נגד המבקש הוגש כתב אישום מתוקן המייחס לו עבירה של החזקת סמים מסוכנים לצריכה עצמית לפי סעיף 7(א) ו-7(ג) לפקודת הסמים המסוכנים (נוסח חדש) התשל"ג-1973. לפי המתואר בכתב האישום המתוקן, ביום 20.5.2010 נהג המבקש ברכבו כאשר הוא מחזיק בסם מסוכן מסוג הירואין, במשקל נטו של 0.6623 גרם , ללא היתר מטעם הרשויות המתאימות. ביום 19.4.2012 הרשיע בית משפט השלום בתל אביב-יפו את המבקש בעבירות שיוחסו לו וזאת על סמך הודאתו (ת"פ 39005-01-11, כבוד השופט א' דורון) , והטיל עליו עונש של שלושה חודשי מאסר על תנאי לתקופה של שלוש שנים; קנס בסך 700 ש"ח וכן פסילה מהחזקת רישיון נהיגה לתקופה של חודשיים. בגזר דינו, התייחס בית המשפט לתסקיר שירות המבחן לפיו המבקש החל בשימוש בתחליף סם ואף הפסיק את השימוש בו לאחר תקופה ארוכה של טיפול. כן התייחס בית המשפט לתסקיר נוסף של שירות המבחן לפיו המבקש מסרב לשתף פעולה עימם. עוד התייחס בית המשפט לעובדה כי למבקש אין עבר פלילי.
על פסק דינו של בית משפט השלום ערער המבקש לבית המשפט המחוזי. בית המשפט המחוזי קבע כי אין מקום להתערב בפסק דינו של בית משפט השלום. בית המשפט קבע כי למעט טענה הנוגעת לכשל ביצוג, שלפיה עורך הדין שיצג את המבקש בבית משפט השלום לא היטיב להסביר בפניו את משמעות ההרשעה, לא נשמעה ולו טענה אחת מדוע יש לסיים את ההליך ללא הרשעה ולא הוצגו נסיבות חריגות. בית המשפט המחוזי קבע כי המבקש דחה את ניסיונות העזרה שהושטו לו ואף הודיע כי הוא מבקש לסיים את הקשר עם שירות המבחן. כן קבע בית המשפט כי לא ייגרם למבקש כל נזק קונקרטי שאינו נזק הנגרם לכל אדם המורשע בפלילים. בשל הסכמת המשיבה לביטול הרכיב העונשי של פסילת רישיון הנהיגה, בוטל רכיב זה בגזר הדין.
מכאן הבקשה שלפניי, שבמסגרתה טוען המבקש כי יש להיענות לבקשתו למתן רשות ערעור משיקולי צדק. המבקש מבקש כי תבוטל הרשעתו ולחלופין כי יופחת עונשו. לטענתו, נסיבותיו האישיות הן חריגות ומצדיקות התערבות בהחלטה להרשיעו. זאת, שכן הוא חולה במחלה גנטית הגורמת להפרעות בתנועה, קושי בדיבור וכאבים, והוא מוכר כנכה בשיעור של 100%. כן הוא טוען כי יש להתחשב בעובדה שהוא אינו בעל עבר פלילי והתנהגותו נבעה מהתנהגות מקרית. לטענתו, הוא עבר תהליך גמילה וכיום הוא אינו משתמש בסמים. המבקש טוען כי הרשעה תהיה הרסנית עבורו בשל כך שהיא תפגע בדימויו העצמי ואף תגרום לפיטוריו. כן הוא טוען כי הרשעה עלולה לפגוע בסיכויי החלמתו. לבסוף טוען המבקש כי העבירה שהורשע בה נמצאת ברף הנמוך מבחינת חומרתה.
לאחר שעיינתי בבקשת רשות הערעור, בנספחיה ובפסקי הדין של הערכאות שקדמו לי, נחה דעתי כי דין הבקשה להידחות, זאת מבלי להידרש לתגובת המשיבה.
הלכה היא, כי אין מעניקים רשות לערעור שני, אלא אם כן עולה מבין טענות הצדדים טענה בעלת חשיבות כללית, בין משפטית ובין ציבורית, החורגת מעניינם הפרטי (ראו ר"ע 103/82 חניון חיפה בע"מ נ' מצת אור (הדר חיפה) בע"מ , פ"ד לו(3) 123 (1982) (להלן: חניון חיפה )). בענייננו, המבקש לא הצביע על עילה המצדיקה דיון "בגלגול שלישי", בהתאם להלכת חניון חיפה . אכן, לעיתים, במקרים חריגים, אף אם נראה כי בקשה לא מעוררת שאלה עקרונית החורגת מעניינו הפרטני של מבקש, תינתן רשות ערעור מחמת שיקולי צדק. כך, כתבתי בעניין זה ברע"פ 2777/11 פלונית נ' מדינת ישראל (טרם פורסם, 16.10.2012):
"חשוב להדגיש כי 'אין בסמכותו הטבועה של בית משפט זה להעניק רשות ערעור שעה ששיקולי צדק מצדיקים זאת כדי לגרוע מעוצמתה של ההלכה הידועה שנקבעה בעניין חניון חיפה' ... הגעתי למסקנתי זו [להעניק רשות ערעור מטעמי צדק] לאחר לבטים ונוכח הצטברותם של מספר גורמים הייחודיים למקרה זה ובראשם מצבה הבריאותי הקשה של המבקשת".
איני סובר כי מקרה זה נמנה עם אותם מקרים קיצוניים שבהם תינתן רשות ערעור מטעמי צדק. על אף מצבו הרפואי של המבקש כפי שמתואר בבקשתו, הוא לא הצביע על נזק קונקרטי קשה שייגרם לו בעקבות הרשעתו והסתפק בציון אפשרויות ערטילאיות. אלא, שלא ניתן לבטל הרשעה, ללא הוכחת נסיבות קונקרטיות המצדיקות זאת. טענתו של המבקש בדבר הנזק התדמיתי שעלול להיגרם לו בעקבות הרשעתו אינה ייחודית עבורו ולא הוכח כי היא תגרום לו נזק חמור יותר מאשר זה הנגרם לכל מורשע בהליך הפלילי.
אף טענותיו של המבקש בכל הנוגע לעונש שהוטל עליו, דינן להידחות. הלכה היא כי טענות הנוגעות לחומרת העונש כשלעצמה, אינן מקימות עילה למתן רשות ערעור בפני בית משפט זה, אלא בנסיבות של סטייה ניכרת ממדיניות הענישה (ראו: רע"פ 5504/08 פלוני נ' מדינת ישראל
(לא פורסם, 27.7.2008). העונש שהוטל על המבקש אינו סוטה ממדיניות הענישה ואף מטעם זה דין בקשתו להידחות. אף לגופו של עניין לא מצאתי מקום להתערב בעונש שהוטל עליו. המבקש נתפס מחזיק בסם מסוכן בעת שהוא נוהג ברכב. האינטרס הציבורי החברתי שבמיגור שימוש בסמים מסוכנים הוא חיוני ויש לתת לו משקל ניכר. לפיכך, העונש שהוטל על המבקש הוא עונש ראוי בנסיבות העניין.
אשר על כן, דין הבקשה להידחות.
