העותר נידון (בתאריך 19.2.03) על ידי בית המשפט הצבאי בשומרון ל – 22 שנות מאסר בפועל ו-36 חודשי מאסר על תנאי. הוא הורשע בעבירות של חברות בהתאחדות בלתי מותרת , קשירת קשר לבצוע פשע , ניסיון ירי לעבר אדם והנחת פצצה.
ערעורו שהוגש בפני בית המשפט הצבאי לערעורים נדחה בתאריך 19.12.05. בעתירה שבפנינו מבקש העותר שימונה לו עורך דין , על מנת להגיש ערעור על גזר הדין שהוטל עליו. לטענתו , ניסיונותיו למנות עורך דין היו לשווא. עוד הודגש כי העותר בטוח שאם ימונה לו עורך דין הלה יצליח לגלות את העוול שנגרם לו בהשוואה לתיקים "כבדים אחרים" ,
מכיוון שהוא לא פגע ולא גרם נזק לאף אחד.
בתגובה לעתירה טען בא כוח פרקליטות המדינה כי דין העתירה להדחות על הסף. הודגש כי בית משפט זה אינו יושב כערכאת ערעור על פסק דינו של בית המשפט הצבאי לערעורים. צוין, כי ככל שהעותר מעוניין למנות לו עורך דין שייצג אותו בפני ערכאות משפטיות, פתוחה בפניו הדלת לפנות לסנגוריה הציבורית ולסיוע המשפטי בבקשה מתאימה. המשיבה טענה כי אינה מחווה דעה באשר לשאלה האם גופים אלה רשאים בכלל להיענות לבקשה מעין זו. לבסוף צוין כי קיימת אפשרות למנוי סנגור באם העותר מעוניין לפנות בבקשה למשפט חוזר על פי הוראות הדין הרלוונטי.
לנוכח עמדת המדינה, נתבקשה תגובת הסנגוריה הציבורית לעתירה. זו השיבה כדלקמן: היה והעותר מעוניין להגיש בקשה למשפט חוזר, הרי שהוא יכול להגיש בקשה שכזו לבית המשפט הצבאי לערעורים ולבקש למנות לו "סנגור ממונה" על פי התנאים הקבועים בסעיף 77 לצו בדבר הוראות בטחון [נוסח משולב] (יהודה ושומרון). צו זה תוקן לאחרונה (צו מספר 1658 מיום 28.4.10).
במקרה זה אין המדובר במינוי סנגור מהסנגוריה הציבורית, שכלל אינה מוסמכת לייצג בבתי המשפט הצבאיים בשטחים. באשר לשאלה בדבר מינוי סנגור ציבורי בהליכי בג"צ סבורה הסנגוריה הציבורית כי בהליך מנהלי המתנהל בבית משפט בישראל, מוסמך בית המשפט למנות סנגור לעותר בלתי מיוצג, אם הוא סבור שהדבר חיוני לשם עשיית צדק. סמכות זו כללית ואינה נובעת מעילות הזכאות המנויות בחוק הסנגוריה הציבורית, התשנ"ו – 1995. נטען כי כך נהגו בית המשפט העליון בהליכי בג"צ ורע"ב וכן בתי המשפט המחוזיים בעתירות אסירים ומוחזקים אחרים.
לצד זאת, הבהירה הסנגוריה הציבורית כי הגם שלשיטתה קיימת סמכות למינוי סנגור, אין מקום להשתמש בה אלא במקרים המתאימים. לכן, לא יהא זה נכון למנות סנגוריה ציבורית בהליך בג"צ, עת מדובר בעתירה נגד פסק דין של בית משפט אחר, בגדרו הייצוג על ידי המדינה מוסדר ללא מעורבות הסנגוריה הציבורית. על פי גישה זו, אין זה ראוי למנות סנגור במקרה בו חייל עותר לבג"צ נגד מערכת בתי הדין הצבאית שדנה בעניינו. כך גם באשר לפלסטינים הנשפטים במערכת בתי המשפט הצבאית בשטחים. ייצוג של נאשמים אלה מוסדר בצו בדבר הוראות בטחון. עם זאת, לשיטת הסנגוריה, גם במקרים אלה יכול בית המשפט, אם מצא לנכון, למנות עורך דין שניתן היה למנות בבית המשפט שנגדו הוגשה העתירה. לגבי העתירה שבפנינו נטען כי אין מקום למנות את הסנגוריה הציבורית לייצג את העותר בעתירה לבג"צ נגד בית המשפט הצבאי לערעורים. תחת זאת, אם בג"צ ימצא הצדקה לכך, הוא רשאי למנות "סנגור ממונה" הנוהג להופיע בבתי המשפט הצבאיים בשטחים. במקרה זה רצוי שזה יהיה אותו סנגור שמונה לעותר בהליכים הקודמים.

עמדתה המפורטת והעקרונית של הסנגוריה הציבורית ראוי שתישקל ביחס לאפיק המנהלי. ברם , בשלב זה אין צורך להכריע בנדון , הואיל והעותר לא מיצה את ההליכים העומדים לרשותו. אכן צודק בא כוח המדינה שלא ברור מהעתירה מהו ההליך בו חפץ העותר לנקוט. אם רצונו של העותר לפנות בבקשה למשפט חוזר ,
פנויה בפניו הדרך לפנות לבית המשפט הצבאי לערעורים בבקשה למינוי סנגור למטרה האמורה , על פי התנאים הקבועים בסעיף 77 לצו בדבר הוראות בטחון [נוסח משולב] (יהודה ושומרון). זאת מבלי להביע עמדה ביחס לסיכויים של בקשה שכזו , באם תוגש. אם העותר מעוניין להגיש עתירה לבית המשפט הגבוה לצדק ,
הרי שהעתירה שבפנינו הינה עתירה כללית ואין בה כל נימוק המצדיק מינוי סנגור על ידי בית משפט זה. הנימוק של העותר לפיו יש למנות לו סנגור כדי לגלות את העוול בפסק דין שניתן לפני למעלה מחמש שנים , נעדר פירוט ואינו מקים כל עילה המאפשרת את התערבותו של בית משפט זה.
