בקשת רשות ערעור על פסק דינו של בית המשפט המחוזי בתל אביב (הנשיאה ברלינר, השופט קרא והשופטת סוקולוב) בע"פ 41572-01-12 מיום 26.3.12, במסגרתו נדחה ערעור על פסק דינו של בית משפט השלום לתעבורה (השופט דרורי) מיום 2.6.11. המבקש הורשע בבית משפט השלום לתעבורה בגרם מוות בנהיגה רשלנית, נהיגה בקלות ראש שגרמה לחבלה, נהיגה במהירות שאינה מותרת, ואי האטה.
רקע
פסק דינו של בית משפט השלום לתעבורה
ב.
הנה תמצית העובדות ושעל יסודן הורשע המבקש, לאחר שמיעת ראיות. ביום 10.1.09 בשעת בוקר נהג המבקש (יליד 1988) ברכבו בכביש בן שלושה נתיבים, בו המהירות המותרת היא 50 קמ"ש . שעה שהתקרב לצומת מרומזר, כשבכיוון נסיעתו אור ירוק, החל לחצות בריצה את הכביש אדם חירש וקשיש ושמו אלדין קרייב, ע"ה (יליד 1927, להלן המנוח ) במעבר חציה, שעה שבכיוון הליכתו אור אדום. רכבו של המבקש פגע למרבה הצער במנוח; הוא פונה לטיפול, וביום 20.1.09 נפטר.

משזיהה המבקש את המנוח החל לבלום, אך לא הצליח למנוע פגיעה. עיקר המחלוקת התמקדה במהירות נסיעתו של המבקש. הבוחן המשטרתי מצא, כי בעת הפגיעה במנוח היה רכבו של המבקש במהירות 56 קמ"ש ואילו בסמוך ולפני הפגיעה היה במהירות שלא פחותה מ- 73.5 קמ"ש . נמצא, כי אילו נהג המבקש במהירות מותרת של 50 קמ"ש - ובהתאם לתגובתו המהירה של המבקש בפועל ברגע קרות התאונה - היה עוצר את רכבו כשמונה מטרים לפני הגיעו אל המנוח. בית המשפט קיבל את ממצאיו של הבוחן המשטרתי וקבע, כי אילו נהג המבקש היה במהירות 50 קמ"ש היתה התאונה נמנעת. לפיכך הורשע המבקש בעבירות שיוחסו לו; זאת חרף קביעתו של בית המשפט לפיה "אין צל של ספק כי הולך הרגל המנוח תרם תרומה גדולה ביותר להתרחשות התאונה והוא למעשה האשם העיקרי בהתרחשותה" (עמוד 5 פסקה 9). בגזר הדין, צוין בין היתר, כי המבקש פגע בעבר בהולך רגל במעבר חצייה. הושתו עליו 6 חודשי מאסר שירוצו בעבודות שירות; 6 חודשי מאסר על תנאי למשך 3 שנים; 6 שנות פסילה מלהחזיק רשיון נהיגה; פיצוי למנוח בסך 8,000 ₪; וצו מבחן למשך שנה.
פסק דינו של בית המשפט המחוזי

בית המשפט המחוזי קבע כי השאלה שבמחלוקת "פשוטה, ממוקדת וחד-משמעית: מה היתה מהירות נסיעתו של המערער". הובהר, כי המבקש בהודעתו מסר שראה את המנוח יורד לכביש וכי אין מדובר בתיק שכל כובד משקלו מונח על זמן התגובה, שכן המבקש הגיב בזמן (שורות 21-17). טענה מרכזית של הסניגור היתה שיכול שסימני הרכב הפוגע אינם תואמים את סימני רכבו של המבקש. בית המשפט המחוזי נדרש למהימנות ממצאיו של הבוחן המשטרתי, אשר הגיע לשטח בסמוך ולאחר התאונה, העניק להם משקל מכריע, ודחה טענה זו. לפיכך נקבע, כי משנמצא שסימני הרכב הפוגע הם סימני רכבו של המבקש, חישוב מהירות רכבו היא עניין מתמטי שגם המומחה מטעמו אינו חולק עליו. נוכח האמור נקבע - כקביעת בית המשפט לתעבורה - כי אלמלא נסע המבקש מעל המהירות המותרת היתה התאונה נמנעת, ולפיכך נדחה הערעור. הוטעם, כי רשלנותו הגבוהה של המנוח (שאינה במחלוקת) אינה מעלה או מורידה לעניין אחריותו הפלילית של המבקש, שכן אינה מנתקת את הקשר הסיבתי בין רשלנותו של המבקש לבין קרות התאונה.
הבקשה
ה.
נטען, כי נוכח נסיבות האירוע ואופן התרחשות התאונה, נוצר חשש כבד וממשי לעיוות דין הנובע מהרשעתו של המבקש, מבלי שאשמתו הוכחה, ובלא שנערכו תחשיבים נכונים שיבססו את הרשעתו; נתבקש לאמץ את עמדת ההגנה לעניין מהירות התגובה האנושית, שקלול מהירות הנסיעה, טווח הנסיעה והתנאים במקום, ולקבוע כי לא היה בידי המבקש למנוע את התאונה. נטען כי שגו שתי הערכאות הקודמות בקביעתם כי קשר סיבתי התקיים. הוצג ע"פ 8529/10 אלוני נ' מדינת ישראל (לא פורסם)(להלן עניין אלוני ) - שם זוכה נהג שהורשע בגרם מוות בנהיגה רשלנית.
דיון והכרעה

עיקרה של הבקשה סב על ממצאים עובדתיים, אשר נבחנו בידי שתי ערכאות, ואין בו - ובמובהק - כדי לבוא בגדרי המקרים המצדיקים רשות ערעור בגלגול שלישי. אכן, נטען בבקשה, שהמקרה דנא מצדיק מתן רשות ערעור בהתאם להלכת חניון חיפה (רע"א 103/82 חניון חיפה בע"מ נ' מצת אור (הדר חיפה) בע"מ , פ"ד לו(3) 123) ואף נסקרה ספרות באשר למקרים בהם יטה בית המשפט ליתן רשות; אולם אין הדברים הללו עולים בקנה אחד עם המקרה דנא. עיון בפסקי הדין של שתי הערכאות בענייננו גם אינו מעלה חשש לעיוות דין בכל הקשור לממצאים אשר כלפיהם טוען המבקש.
ז.
במישור המשפטי, טוען המבקש נגד קיומו של קשר סיבתי. טענה זו נדונה בפסק דינו של בית המשפט המחוזי ונקבע, כי המדובר בשני גורמים המביאים לתוצאה הקטלנית - התנהגותם של המבקש מזה ושל המנוח מזה - וכי בעצם היותם מצטברים אין כדי להסיר את אחריותו הפלילית של המבקש, שכן לא ניתק הקשר הסיבתי. קביעה זו אינה מצדיקה בחינה מחודשת.
ח.
עוד הפנה המבקש לעניין אלוני , ובעיקר לדבריו אלה של בית המשפט:
"משקבע בית המשפט כי קיימת אפשרות שהמערער נכנס לצומת באור ירוק, כי נסע במהירות המותרת, כי עלה בידו לסתור את החזקה בדבר השפעת שכרותו על נהיגתו, וכי קיימת אפשרות שהמנוח נכנס לצומת באור אדום - לא ניתן היה להרשיעו בעבירת ההריגה, אך גם לא בעבירה של גרם מוות ברשלנות".
המבקש עתר להקיש מעניין אלוני בבחינת קל וחומר; שם די היה ב"אפשרות" לכך שהמערער נכנס באור ירוק והמנוח באור אדום, כדי להביא לזיכויו של המערער. כנטען, בענייננו אין מדובר ב"אפשרות" אלא ב"ודאות" שאלה פני הדברים, ומשכך, מקל וחומר, יש לזכות את המבקש.
ט.
ההשוואה לעניין אלוני אינה יכולה להועיל למבקש, בכל הכבוד. שם, קיומו של ספק סביר באשר לקיומו של רכיב מרכיבי היסוד העובדתי הביא לזיכויו של המערער. המחלוקת היתה אם נכנס המערער שם לצומת באור אדום, אם לאו; אם נכנס המנוח שם באור ירוק, אם לאו. בנדון דידן אין טענה, כי המבקש עבר עבירה של נסיעה באור אדום או כי המנוח עבר באור ירוק. המבקש עבר עבירה של נהיגה במהירות שאינה מותרת , שבגינה לא נמנעה התאונה. קביעה זו הושתתה על ממצאי חוות דעתו של הבוחן המשטרתי, אשר נבחנו ואומצו על ידי שתי הערכאות; וכפי שעולה מפסק דינו של בית המשפט המחוזי, אף המומחה מטעם המבקש הסכים לחישוב בהקשר זה. לפיכך אין להלום את הטענה לפיה ניתן "מקל וחומר" להסיק מ"אפשרות" ל"ודאות" כנטען.
י.
בנסיבות, אין בידי איפוא להיעתר למבוקש.
