בקשה לעיון בתיק
החלטה
לפניי בקשה לעיון בתיק בית-המשפט שבכותרת. הבקשה נועדה להתיר למבקש – עורך-דין במקצועו – לעיין בתצהירה של הגב' גלילי אשר הוגש בשעתו מטעם העותרות. בבקשה צוין כי המבקש הינו עורך-דין שמשרדו מנהל תביעה משפטית כנגד הגב' גלילי, וכי העיון בתצהיר מתבקש לצורך ניהול אותה התביעה (בלא שנמסרו פרטים אודות מהות התביעה וטיב זיקתה לתצהיר הנדון). העותרות מתנגדות לעיון המבוקש.
לאחר שעיינתי בטענות הצדדים וכן בתצהיר נשוא בקשת העיון, באתי למסקנה כי דין הבקשה להידחות. אמת, נקודת המוצא הינה כי לכל אדם נתונה זכות לעיין בתיקי בית-משפט, נוכח עקרון פומביות הדיון וזכות הציבור לדעת. עם זאת, אין המדובר בזכות בלתי מוגבלת, ויש שעליה לסגת מפני זכויות ואינטרסים נוגדים. בתצהיר נשוא בקשת העיון מובאים פרטיים אישיים אודות מצבה הבריאותי והמשפחתי של הגב' גלילי, וכן פרטים אודות מצבה הכלכלי והתעסוקתי. יובהר כי הגב' גלילי לא היתה בעלת - דין ישירה להליך שבכותרת, אלא תצהירהּ הוגש בשעתו על-ידי העותרות על-מנת לתמוך בטענותיהן בנוגע למצבן של אמהות חד-הוריות. לאחר עיון בפרטים האישיים המפורטים בתצהיר, אני סבורה כי באיזון שבין האינטרסים אשר בעטים הוגשה בקשת העיון לבין זכותה של הגב' גלילי לצנעת הפרט, ידה של האחרונה על העליונה. אשר על כן, הבקשה לעיון בתצהירה של הגב' גלילי נדחית.
