החלטה
המבקשת הועמדה לדין בבית משפט השלום בחיפה (פ 3983/05) בגין עבירה של שימוש נמהר ורשלני באש או בחומר דליק, לפי סעיף 338(א)(3) לחוק העונשין, התשל"ז-1977 (להלן: חוק העונשין ); ועבירה של חבלה ברשלנות, לפי סעיף 341 לחוק העונשין.
לפי הנטען בכתב האישום, ביום 24.12.2004 הפעילו המבקשת ואישה נוספת דוכן "שעשועי מדע", במסגרת אירועי חנוכה. כחלק מהפעלת הדוכן השתמשה המבקשת בחומר דליק מסוג אתאנול, לו הוסיפה מלחים מסוימים לשם קבלת להבות בגוונים שונים. במהלך הפעילות שפכה המבקשת בשוגג חומר דליק על קטין שהשתתף באירוע, וכתוצאה מכך אחזה אש בבגדיו ובשיערו ונגרמו לו כוויות והוא נזקק למספר ניתוחים.
ביום 4.5.2008 הרשיע בית משפט השלום (כבוד סגנית הנשיא ר' חוזה ) את המבקשת בעבירה של מעשה פזיזות ורשלנות באש, וזיכה אותה מעבירה של חבלה ברשלנות. בית המשפט
קבע כי המבקשת סטתה באורח משמעותי ובמידה גדושה מרמת הזהירות הסבירה שהיה עליה לצפות בנסיבות הענין – שימוש באש במרחק קצר מקהל צופים הכולל ילדים.
ביום 23.11.2008
הורה בית משפט השלום על ביטול הרשעתה של המבקשת והטיל עליה צו שירות לתועלת הציבור בהיקף של 180 שעות. בית המשפט קבע כי הרשעת המבקשת תחסום את הדרך בפניה מלהמשיך ולעסוק במקצוע אליו הכשירה עצמה וכי מנגד לא יהיה בהרשעתה כדי לשנות במאום את מצבו של הקטין או ביכולתו לתבוע את נזקיו ממנה בהליך אזרחי.
על ההחלטה הנ"ל ערערה המשיבה לבית המשפט המחוזי בחיפה (ע"פ 2968-12-08).
בפסק דינו מיום 7.5.2009 קיבל בית המשפט המחוזי (כבוד סגן הנשיא י' גריל והשופטות ב' בר-זיו ו-ת' שרון-נתנאל) את הערעור בקובעו כי הימנעות מהרשעה אפשרית בהתקיים שני תנאים מצטברים – האחד כי ההרשעה צפויה להסב לנאשם נזק רב ולפגוע פגיעה חמורה בשיקומו; והשני כי סוג העבירה מאפשר לוותר על ההרשעה מבלי לפגוע באופן מהותי בשיקולי הענישה האחרים. בכל הנוגע למבקשת קבע בית המשפט כי אין בנסיבותיה האישיות כדי לגבור על האינטרס הציבורי שבהרשעתה.
מכאן בקשת רשות הערעור שבפניי, אשר במסגרתה טוענת המבקשת כי שגה בית המשפט המחוזי משהרשיעה, לנוכח ההשלכה הקשה שתהיה להרשעה זו על עתידה המקצועי. לטענת המבקשת, בית המשפט המחוזי ביטל את החלטתו של בית משפט השלום בגין מהותה של העבירה בה הורשעה, הגם שלא התרשם בעצמו, בשונה מבית משפט השלום, ממצבו של הקטין כיום.
המבקשת אף מבקשת להוסיף ראיות הנוגעות להשלכותיה של ההרשעה עליה, אולם בנסיבות הענין אין מקום להיענות לבקשה זו.
מנגד טוענת המשיבה כי הבקשה אינה עומדת בקריטריונים הדרושים למתן רשות ערעור, שכן אינה חורגת מעניינה הפרטי של המבקשת, וכי גם לגופו של ענין ההחלטה להרשיעה הייתה מוצדקת.
לאחר שעיינתי בבקשה על נספחיה, בתגובה לה ובהחלטותיהן של הערכאות שקדמו לי, שוכנעתי כי דין הבקשה להידחות.
עניינה של המבקשת כבר נדון בפני שתי ערכאות. כידוע, הכלל הנוהג הינו, כי הרשות לערעור שני, אינה ניתנת כדבר שבשגרה, אלא מוגבלת למקרים המעוררים שאלה בעלת חשיבות משפטית או ציבורית, החורגת מעניינם הפרטני של הצדדים, בהתאם להלכת בר"ע 103/82 חניון חיפה בע"מ נ' מצת אור (הדר חיפה) בע"מ , פ"ד לו(3) 123 (1982). בענייננו, חרף טענות המבקשת, אין בבקשתו כל עילה שתצדיק מתן רשות ערעור.
יתרה מכן, הלכה היא כי טענות הנוגעות לחומרת העונש כשלעצמה – ובהן גם טענה שהיה על בית המשפט
להימנע מהרשעה, אינן מקימות עילה למתן רשות ערעור בפני בית משפט זה, אלא בנסיבות של סטייה ניכרת ממדיניות הענישה (ראו רע"פ 5504/08 פלוני נ' מדינת ישראל
(לא פורסם, 27.7.2008)). בנסיבות המקרה, לא מצאתי כל סטייה שכזו מנורמת הענישה המקובלת בעבירה אותה ביצעה המבקשת, אף לאור נסיבותיה האישיות. מסיבות אלו בלבד, דין הבקשה להידחות.
מעבר לדרוש יוער, כי גם לגופו של ענין דין הבקשה להדחות. כידוע, משנקבעה אחריותו של אדם בפלילים, יש להרשיעו. חריג שבחריגים לכלל זה מותיר בידי בית המשפט
סמכות להימנע מהרשעה, במקרים יוצאי דופן (ראו רע"פ 1189/06 בר-לב נ' מדינת ישראל (לא פורסם, 12.9.2006)). אמנם קרוב לוודאי שלהרשעתה בפלילים תהיה השפעה קשה על עתידה של המבקשת. אולם לא ניתן מנגד להתעלם מכך שדווקא היא, שהוסמכה בתחום מדעי הרפואה, ביוטכנולוגיה וכימיה, ועוסקת בתחום זה, תקפיד שבעתיים בעת השימוש בחומרים מסוכנים אל מול קהל, ותקפיד לנקוט בכל אמצעי הזהירות הנדרשים לשם מניעתם של מקרים כגון התוצאה הקשה שהתרחשה בפועל. בנסיבות אלו לא היה מנוס מההרשעה, חרף הפגיעה שגלומה מטבע הדברים בהרשעה זו.
אשר על כן, הבקשה למתן רשות ערעור נדחית.
