החלטה
כנגד המבקש הוגש, ביום 31.5.06, לבית-משפט השלום בנצרת כתב אישום (ת.פ. 2259/06), המייחס לו עבירה של גידול סמים מסוכנים לפי סעיף 6 לפקודת הסמים המסוכנים (נוסח חדש), התשל"ג-1973 (להלן: פקודת הסמים המסוכנים ); ועבירה של שימוש במסמך מזויף לפי סעיף 420 לחוק העונשין, התשל"ז-1977 (להלן: חוק העונשין ).
לפי הנטען בכתב האישום, ביום 14.9.05 נערך חיפוש בביתו של המבקש ונמצא, כי הוא החזיק בתוך שקית ניילון זרעים מסוג קנאבוס במשקל שאינו ידוע למשיבה, כן החזיק בחדר השינה בביתו בתוך עציץ, 55 שתילי סם מסוכן מסוג קנאבוס במשקל כולל של 21.46 גרם
נטו וזאת ללא היתר כדין, לצריכתו העצמית. בנוסף, נמצא שטר הנחזה להיות שטר של 100 ש"ח ביודעו, כי השטר זויף או שונה.
תחילה, הודה המבקש בבית-משפט השלום בכתב האישום המתוקן, אולם ביום 27.12.07 הורה בית-משפט השלום (כבוד הנשיא כ' תאופיק) על ביטול הכרעת הדין והותר למבקש לחזור בו מהודאתו. באותו מעמד, תוקן כתב האישום והמבקש הודה בכתב האישום המתוקן והורשע – על-פי הודאתו האחרונה. בית-משפט השלום גזר על המבקש עונש של חתימה על התחייבות כספית, על סך 10000 ₪
לפיה ימנע מלבצע אחת מהעבירות בה הורשע; הארכת מאסר על תנאי שהיה תלוי ועומד כנגד המבקש לתקופה של שנתיים נוספות ופסילה של המבקש מלקבל או מלהחזיק ברישיון נהיגה לתקופה של 9 חודשים בפועל.
על גזר-הדין של בית-משפט השלום ערערה המשיבה לבית-המשפט המחוזי בנצרת (עפ"א 34/08).
בית-המשפט המחוזי (כבוד השופטים ז' הווארי, א' הלמן וש' אטרש) קיבל, ביום 11.3.08, את הערעור, ביטל את גזר-הדין של בית-משפט השלום וגזר על המבקש מאסר בפועל למשך 12 חודשים; הפעלת המאסר המותנה בן השנתיים בת.פ. 162/94 של בית-המשפט המחוזי בחיפה, מחציתו בחופף ומחציתו במצטבר, כך שסך-כל תקופת המאסר בפועל תעמוד על 24 חודשים; מאסר על תנאי למשך 10 חודשים והתנאי הוא, שהמבקש לא יעבור במשך שנתיים החל מיום שחרורו עבירה מן העבירות בהן הורשע בתיק זה או כל עבירה אחרת על פקודת הסמים המסוכנים, למעט שימוש עצמי, שבגינה המאסר המותנה יהיה 6 חודשים.
מכאן בקשת רשות הערעור שבפני, בגדרה שב המבקש על טענותיו כפי שהעלה בפני בית-המשפט המחוזי.
לטענת בא-כוח המבקש, בית-המשפט קמא לא שת ליבו להודייתו בלא ניהול משפט וכן לכל ההשלכות שנגררות כפועל יוצא מכך. לטענתו, אם היה מנהל משפט, היה בכוחו להוכיח, כי מצבו הקליני הדיכאוני הוא שהביאו לצרוך ולגדל סמים בתור תרופה שתסייע לו "לנהל חיים טובים יותר". עוד מוסיף וטוען בא-כוח המבקש, כי נסיבותיו האישיות של המבקש והתרומה שתורם המבקש בהתנדבותו להוסטל של קשישים, צריכים להביא למתן רשות ערעור על גזר-דינו.
מנגד, תומכת באת-כוח המשיבה בפסק-הדין של בית-המשפט המחוזי ומבקשת לדחות את בקשת רשות הערעור. לטענתה, מדובר בבקשת רשות ערעור שאינה עומדת במבחנים למתן רשות ערעור. עוד מוסיפה היא, כי עונשו של המבקש אינו חורג ממדיניות הענישה המקובלת בעבירות אלה והוא ראוי בנסיבותיו של המבקש, אשר זו אינה המעידה הראשונה לו ובעברו
הרשעות בעבירות סמים.
החלטתי לדחות את בקשת רשות הערעור.
עניינו של המבקש כבר נדון בפני שתי ערכאות. כידוע, הכלל הנוהג הוא, כי הרשות לערעור שני, אינה ניתנת כדבר שבשגרה, אלא מוגבלת למקרים המעוררים שאלה בעלת חשיבות משפטית או ציבורית, החורגת מעניינם הפרטני של הצדדים. בענייננו, הבקשה אינה מעוררת כל שאלה משפטית עקרונית שכזו והמבקש לא הצביע על עילה המצדיקה דיון ב"גלגול שלישי" בעיינו בהתאם להלכת חניון חיפה (רע"א 103/82 חניון חיפה בע"מ נ' מצת אור (הדר חיפה) , פ"ד לו(3) 123).
כמו-כן, טענותיו של המבקש מופנות אך ורק לעניין מידת העונש שהושת עליו. ברם, כידוע, הלכה היא, כי טענות בנוגע לחומרת העונש כשלעצמן, אינן מקימות עילה למתן רשות ערעור, אלא בנסיבות של סטייה ניכרת ממדיניות הענישה (רע"פ 1174/97 עזרא רפאלי נ' מדינת ישראל (לא פורסם, 24.3.97); רע"פ 7201/97 דב בשירי נ' היועץ המשפטי לממשלה (לא פורסם, 11.12.97). במקרה שלפני, העונש שהוטל על המבקש אינו חורג ממתחם הענישה הראוי בעבירות מהסוג שביצע ולא מצאתי כל מקום להתערב בפסק-דינו של בית-המשפט המחוזי.
בענייננו, בית-המשפט המחוזי סקר בפסק-דינו את תסקירי שירות המבחן בעניינו של המבקש ולא מצא בהם נסיבה היכולה ללמד על רצון אמיתי לגמילה ולחזרה למוטב על-ידי המבקש. יתרה מכך נראה, כי עונשו של המבקש אינו חורג ממדיניות הענישה בעבירות אלה ואין מקום להקל בעונשו לאור נסיבותיו האישיות, שכן בעברו 20 הרשעות קודמות רבות במגוון רב של עבירות, לרבות עבירות סמים והמבקש לא נרתע מלבצע את העבירות דנן למרות מאסר מותנה שהיה תלוי ועומד נגדו.
אשר-על-כן, בקשת רשות הערעור נדחית.
החלטתי מיום 20.3.2008 – בעניין עיכוב ביצוע עונש המאסר – מבוטלת בזה.
על המבקש להתייצב ביום 28.9.08 לא יאוחר מהשעה 10:00 במזכירות הפלילית של בית-המשפט המחוזי בנצרת, לשם תחילת ריצוי עונשו.
