השופטת א' פרוקצ'יה:

עניינה של העתירה בבקשה לצו מסוג הביאס קורפוס, שעיקרה בבקשת העותרים כי המשיבים יודיעו למשפחת העותר 1 (להלן – העותר) היכן הוא מוחזק, לאחר שנעצר על ידי כוחות הבטחון ביום 4.2.08.

כפי שעולה מן העתירה, ביום 5.2.08, למחרת מעצרו של העותר, פנה עותר 2, המוקד להגנת הפרט (להלן – המוקד), למרכז השליטה של צה"ל כדי לברר את מקום הימצאו של העותר. ממרכז השליטה נמסר למוקד כי העותר הוחזק במיתקן מעצר זמני בעציון, ומשם הועבר לבית הכלא שיקמה. מאוחר יותר נמסר כי העותר הועבר לבית כלא אוהלי קידר. אולם התברר, כי העותר לא היה רשום במסוף שב"ס, ולכן כשפנה המוקד לבתי הכלא האמורים נמסר לו כי העותר אינו מוחזק באף אחד מהם.

במסגרת תגובתם לעתירה, מסרו המשיבים לבית המשפט ביום 7.2.08 כי העותר הוחזק בכלא שיקמה, ולשם הועבר מבית הסוהר אוהלי קידר. כן ציינו המשיבים כי ב-5.2.08 הובא העותר בפני בית המשפט המחוזי בבאר שבע במסגרת צו הבאה, ויוצג שם על ידי הסניגוריה הציבורית.

ביום 18.2.08, בעקבות דיון בעתירה, בקשנו מהמשיבים להגיש לנו הודעת עדכון בה יפורטו הטעמים לכך שמאז 4.2.08 ועד למתן תגובת המדינה לעתירה ביום 7.2.08 לא הצליח המוקד ובני משפחת העותר לקבל מידע מלא על מקום המצאו של העצור, ומה פשר התקלות שהביאו לכך. כן בקשנו התייחסות לשאלה אלו לקחים הופקו מארועים אלה כדי למנוע תקלות דומות בעתיד.

מהודעתם המשלימה של המשיבים מיום 10.3.08 עולה כי מ דובר
בתקלת אנוש שבגללה לא נקלטו במערכת הממוחשבת של שב"ס הנתונים בדבר מקום החזקתו של העותר במתקני השב"ס, ולכן גם לא דווח מקום המצאו המדויק לנציגי המוקד. מידע מדויק בענין זה נמסר, כאמור, רק כ-72 שעות לאחר המעצר, בתגובת המדינה מיום 7.2.08.

אשר להפקת לקחים, מציינים המשיבים כי על רקע תהליך העברת כלל מתקני הכליאה בישראל לאחריות שב"ס, גדל מאד מספר העצורים והאסירים המוחזקים באחריות שב"ס. לאור זאת, עלה הצורך בעריכת שנויים ברמה הניהולית והאופרטיבית ובכלל זה, הצורך לשפר ולתגבר את מערך הרישום של המוחזקים בבתי כלא. במסגרת השינויים האמורים, יפורסם תיקון לפקודת נציבות שירות בתי הסוהר עד ליום 1.5.08 (ראו גם בג"צ 8696/07 שנדון בבית משפט זה). ביום 5.3.08 התקיימה ישיבה במשרד המשפטים בהשתתפות כל הגורמים המעורבים, אשר נועדה לגבש ולסכם את עבודת המטה בכל הנוגע לתיקון הפקודה כדי למנוע, במידת האפשר, את הישנותן של תקלות אנוש דומות.

התרשמנו כי המדינה ערה באופן מלא לצורך לפתור את בעיית הרישום והמעקב אחר מקום החזקתם של עצורים במסגרת שב"ס, כדי למנוע מציאות שבה, בנקודת זמן כלשהי, לא ניתן לתת לבני משפחה מידע בדבר מקום הימצא קרובם.
במקרה זה, עקב שינויים מערכתיים מאסיביים במערכת שב"ס, ארעה תקלת אנוש, שמצאה את פתרונה תוך זמן קצר באופן יחסי. המדינה נערכת עתה בצורה כוללת לפתרון המערכת הרישומית בשב"ס, ויש לקוות, כי בכך תקלות מסוג זו שארעה כאן לא תישנינה.

בנסיבות המתוארות, נראה לנו כי תכלית העתירה נתמצתה, ולפיכך העתירה נמחקת.
