החלטה

המבקש הורשע, על פי הודאתו, בעובדותיו של כתב אישום מתוקן בו יוחסה לו עבירה של החזקת סם מסוכן שלא לצריכה עצמית, לפי סעיף 7(א)(ג) רישא לפקודת הסמים המסוכנים (נוסח חדש), תשל"ג-1973. מכתב האישום שבעובדותיו הודה עולה, כי ביום 21.9.2005 סמוך לשעה 02:00 לפנות בוקר, נמצא המבקש מחזיק ברשותו –
מתחת למושב הנהג של הרכב בו נהג – אריזת פלסטיק ובתוכה סם מסוג הרואין במשקל נטו של 4.4427 גרם . משהבחין המבקש בשוטרים שדלקו אחריו, הוא זרק מחלון הרכב אריזת פלסטיק, בתוכה היה סם מסוג קוקאין במשקל נטו של 1.0034 גרם . בעקבות הרשעתו נדון המבקש למאסר על תנאי בן 12 חודשים, קנס בסך 3,000 וכן פסילה על תנאי של רישיון הנהיגה שלו.

ערעור שהגישה המדינה כנגד גזר דינו של המבקש – התקבל. בית המשפט המחוזי (סגן הנשיא י' גריל והשופטים א' קיסרי ו מ'
רניאל ) עמד על עברו הפלילי העשיר של המבקש – הכולל, בין היתר, הרשעה בעבירה של החזקת סמים מסוכנים לצריכה עצמית – וציין, כי העבירה נושא ההליך שלפנינו בוצעה חודש בלבד לאחר שחרורו של המבקש ממאסר בו נשא בגין הרשעה קודמת. עוד צוין, כי המבקש נמנע מלהגיע לשיחות ולבדיקות שתן אליהן זומן על ידי שירות המבחן, ולמעשה ביצע בדיקת שתן אחת בלבד. בית המשפט הוסיף וציין, כי אין להתעלם מן העובדה שהסמים שנמצאו בחזקת המבקש לא יועדו לצריכה עצמית בלבד. בצד האמור, שקל בית המשפט את טיעוניו של המבקש בדבר השתלבותו בעבודה מסודרת ומסלול השיקום בו הוא נתון. לאחר ששקלל נתונים אלה החליט בית המשפט המחוזי להחמיר בעונשו של המבקש, ולהעמידו על שבעה חודשי מאסר לריצוי בפועל. לשלמות התמונה יצוין, כי פסק דינו של בית המשפט המחוזי ניתן מבלי שהוגש בעניינו של המבקש תסקיר מעודכן של שירות המבחן. זאת, לאחר שבקשה שהוגשה מטעם המבקש בעניין זה נדחתה בנימוק לפיו בעניינו של המבקש הוגשו תסקירים הפורשים תמונה מלאה אודותיו, ומתן הוראה להכנת תסקיר משלים תגרור דחייה נוספת בשמיעת הערעור (פסקה י"ג לפסק דינו של בית המשפט המחוזי). סנגורו של המבקש חזר על בקשתו בעניין זה במהלך הדיון, אולם בקשה זו נדחתה אף היא (פסקה י"ד לפסק דינו של בית המשפט המחוזי).

מכאן הבקשה שלפני בגדרה נטען, כי מאז ניתן גזר הדין נפצע המבקש באורח קשה בתאונת דרכים ומצבו הרפואי מחייב הימנעות מהטלת עונש מאסר בפועל. כן נטען, כי קיים פער חריג בין העונש שהושת על המבקש בבית משפט שלום לזה שהושת עליו בבית המשפט המחוזי. לבסוף נטען, כי בית המשפט המחוזי שגה עת שדחה את עתירתו של המבקש לקבל תסקיר מבחן עדכני.

דין הבקשה להידחות. עיקר טענותיו של המבקש נסבו על חומרת העונש שנגזר לו בידי בית המשפט המחוזי, וכידוע ההלכה הנוהגת היא שחומרת העונש לבדה אינה מקימה, כשלעצמה, עילה לקיומו של ערעור בפני בית משפט זה (רע"פ 8718/08 דגני נ' מדינת ישראל (לא פורסם, 26.10.2008); רע"פ 4905/08 פלוני נ' מדינת ישראל (לא פורסם, 9.9.2008); רע"פ 5482/08 חמדיה נ' מדינת ישראל (לא פורסם, 30.6.2008)). אכן, להלכה זו נקבעו חריגים, אולם לא מצאתי כי עניינו של המבקש נמנה עליהם. גם טענת המבקש באשר לאי-הגשת תסקיר משלים בעניינו אינה מצדיקה רשות ערעור. כעולה מפסק דינו של בית המשפט המחוזי, בעניינו של המבקש הוגש תסקיר מבחן שבעקבותיו הוגשו תסקירים משלימים, ומאלה עולה כי המבקש נמנע, באופן עקבי, מלהתייצב לבדיקות ופגישות שנקבעו לו, וגם הניסיונות ליצור עמו קשר טלפוני העלו חרס. בנסיבות אלה, איני סבור כי בהחלטתו של בית המשפט המחוזי שלא להורות על הגשת תסקיר נוסף נפל פגם.
סיכומו של דבר, הבקשה נדחית, וממילא נדחית הבקשה לעיכוב ביצוע העונש.
