בקשה למתן רשות ערעור על פסק דינו של בית המשפט המחוזי מרכז-לוד (השופטים א' טל – סג"נ, א' מקובר , ז' בוסתן ) בע"פ 7912-03-13 מיום 17.11.2013 , במסגרתו נדחה ערעור על הכרעת דינו של בית משפט השלום בנתניה (השופטת ח' שניצר-זאגא ) בת"פ 22871-01-12 מיום 17.2.2013.
רקע והליכים

נגד המבקש הוגש לבית משפט השלום בנתניה כתב אישום בו הואשם בשלוש עבירות איומים לפי סעיף 192 לחוק העונשין, התשל"ז-1977 (להלן: חוק העונשין ) ; וכן בעבירת תקיפה הגורמת חבלה ממש, לפי סעיף 380 לחוק העונשין; היזק לרכוש במזיד, לפי סעיף 452 לחוק העונשין; וחבלה במזיד ברכב, לפי סעיף 413ה לחוק העונשין. על פי עובדות כתב האישום, המבקש שהה בביתם של המתלוננים (אם ובנה, להלן בהתאמה: המתלוננת ו- המתלונן או המתלוננים ) מגיל צעיר במסגרת של אומנה. בהמשך, בין הצדדים התגלע סכסוך שעיקרו דרישת המתלוננים מהמבקש לעזוב את ביתם לאחר שחרורו משירותו הצבאי. באירוע שמופיע באישום הראשון, נטען שביום 2.1.2012 המבקש תקף את המתלונן, בעט בו, הכה אותו באגרופו, הפילו ארצה, המשיך לבעוט בו כשהוא שכוב, ולאחר מכן בעט במכוניתו. כתוצאה ממעשים אלה המתלונן ורכבו נפגעו. באירועים בכתב האישום השני והשלישי נטען שבדצמבר 2011 ובינואר 2012 המבקש איים על המתלוננת והמתלונן בתנועת שיסוף גרון מול פניהם.

ביום 17.2.2013 הרשיע בית משפט השלום את המבקש, לאחר ניהול הוכחות, בעבירות שיוחסו לו בכתב האישום. המבקש טען כי אין לו קשר למעשים, וכי המתלוננים "רקמו יחד מזימה על מנת להעליל עליו עלילות שווא על רקע תלונה שהוגשה על ידו בעבר" (פסקה 17 להכרעת הדין). עוד טען המבקש כי המשטרה לא ביצעה פעולות חקירה חיוניות אשר היו מוכיחות את חפותו, לרבות איכונים לטלפון הנייד שלו כדי להוכיח את טענתו שלא היה במקום שנטען שהיה בו באישומים השני והשלישי, חקירת עדים שיכלו לגבות את גרסתו לאירועים ובדיקת מצלמות שלטענתו צילמו את האירוע במוקד האישום הראשון. בית משפט השלום דן בטענות אלה בהרחבה, כמו גם בעדויות מטעם התביעה, והעדיף את גרסת המתלוננים אותה מצא "רהוטה, אמינה ומדויקת" (פסקה 16 להכרעת הדין), שגובתה בעדויות וראיות נוספות, על פני גרסתו של המבקש (פסקה 18 להכרעת הדין).

ביום 19.2.2013 ניתן גזר דינו של המבקש. בית המשפט דן בחומרת העבירות, התייחס לענישה הנוהגת, וקבע את מתחם הענישה ההולם בנסיבות של כל אחת מהעבירות. באשר לעבירות האלימות למעט עבירת האיומים קבע מתחם הנע בין עונש מאסר על תנאי ל-12 חודשי מאסר בפועל, ועד שמונה חודשי מאסר בפועל בעבירת איומים והיזק לרכוש. כמו כן, דן גם בנסיבות האישיות הקשות של המבקש והצלחותיו בחייו נוכח אלו, וציין כי המבקש ניתק קשרים עם המתלוננים כשיקול משמעותי לקולא. נוכח "אופק של שיקום" שמצא בעניינו של המבקש, בית המשפט חרג לקולה מהמתחם שנקבע לכל העבירות, וגזר עונש משותף לכל העבירות, שמונה חודשי מאסר על תנאי, שלא יעבור עבירות אלימות למעט איומים וכן עבירות בקשר לרכב במשך שלוש שנים, ארבעה חודשי מאסר על תנאי, שלא יעבור עבירות איומים והיזק בזדון במשך שלוש שנים, קנס בסך 1,000 ש"ח, פיצוי למתלוננים בסך 1,000 ש"ח, והתחייבות על סך 5,000 ש"ח להימנע מלעבור במשך שנתיים כל עבירה בה הורשע.

המבקש ערער על הכרעת הדין בעניינו לבית המשפט המחוזי מרכז-לוד. המבקש טען כי מחדלי חקירה של המשטרה פגעו בהגנתו, ולכן, בהסתמך על ע"פ 5019/09 חליווה נ' מדינת ישראל (20.8.2013) (להלן: עניין חליווה ) ביקש את זיכויו. ביום 17.11 .2013 דחה בית המשפט המחוזי את ערעורו וקבע כי ניתנו לו הזדמנויות בבית משפט השלום להביא עדים מטעמו, ונשמעה עדותו. כמו כן בית המשפט המחוזי קבע, כי לצד עדותו של המתלונן היו גם ראיות נוספות, שאת כולן מצא בית משפט השלום מהימנות, לעומת גרסת המבקש אשר לה "לא ייחס אמון" וקבע שהיא "לא מתיישבת עם הראיות, ההיגיון והשכל הישר" (פסקה 9 לפסק הדין של בית המשפט המחוזי).
הבקשה ותגובת המשיבה

במסגרת הבקשה, המבקש חוזר בפירוט רב על טענותיו מהערכאות הקודמות, ותמציתן שמחדלי חקירה שונים של המשטרה פגעו בהגנתו, ועל פי הפסיקה, יש לזכותו בשל כך.

בתגובתה, המשיבה טענה שיש לדחות על הסף את הבקשה מפני שאינה מעוררת כל סוגיה עקרונית שחורגת מעניינו הפרטני של המבקש. עוד הוסיפה, כי סוגיית מחדלי החקירה נדונה בבית משפט זה וקיימת בה הלכה ברורה, לפיה אין במחדלי חקירה בפני עצמם כדי להביא לזיכוי, ומשמעותם של המחדלים נקבעת על פי מידת הפגיעה ביכולתו של הנאשם להתגונן, ועל פי השאלה האם הם מעוררים ספק סביר באשמה. לעניינו הפרטני של המבקש, טענה המשיבה, כי טענותיו נדונו בערכאות הקודמות, ונדחו באופן מפורט, ואין כל מקום להתערבות בהכרעותיהן.
הכרעה

אין בידי להיעתר לבקשה לרשות ערעור. הלכה היא, כי אין מעניקים רשות לערעור שני, אלא אם כן המקרה מעלה סוגיה טענה בעלת חשיבות כללית, משפטית או ציבורית, החורגת מעניינם הפרטני (ר"ע 103/82 חניון חיפה בע"מ נ' מצת אור (הדר חיפה) בע"מ , פ"ד לו(3) 123 (1982)), או אם ישנם שיקולי צדק ייחודיים בנסיבות המקרה (רע"פ 5066/09 אוחיון נ' מדינת ישראל (22.4.2010)).

סוגיית מחדלי חקירה והשפעתם על נאשמים נדונה פעמים רבות בפסיקת בית משפט זה. סיכומה של ההלכה לסוגיה זו הוא כי:
"אין לומר כי מחדלי חקירה בהכרח יובילו לזיכויו של הנאשם. כך, למשל, לא כל הימנעות מחקירה לה טוענת הסניגוריה הינה 'מחדל חקירה' ולא כל מחדל חקירה גורם בהכרח ל'נזק ראייתי'. לא כל נזק ראייתי ולא כל מחדל בחקירה מובילים לזיכוי. נפקותו של המחדל תלויה בנסיבות המקרה הקונקרטי, ובפרט בשאלה, האם עסקינן במחדל כה חמור, עד כי יש חשש שמא קופחה הגנתו של המערער בענייננו באופן שיתקשה להתמודד עם חומר הראיות המפליל אותו או להוכיח את גרסתו שלו. על פי אמת מידה זו, על בית המשפט להכריע מה משקל יש לתת למחדל, לא רק כשהוא עומד לעצמו, אלא גם בראיית מכלול הראיות" (ע"פ 8529/11 אטקישייב נ' מדינת ישראל , פסקה 8 לפסק דינו של השופט נ' הנדל

בעניין חליווה עליו משליך המבקש את יהבו, נדונו נסיבות ייחודיות בהן נקבע כי יש לזכות את המערער שם מחלק מהאישומים נגדו בשל מחדלי חקירה. השופט ח' מלצר הבהיר שם כי אין בנסיבות אלו כדי לשנות מההלכה בסוגיה:
" הלכה מושרשת זו מקובלת בכללותה אף עלי . יחד עם זאת, אני סבור כי בנסיבות הייחודיות, אשר מאפיינות את מחדלי החקירה שהתרחשו בעניינו של המערער – יש מקום לקבוע כי מדובר במחדלים, אשר קיפחו את הגנתו של הנאשם, ופגעו באופן משמעותי בזכותו החוקתית להליך הוגן עד כדי כך שיש לקבוע כי נוכח אותם מחדלים – יש לזכות את המערער מעבירות האלימות המיוחסות לו באישום הראשון." אם כן, טענתו של המבקש אינה מעלה סוגיה עקרונית אשר טרם נידונה בבית משפט זה. יתר על כן, טענותיו הפרטניות נידונו בשתי הערכאות, ובבית משפט השלום בהרחבה רבה. לעניין זה יפה ההלכה המושרשת כי ערכאת הערעור לא תתערב ללא סיבה כבדת משקל בממצאים העובדתיים שנקבעו על ידי הערכאה הדיונית (ראו: ע"פ 2932/00 אלמקייס נ' מדינת ישראל , פ"ד נה(3) 102 (2001)). הלכה זו מקבלת משנה תוקף שעה שמדובר בגלגולו השלישי של ההליך, והמבקש לא הביא סיבה שהולמת התערבות כזו.
12.
סוף דבר, הבקשה נדחית.
