החלטה
נגד המבקש הוגש כתב אישום בבית משפט השלום בבאר שבע (תיק פלילי 4933/08) בגין עבירה של הסתננות, לפי סעיף 2 לחוק למניעת הסתננות (עבירות ושיפוט), התשי"ד-1954; שתי עבירות של גניבה, לפי סעיף 384 לחוק העונשין, התשל"ז-1977 (להלן: חוק העונשין ); שתי עבירות של התפרצות למקום מגורים, לפי סעיף 406(ב) לחוק העונשין; ועבירה של הפרעה לעובד ציבור במילוי תפקידו, לפי סעיף 288א' לחוק העונשין.
על פי מתואר בכתב האישום, המבקש הינו תושב רצועת עזה אשר מעולם לא החזיק באישור כניסה או שהייה בישראל כדין. ביום 12.9.2008 הסתנן המבקש לישראל בדרך שחייה בים, עד שהגיע בסמוך לישוב נתיב העשרה. לאחר שנכנס לישוב פרץ המבקש למספר בתים בישוב כשהוא נוטל מהם פרטי רכוש שונים ובהם מפתחות רכב, ארנק, מצלמה דיגטאלית, שעון יד וכן מצרכי מזון שונים. בשלב מסוים הבחינו בו אנשי הישוב ובהם רכז הביטחון של הישוב וקראו לו לעצור. המבקש ניסה לברוח מהמקום בריצה, אך נתפס ועוכב על ידי רכז הביטחון ושומר הישוב.
המבקש הודה בעובדות כתב האישום והורשע על פי הודאתו. ביום 21.12.2008 ניתן גזר דינו של בית משפט השלום (כבוד השופטת ד' בית-אור ). בית המשפט ציין כי למבקש עבר פלילי בעבירות רכוש וכניסה לישראל, אך יחד עם זאת אף את העובדה שהמבקש הודה בהזדמנות הראשונה וחסך זמן שיפוטי יקר, את נסיבותיו האישיות, את כך שהרכוש הוחזר לבעליו ואת העובדה שעברו הפלילי הינו מלפני שנים רבות יחסית. במכלול השיקולים מצא בית המשפט להשית עליו עונש של 20 חודשי מאסר בפועל ו-24 חודשי מאסר על תנאי למשך 3 שנים.
המשיבה ערערה על קולת העונש לבית המשפט המחוזי בבאר שבע (ע"פ 6025/09).
ביום 27.5.2009 ניתן פסק דינו של בית המשפט המחוזי בבאר שבע (כבוד סגני הנשיא ר' אבידע ו נ' הנדל וכבוד השופטת ח' סלוטקי ). נקבע כי לאור מדיניות הענישה הראויה בעבירות הסתננות והנסיבות המחמירות בתיק, היינו עבירות הרכוש מסוג פשע שביצע המבקש, נדרש עונש מרתיע הן ברמה הפרטנית והן ברמה הכללית, וכי העונש שקבע בית משפט השלום אינו נותן ביטוי מלא לשיקול זה. לפיכך, התקבל הערעור והוחמר עונשו של המבקש לכדי 27 חודשי מאסר הפועל.
מכאן הבקשה שבפניי. המבקש פונה בבקשה כי יוקל בעונשו בעיקר לאור נסיבותיו האישיות, אב לחמישה ילדים אשר עול פרנסתם עליו, ואשר אחד מהם חלה במחלת לב בזמן מאסרו.
לאחר שעיינתי בבקשה ובפסקי הדין של הערכאות הקודמות, נחה דעתי כי דינה להידחות. וזאת, אף מבלי לבקש את תגובת המשיבה.
כידוע רשות ערעור בפני ערכאה שלישית, אינה ניתנת בשגרה אלא אך במקרים חריגים בהם מתעוררת סוגיה בעלת חשיבות משפטית או ציבורית החורגת מעניינם הפרטני של הצדדים (ר"ע 103/82 חניון חיפה בע"מ נ' מצת אור (הדר חיפה) בע"מ , פ"ד לו(3) 123 (1982)). יתרה מכך, טענות בנוגע לחומרת העונש, אינן מקימות דרך כלל עילה למתן רשות ערעור בפני בית משפט זה, אלא בנסיבות של סטייה ניכרת ממדיניות הענישה (ראו רע"פ 1174/97 רפאלי נ' מדינת ישראל (לא פורסם, 24.3.1997); רע"פ 7201/97 בשירי נ' היועץ המשפטי לממשלה (לא פורסם, 11.12.1997)). בנסיבות המקרה, לא מצאתי כי המבקש מעורר שאלה החורגת מעניינו הפרטני או כי הראה סטייה מנורמת הענישה המקובלת בעבירות אותן ביצע. מסיבות אלו בלבד, דין הבקשה להידחות.
מעבר לנדרש יוער, כי לא ראיתי פגם אף בשיקולי בית המשפט המחוזי לגופם. הפוטנציאל החמור הגלום בעבירות ההסתננות לישראל, ובמיוחד כשאלו מבוצעות מלכתחילה לתכלית של ביצוע עבירות נוספות, רכושיות ואחרות, מחייב מתן משקל רב לאינטרס הציבורי בהרתעה מפני ביצוען. משכך, פוחת אף משקלן של נסיבותיו האישיות של המבקש, ובכללן נסיבותיו המשפחתיות. בנסיבות הענין, לא רק שהמבקש הסתנן לישראל, אלא שעשה זאת במטרה לבצע עבירות רכוש, ואכן נתפס רק לאחר שביצע שורה ארוכה של עבירות רכוש לא קלות. בנסיבות אלו, וחרף העובדה שהרכוש הגנוב הוחזר לבעליו, איני רואה מקום להתערב בשיקול דעתו של בית המשפט
המחוזי שמצא להחמיר בעונשו של המבקש, ודין הבקשה לרשות ערעור להידחות אף לגופה.
אשר על כן, הבקשה נדחית.
