החלטה
המבקש הועמד לדין בבית משפט השלום בתל-אביב-יפו (פ 1281/04) בגין שבע עבירות ניהול מקומות לשם עריכת משחקים אסורים, לפי סעיף 228 לחוק העונשין, התשל"ז-1977 (להלן: חוק העונשין ).
על פי המתואר בכתב האישום, בין השנים 2002 ו-2003 החזיק המבקש מקומות לשם עריכת משחקים אסורים. בתאריכים 4.7.2002, 30.9.2002 ו-27.2.2003 החזיק המבקש מקום לשם ניהול משחקים אסורים ברחוב ככר רבין 4 בתל אביב, שם ניהל משחקים אסורים באמצעות מכונות מזל אלקטרוניות. בתקופה מקבילה, בתאריכים 2.1.2003, 15.1.2003 ו-10.4.2003 החזיק המבקש מקום ברחוב העבודה 27 בבת ים וניהל שם משחקים אסורים באמצעות מכונות מזל אלקטרוניות ולעיתים אף באמצעות מסכי מחשב עם כונן. בתאריך 14.10.2002 החזיק המבקש מקום ברחוב דיזנגוף 101 בתל אביב וניהל שם משחקים אסורים באמצעות שולחן רולטה.
ביום 23.3.2005 הרשיע בית משפט השלום (כבוד השופטת ד' שריזלי ) את המבקש בעבירות אשר יוחסו לו בכתב האישום וזאת על בסיס הודאתו. ביום 7.4.2005, לאחר שמיעת הטענות לעניין העונש מפי הצדדים, גזר בית המשפט על המבקש קנס בסך 20,000 ש"ח או 3 חודשי מאסר תמורתו, וכן 10 חודשי מאסר על תנאי למשך 3 שנים והתנאי הוא שלא יעבור עבירה לפי סעיפים 225 ו-228 לחוק העונשין.
על גזר דינו של בית משפט השלום ערערה המשיבה לבית המשפט המחוזי בתל-אביב-יפו (ע"פ 71027/05). הערעור הופנה כנגד קלות העונש אשר הושת על המבקש.
בית המשפט המחוזי (כבוד השופטים א' שהם , י' שיצר ו י' שבח ) קיבל את ערעור המשיבה בהתחשב בחומרת העבירות שיוחסו למבקש והשפעתן על אוכלוסיית המהמרים ומשפחותיהם ועידודן להתמכרות, בנוסף לנזק החברתי והערכי הכבדים. בנוסף לכך, התחשב בית המשפט בעובדה שהמבקש ביצע 7 עבירות, זלזל בחוק והתעלם מצווי הסגירה השונים שהוצאו ביחס למקומות אשר ניהל. על אף העובדה שקיבל את ערעור המשיבה, בחר בית המשפט שלא למצות את הדין עם המבקש וגזר עליו 6 חודשי מאסר בפועל, אשר יכול וירוצו בדרך של עבודות שירות; בנוסף להחמרה ברכיב הקנס אשר הוטל על המבקש כך שיעמוד על 40,000 ש"ח או 5 חודשי מאסר תמורתו. רכיב המאסר על תנאי נותר על כנו.
מכאן בקשת רשות הערעור שבפניי, בגדרה טוען המבקש, כי שגה בית המשפט המחוזי משהחמיר את העונש שהוטל עליו. לטענת המבקש, מ דובר
במקרה חריג, בו נגזר על המבקש עונש של מאסר בפועל רק בערכאה השנייה, בגזר דין הסוטה מרמת הענישה שהייתה מקובלת בנסיבות דומות בתקופת ביצוע העבירה ועל כן יש לאפשר לו לערער על עונש זה בפני ערכאה נוספת. עוד טוען המבקש כי שגה בית המשפט המחוזי בקובעו כי היתה לו הרשעה קודמת בגין אותה עבירה וזאת מהסיבה שההרשעה ניתנה על סמך עבירה שבוצעה באותה שנה של העבירות בהן הוא מורשע בעניין זה ועל כן אין לראות בה כ"הרשעה קודמת". לבסוף, טוען המבקש שבית המשפט לא התחשב בנסיבותיו האישיות במידה מספקת.
מנגד טוענת המשיבה כי דין הבקשה להידחות הן מהטעם שבנסיבות המקרה לא הייתה סטייה ניכרת ממדיניות הענישה שמצדיקה מתן רשות ערעור, אף אם מדובר במדיניות הענישה שהייתה נהוגה בזמן ביצוע העבירה, והן מהטעם כי לגופו של עניין לא נגרם למבקש עיוות דין ואין מקום להתערבות בעונש אשר הוטל עליו נוכח חומרת העבירות בהן הורשע.
דין בקשת רשות הערעור להידחות.
עניינו של המבקש כבר נדון בפני שתי ערכאות שונות. ככלל, הלכה היא, כי רשות ערעור לדיון בגלגול שלישי, ניתנת במשורה באותם מקרים חריגים אשר מעוררים שאלה בעלת חשיבות כללית וציבורית החורגת מעניינם הפרטי של בעלי הדין. במקרה שבפניי, חרף טענות המבקש, הבקשה אינה מעוררת כל שאלה משפטית עקרונית, אשר תצדיק דיון בגלגול שלישי (ראו ר"ע 103/82 חניון חיפה בע"מ נ' מצת אור (הדר חיפה) בע"מ , פ"ד לו (3) 123 (1982)).
יתרה מכך, הלכה היא, כי טענות בנוגע לחומרת העונש כשלעצמה, אינן מקימות עילה למתן רשות ערעור בפני בית משפט זה, אלא בנסיבות של סטייה ניכרת ממדיניות הענישה (ראו רע"פ 1174/97 רפאלי נ' מדינת ישראל
(לא פורסם, 24.3.1997); רע"פ 7201/97 בשירי נ' היועץ המשפטי לממשלה
(לא פורסם, 11.12.1997)). בנסיבות המקרה, לא מצאתי כל סטייה שכזו מנורמת הענישה המקובלת בעבירה אותה ביצע המבקש. מסיבות אלו בלבד, דין הבקשה להידחות.
מעבר לדרוש יוער, כי אף לגופו של עניין, דין הבקשה להדחות. המבקש הורשע, על פי הודאתו, בשבע עבירות של ניהול מקומות לשם עריכת משחקים אסורים. חרף צווי הסגירה השונים שהוצאו ביחס למקומות אלה, בחר המבקש להמשיך בביצוע העבירות. זאת ועוד, עצם העובדה שהוא הורשע בעבירה דומה בעניין אחר יש בה כדי להעיד על אופיו, ולכך יש לתת משקל. די בשיקולים אלה בכדי לדחות את הבקשה.
כך גם בנוגע לטענות בגין הפגמים במדיניות הענישה. הטענות אותן מעלה המבקש בבקשתו נשקלו על ידי בית המשפט המחוזי והעונש שהוטל עליו הינו עונש הולם המתחשב במכלול השיקולים הרלוונטיים למקרה דנן. עיון בפסק דינו של בית המשפט המחוזי מלמד שזה נימק את מסקנותיו כדבעי, ועל כן אין מקום להתערב בהן.
אשר על כן, הבקשה למתן רשות ערעור נדחית.
החלטתי מיום 7.1.2008 בעניין עיכוב ביצוע עונש המאסר בעבודות שירות מבוטלת.
על המבקש להתייצב ביום 1.5.2008, לא יאוחר מהשעה 9:00, בפני הממונה על עבודות שירות מחוז מרכז, יחידת עבודות שירות, לשם תחילת ריצוי עונשו.
