החלטה
המבקש הועמד לדין בבית משפט השלום בתל-אביב-יפו (פ 8264/07) בגין עבירה של זיוף בכוונה לקבל דבר, לפי סעיף 418(2) לחוק העונשין, התשל"ז-1977.
לפי הנטען בכתב האישום, עובר ליום 19.4.2005 זייף הנאשם גיליון ציונים לתואר ראשון בכך שערך גיליון בו שינה את ציוניו, במטרה להתקבל ללימודי תואר שני באוניברסיטת תל אביב.
ביום 27.11.2008 הרשיע בית משפט השלום (כבוד השופט י' יצחק) את המבקש בעבירה שיוחסה לו בכתב האישום, בקבעו כי הוכח בעליל כי גיליון הציונים אינו משקף את ציוניו הנכונים ומנגד הימנעותו מלהעיד או מלמסור גרסה כלשהי במשטרה, מביאה לקביעה כי הוכחה אשמתו מעבר לכל ספק סביר.
ביום 27.11.2008
גזר בית המשפט על המבקש עונש של שבעה חודשי מאסר על תנאי למשך שלוש שנים וקנס בסך 2,000 ש"ח או 20 ימי מאסר תמורתו.
על פסק הדין הנ"ל ערער המבקש לבית המשפט המחוזי תל-אביב-יפו (ע"פ 7040/09). במהלך הערעור חזר בו המבקש מערעורו כנגד הרשעתו והתמקד בערעור כנגד גזר הדין.
בית המשפט
המחוזי (כבוד סגן הנשיא ז' המר והשופטים ע' פוגלמן ו- ת' שפירא ) דחה את הערעור בקובעו כי אין מקום להתערב בעונש שנגזר על המבקש או בהחלטה שלא להימנע מהרשעתו.
מכאן בקשת רשות הערעור שבפניי, אשר במסגרתה שב המבקש וטוען כי שגה בית המשפט משהרשיעו, לנוכח ההשלכה הקשה שתהיה להרשעה על עתידו המקצועי. לטענת המבקש, בית המשפט החמיר בעונשו בעקבות החלטתו שלא להעיד ולשמור על זכות השתיקה במשטרה, בניגוד להלכה בעניין.
המבקש אף מבקש להוסיף ראיות הנוגעות להשלכותיה של ההרשעה עליו, אולם בנסיבות העניין אין מקום להיענות לבקשה זו.
מנגד טוענת המשיבה כי הבקשה אינה עומדת בקריטריונים הדרושים למתן רשות ערעור, שכן אינה חורגת מעניינו הפרטי של המבקש, וכי גם לגופו של עניין ההחלטה להרשיע את המבקש הייתה מוצדקת.
לאחר שעיינתי בבקשה על נספחיה, בתגובה לה ובהחלטותיהן של הערכאות שקדמו לי, שוכנעתי כי דין הבקשה להידחות.
עניינו של המבקש כבר נדון בפני שתי ערכאות. כידוע, הכלל הנוהג הינו, כי הרשות לערעור שני, אינה ניתנת כדבר שבשגרה, אלא מוגבלת למקרים המעוררים שאלה בעלת חשיבות משפטית או ציבורית, החורגת מעניינם הפרטני של הצדדים, בהתאם להלכת בר"ע 103/82 חניון חיפה בע"מ נ' מצת אור (הדר חיפה) בע"מ , פ"ד לו(3) 123 (1982). בענייננו, חרף טענות המבקש, אין בבקשתו כל עילה שתצדיק מתן רשות ערעור. יצוין בעניין זה כי טענתו של המבקש לפיה החמיר עמו בית המשפט לנוכח החלטתו שלא להעיד ולשמור על זכות השתיקה חסרת כל שחר, משברי מקריאת גזר הדין שאין מדובר בשיקול שנשקל בעת גזירת העונש, כאשר השיקול העיקרי היה דווקא ראיה אותה הציג המבקש, לפיה אף בהמשך דרכו המקצועית עלו שאלות בדבר מהימנותו ויושרו המקצועי.
יתרה מכן, הלכה היא כי טענות הנוגעות לחומרת העונש כשלעצמה – ובהן גם טענה שהיה על בית המשפט להימנע מהרשעה, אינן מקימות עילה למתן רשות ערעור בפני בית משפט זה, אלא בנסיבות של סטייה ניכרת ממדיניות הענישה (ראו רע"פ 5504/08
פלוני נ' מדינת ישראל (לא פורסם, 27.7.2008). בנסיבות המקרה, לא מצאתי כל סטייה שכזו מנורמת הענישה המקובלת בעבירה אותה ביצע המבקש, אף לאור נסיבותיו האישיות. מסיבות אלו בלבד, דין הבקשה להידחות.
מעבר לדרוש יוער, כי גם לגופו של עניין דין הבקשה להדחות. כידוע, משנקבעה אחריותו של אדם בפלילים, יש להרשיעו. חריג שבחריגים לכלל זה מותיר בידי בית המשפט סמכות להימנע מהרשעה, במקרים יוצאי דופן (ראו רע"פ 1189/06 בר-לב נ' מדינת ישראל (לא פורסם, 12.9.2006)). אמנם ייתכן ולהרשעתו בפלילים תהיה השפעה קשה על עתידו של המבקש, אולם על אפשרות זו היה לעמוד לנגד עיניו בשעה שבחר לבצע את העבירה בה הורשע, ולא מצאתי כי יש בנסיבותיו האישיות כדי להצדיק הימנעות מהרשעתו.
אשר על כן, הבקשה למתן רשות ערעור נדחית.
