א.
בקשת רשות ערעור על פסק דינו של בית המשפט המחוזי מרכז (השופטת הבכירה אהד) בעפ"ת 266-01-12 מיום 4.3.12, שבגדרו נדחה ערעור המבקש על החלטת בית משפט השלום לתעבורה בפתח תקוה (סגנית הנשיא וישקין) בהמ"ש 68-12-11 מיום 11.12.11. עניינה של הבקשה הארכת מועד להישפט.
ב.
מכונית המבקש צולמה ביום 11.6.11, נהוגה במהירות של 127 קמ"ש , הגבוהה מן המהירות המותרת. המבקש קיבל דו"ח, והוא שולם. הרכב רשום על שם המבקש, אולם לטענתו בתו היא שנהגה ברכב ועברה את העבירה; היא הגישה לימים תצהיר על כך שלא נסתר. ביום 2.11.11 קיבל המבקש הודעה על נקודות שנצברו בגין העבירה, או אז הגיש בקשה להארכת מועד כדי להישפט.
ג.
בית משפט השלום לתעבורה דחה עתירת המבקש להאריך את המועד. נומק, כי אינטרס הציבור מחייב להעביר מסר חד משמעי בדבר חובה לעמוד במסגרת הזמנים הקבועה בחוק. חריגה מעקרון זה, כך הוסבר, תהוה הפליה לרעה של שאר ציבור הנהגים הפועל כחוק מבחינת המועדים.
ד.
בית המשפט המחוזי לא מצא להתערב בפסק דינו של בית משפט השלום לתעבורה. צוין, כי מדובר בהחלטה מנומקת ומבוססת. כן נדחתה הטענה כי המבקש לא היה ער לניקוד שהוטל עליו בעקבות הדו"ח, שכן מספר הנקודות צוין בדו"ח עצמו.
ה.
מכאן הבקשה הנוכחית. נטען, כי סעיף 230 לחוק סדר הדין הפלילי (נוסח משולב), תשמ"ב- 1982 מעניק לבית המשפט שיקול דעת בכל הנוגע להארכת המועד להישפט, ואין הוא מגביל את בית המשפט לסיטואציה שבה שילם הנאשם את הקנס טרם ביקש להישפט. צוין, כי אין ספק שהנהג שעבר את העבירה אינו המבקש אלא בתו, ועל כן אם לא תתאפשר הארכת מועד, ייגרם לו עיוות דין של ממש.

לאחר העיון אין בידי להיעתר למבוקש. בידוע, כדי שתישקל רשות ערעור בגלגול שלישי, יש צורך להצביע על בעיה משפטית או ציבורית החורגת מעניינם של הצדדים להליך, ואין המקרה דנא בא בגדרים אלה (רע"א 103/82 חניון חיפה נ' מצת אור (הדר חיפה) , פ" ד לו(3) 123); רע"פ 9058/09 יהודה נ' מדינת ישראל (לא פורסם)). היו למבקש שני ימיו השיפוטיים, ואף אם להלכה ניתן היה להחליט אחרת אין מקום למועד נוסף. ומכל מקום, משקיבל המבקש דו"ח תעבורה על שמו בגין עבירה אשר לטענתו לא נעברה על ידיו, ובו גם ניקוד, היה עליו לפעול לאלתר במסגרת סעיף 229 לחוק סדר הדין הפלילי לשם ביטול הדו"ח או הסבתו לבתו. המבקש נמנע מעשות כן, ורק למעלה ממחצית השנה מעת ביצוע העבירה והדו"ח, פנה בבקשה לביטולו. בנסיבות אלה, רשאי היה בית המשפט לתעבורה לדחות את הבקשה להארכת מועד, בשל האיחור הבלתי סביר שבהגשתה; אכן, המבקש נימק טענתו בהיותו עולה לארץ - ואולם הוא קיבל את הדו"ח ושילם אותו, כלומר – ידע, ועל סימן השאלה היה להתעורר אז. דומה כי יש יסוד להנחה, שפנייתו של המבקש לבית המשפט באה רק מש"חרב הפסילה" הונפה מעל ראשו. חוששני כי בנסיבות אין בטענותיו בבקשה זו כדי להצדיק - כאמור - הליך בגלגול שלישי.
