החלטה
בפניי שתי בקשות ערעור על פסק דינו של בית המשפט המחוזי בתל-אביב-יפו בתיק ע"פ 7180/09 וע"פ 7196/09 מיום 5.4.2009. במסגרת פסק הדין נדחו ערעוריהם של המבקש בע"פ 3749/09 (הוא המבקש 1 בע"פ 3725/09, להלן: רשתי ) ושל המבקש 2 בע"פ 3725/09 (להלן: ביטון ) על גזר הדין מיום 5.1.2009, אשר ניתן בעניינו של המבקש בבית משפט השלום בתל-אביב-יפו (ת"פ 6903/07). הבקשה בע"פ 3749/09 מופנית כנגד כלל רכיבי העונש שהוטל על רשתי ואילו הבקשה בע"פ 3725/09 מתמקדת בסעיפי חילוט הרכוש.
כנגד רשתי ושניים אחרים הוגש כתב אישום, אשר תוקן בשלישית במסגרת הסדר טיעון ואשר הכיל ארבעה עשר אישומים. בשלשה מתוכם, יוחסו לרשתי שלוש עבירות של סחר בסם מסוכן, לפי סעיף 13 לפקודת הסמים המסוכנים [נוסח חדש], התשל"ג-1973 (להלן: פקודת הסמים המסוכנים ); וכן עבירה של החזקת סם מסוכן שלא לצריכה עצמית, לפי סעיפים 7(א) ו-7(ג) לפקודת הסמים המסוכנים. כתב האישום הכיל גם בקשה לחילוט מכונית הטויוטה בה השתמש רשתי במסגרת ביצוען של חלק מן העבירות (להלן: מכונית הטויוטה ) וסכומי כסף שנמצאו ברשותו.
על פי המתואר בכתב האישום, בשלוש הזדמנויות שונות בחודש יוני 2007, מכר רשתי עשרות גרמים של סם מסוכן מסוג קוקאין לסוכן סמוי של המשטרה (להלן: הסוכן ) תמורת אלפי שקלים, כאשר באחת הפעמים הוא אף פעל במשותף עם אדם נוסף, אשר העביר את הסמים לסוכן. כמו כן, באחת מפגישותיו האחרות עם הסוכן, החזיק רשתי 3.3163 גרם
של קוקאין.
ביום 18.3.2008, הרשיע בית משפט השלום בתל-אביב-יפו (כובד השופטת ח' כוחן ) את רשתי בעבירות המיוחסות לו, על פי הודאתו. בהוראת בית המשפט , הוכן בעניינו של רשתי תסקיר מעצר מיום 24.8.2008 וכן תסקיר נוסף מיום 11.11.2008 (בעודו שוהה במעצר), בו עמד שירות המבחן על רצונו לבצע שינוי באורחות חייו, ואולם הדגיש כי מעשיו מבטאים דפוסי התנהגות מושרשים וציין, כי קיים אצלו קושי בקבלת מרות, כי הוא נתון לדחפים אימפולסיביים וכי "הוא מתקשה להתנקות מסמים לאורך זמן". בתסקיר זה ביקשה קצינת המבחן לקבל דחייה לצורך המשך מעקב ואולם בית המשפט לא נעתר לכך.
ביום 5.1.2009, לאחר שמיעת הטיעונים לעונש והתייחסות לחומרת מעשיו של רשתי ומאידך גם לנסיבותיו המקלות, קבע בית משפט השלום בגזר דינו מיום 5.1.2009, כי רשתי הינו סוחר סמים. בעקבות זאת ותוך שימוש בחזקה הקבועה בסעיף 31(6) לפקודת הסמים המסוכנים, לפיה יש לראות את רכושו של רשתי כרכוש שהושג בעבירה של עסקת סמים, חילט בית המשפט הן את הכסף שנמצא בביתו – 34,350 ש"ח והן את מכונית הטויוטה. ביטון טען בפני בית המשפט כי המכונית שייכת לו
ובנוסף נטען כי הכסף שחולט שייך לאביו של רשתי ואולם טענות אלה נדחו. נוסף על כך, הוטל על רשתי עונש של 26 חודשי מאסר; 15 חודשי מאסר על תנאי למשך שלוש שנים; קנס בסך 15,000 ש"ח; ופסילת רישיון נהיגה למשך 18 חודשים.
על גזר הדין הוגשו שני ערעורים לבית המשפט המחוזי בתל-אביב-יפו. רשתי ערער על חומרת עונשו ואילו ביטון ערער על ההחלטה כי הוא אינו הבעלים של מכונית הטויוטה (ע"פ 7180/09 וע"פ 7196/09). לאחר שהדגיש את הנסיבות המחמירות בהן בוצעו העבירות ואת החובה להילחם בנחרצות כנגד עבריינות הסמים בכלל, אישר בית המשפט המחוזי (כבוד סגנית הנשיא כתוארה אז, ד' ברלינר והשופטים ע' פוגלמן ות' שפירא ) כי העונש שהוטל על רשתי ראוי ומידתי. הטענות בסוגיית החילוט – טענות הבעלות של ביטון על הטויוטה והטענות בנוגע למקור הכספים – לא התקבלו גם בערכאה השנייה וכך נדחו הערעורים על כל רכיביהם.
עוד יצוין, כי צבי אשטיוקר (להלן: אשטיוקר ), נאשם נוסף בכתב האישום שהוגש כנגד רשתי, הורשע גם הוא על פי הודאתו בעבירות שיוחסו לו – שלוש עבירות של סחר בסם מסוכן מסוג חשיש, עבירה של החזקת סם מסוכן שלא לצריכה עצמית ועבירה של החזקת כלים להכנת סם. מאחר שאשטיוקר סחר בחשיש ולא בקוקאין, בית המשפט הקל בעונשו ביחס לרשתי.
מכאן הבקשות שבפניי. בא כוחו של רשתי ברע"פ 3749/09 שב ומשיג על חומרת העונש שהוטל על מרשו, בטענות שונות העוסקות בין השאר בנסיבותיו האישיות של רשתי, בהשוואה בין עונשו לעונש שהוטל על אשטיוקר ובתסקירי שירות המבחן. גם בא כוחם של רשתי וביטון ברע"פ 3725/09 חוזר בפניי על הטענות המשפטיות והעובדתיות שהעלה בפני בית המשפט
המחוזי, הן לענין הכספים שחולטו והן לענין מכונית הטויוטה.
בא כוח המשיבה סבור מצידו, כי אין מקום לדון בעניינם של המבקשים בגלגול שלישי ומפנה לנימוקי בית המשפט המחוזי לסתירת טענותיהם.
דין בקשת רשות הערעור להידחות.
הלכה היא, כי רשות ערעור בפני ערכאה שלישית ניתנת רק במקרים חריגים, בהם מתעוררת סוגיה בעלת חשיבות משפטית או ציבורית החורגת מעניינם הפרטני של הצדדים (ר"ע 103/82 חניון חיפה בע"מ נ' מצת אור (הדר חיפה) בע"מ , פ"ד לו(3) 123 (1982)). אין טענות באי כוח המבקשים נוגעות אלא לעניינם האישי של מרשיהם ואין בהן כדי לחדש דבר, על הנטען בפני בית המשפט המחוזי. לפיכך אין שאלות אלה מצדיקות דיון בגלגול שלישי.
מעבר לכך, שתי הבקשות מופנות כנגד חומרת עונשו של רשתי ובידוע שטענות מסוג זה אינן מקימות ככלל עילה למתן רשות ערעור בפני בית משפט זה, אלא בנסיבות של סטייה ניכרת ממדיניות הענישה (ראו רע"פ 1174/97 רפאלי נ' מדינת ישראל (לא פורסם, 24.3.1997); רע"פ 7201/97 בשירי נ' היועץ המשפטי לממשלה (לא פורסם, 11.12.1997)). גזר הדין שהוטל על המבקש איננו חורג מנורמת הענישה המקובלת בעבירות החמורות בהן הורשע רשתי ועל כן דין הבקשה להידחות מסיבות אלה בלבד.
למעלה מן הצורך אציין, כי דין הבקשות להידחות גם לגופן. כל קביעותיו של בית משפט השלום מבוססות ומנומקות היטב בגזר הדין. כמות הקוקאין שמכר רשתי לסוכן במספר מפגשים, סכומי הכסף הגבוהים שקיבל תמורתו והעובדה שהפנה את הסוכן גם לאדם נוסף לקבלת הסמים – סימן לכך שהוא התמצא היטב בעיסוקו –מצדיקים בהחלט להחמיר בעונשו כראוי לסוחר סמים. נסיבותיו האישיות, אינן ממעיטות מן הפסול שבמעשיו, כך במיוחד לאור ממצאיו המדאיגים של שירות המבחן, ועל כן איני רואה מקום להתערב במסקנות בית משפט השלום ובית המשפט המחוזי.
אין ממש גם בטענות המתייחסות לחילוט הרכוש. עדות אביו של רשתי בה נטען, כי הכסף שחולט הגיע לרשתי ממנו, נדחתה בבית משפט השלום בשל סתירות שנמצאו בה ונוכח אי התאמתה לעדותו של רשתי עצמו. גם עדותו של ביטון על כך שמכונית הטויוטה שייכת לו, נמצאה לא מהימנה, בין השאר בשל הסתירות בינה לגרסה שהציג רשתי בהודעתו במשטרה. בבקשה, לא הוצגו בפניי טיעונים שיש בהם כדי לסתור את האמור ולפיכך אין לי אלא להסכים עם ההחלטה לחילוט הרכוש, בהסתמך על הוראתו של סעיף 31(6) לחוק העונשין.
אשר על כן, הבקשות למתן רשות ערעור נדחות על כל רכיביהן, הן לענין חילוט הכסף ומכונית הטויוטה, והן לענין עצם חומרת העונש.
