי בקובעו כי הקמת במת העץ פוגעת בזכות הציבור למעבר חופשי בחוף הים, וכי פגיעה זו מהווה פגיעה ניכרת בסביבה החופית. עוד טוען המבקש כי שגה בית המשפט המחוזי משקבע כי ישנה פגיעה באזורי המחייה של צבי הים. טענה נוספת שמעלה המבקש היא כי למשיבה היה ידוע אודות במת העץ מזה מספר שנים ועד היום טרם הוגש כתב אישום. לטענת המבקש, נוכח אופיו של צו ההפסקה המנהלי מחויבת הרשות המנהלית בנקיטת הליכים עיקריים, ושימוש בהליכים זמניים ללא נקיטה בהליך עיקרי הינו שימוש פסול, במיוחד כאשר עסקינן בסוגיה חדשה אשר טרם נבחנה על ידי בית המשפט המוסמך. משכך קביעותיו של בית המשפט המחוזי בעניין צריכות היו להוביל לביטול הצו, זאת מאחר ואף אם יוגש כתב אישום, הרי שללא מתן אפשרות נאותה למבקש להתגונן ייגרם לו עיוות דין.
מנגד טוענת המשיבה כי בקשת רשות הערעור אינה מעוררת כל שאלה משפטית עקרונית והמבקש לא מצביע על עילה המצדיקה דיון בגלגול שלישי. לטענתה המבקש עותר לשינוי קביעות שבעובדה שנקבעו על ידי בתי משפט השלום והמחוזי, וכידוע ערכאת ערעור אינה מתערבת בממצאים עובדתיים שהוכרעו על הערכאה הדיונית.
דין בקשת רשות הערעור להידחות.
עניינו של המבקש כבר נדון בפני שתי ערכאות. כידוע, הכלל הנוהג הינו, כי הרשות לערעור שני, אינה ניתנת כדבר שבשגרה, אלא מוגבלת למקרים המעוררים שאלה בעלת חשיבות משפטית או ציבורית, החורגת מעניינם הפרטני של הצדדים. בענייננו, לא מצאתי בטענות המבקש כל שאלה משפטית עקרונית שכזו, או כל עילה אחרת אשר תצדיק דיון "בגלגול שלישי", בהתאם להלכת ר"ע 103/82 חניון חיפה בע"מ נ' מצת אור (הדר חיפה) בע"מ , פ"ד לו(3) 123 (1982). מסיבה זו בלבד, דין הבקשה להידחות.
מעבר לדרוש יוער, כי דין הבקשה להידחות אף לגופו של עניין. בענייננו, קבע בית משפט השלום כי במת העץ שהוקמה מהווה סיכון לאזורי מחיה ורביה של צבת הים מן הסוג החום, ומהווה פגיעה בסביבה החופית כמשמעותה בחוק לשמירה על הסביבה החופית. מדובר בקביעה המתבססת על העדויות והנתונים שעמדו בפני בית המשפט. כידוע, הלכה היא, כי בית משפט בשבתו כערכאת ערעור איננו נוטה להתערב בממצאים עובדתיים אותם קבע בית משפט של הערכאה הדיונית אשר שמעה את העדויות, התרשמה מהן ובחנה אותן, אלא במקרים חריגים (ראו ע"פ 111/99 שוורץ נ' מדינת ישראל , פ"ד נד(3) 769, 780 (2000); ע"פ 190/82 מרקוס נ' מדינת ישראל , פ"ד לז(1) 225, 234 (1983)). המקרה שבפני אינו אחד מאותם מקרים חריגים. בית משפט השלום שמע את עדותה של העדה המומחית, ערך סיור בחוף הים וביסס את קביעותיו על הנתונים שלפניו. אומנם נפלה מחלוקת בין בית המשפט השלום לבית המשפט המחוזי האם בימת העץ פוגעת בזכות הציבור למעבר חופשי ברצועת החוף, והאם פגיעה זו מהווה פגיעה בסביבה החופית לפי חוק ההגנה על הסביבה החופית, אך הן הערכאה הדיונית והן ערכאת הערעור קבעו כי בימת העץ, מהווה פגיעה וסיכון לפגיעה באזורי המחיה של צבת הים, ומשכך צמצום המעבר החופשי ברצועת החוף לא היה הטעם היחיד והעיקרי להחלטת בית המשפט.
באשר לטענתו של המבקש כי בעת הגשת כתב האישום למעשה פוקע הצו המנהלי, הרי שדינה של טענה זו להידחות. בית המשפט המחוזי קבע כי על המשיבה להגיש כתבי אישום, וכי אי הגשת כתבי אישום עד ליום 1.3.2008 תגרום לפקיעת הצווים. בקביעתו זו איזן בית המשפט המחוזי בין הפגיעה אשר גורם ההליך המנהלי
לזכויותיו של המבקש, ובין האינטרס הציבורי לשמירה על משאבי הטבע, ולא מצאתי מקום להתערב בה.
אשר על כן, דין בקשת רשות הערעור להדחות.
החלטתי מיום 13.1.08, בענין עיכוב ביצוע הצו, מבוטלת בזה.
