בעתירה שלפנינו מתבקש בית משפט זה להורות למחלקה לחקירות שוטרים לפתוח בחקירה פלילית נגד חוקרי שירות הביטחון הכללי (להלן – השב"כ ), שהיו מעורבים בחקירתו של העותר 1 (להלן – העותר ) בשנת 2007, בחשד לשימוש בעינויים במסגרת החקירה. עוד מתבקש בית משפט זה להורות כי חוקרים אלה יועמדו לדין פלילי.

העותר נעצר ביום 3.9.2007 בחשד שהוא משמש כמומחה החבלה של תשתית חמאס בשכם. גורמי החקירה סברו כי העותר מחזיק במידע בדבר מיקומה של מעבדת החבלה של התשתית, מטענים שברשותה וכוונות לבצע פיגועים. עם מעצרו נחקר העותר. במהלך החקירה הופעלו נגדו, לטענתו, אלימות פיסית קשה ואמצעים נוספים, העולים כדי עינויים. על רקע זה הגיש העותר 2, הועד הציבורי נגד עינויים, תלונה ליועץ המשפטי לממשלה ביום 27.11.2007. התלונה הועברה לטיפולו של הממונה על בדיקת תלונות נחקרים בשב"כ (להלן – המבת"ן ), הכפוף מקצועית לממונה על המבת"ן בפרקליטות המדינה (להלן – הממונה על
המבת"ן ). התלונה נבדקה על ידי המבת"ן והממצאים הובאו בפני הממונה על המבת"ן. ביום 15.9.2011 הודיעה לעותרים הממונה על המבת"ן דאז, עורכת הדין רחל מטר, כי לא נמצא יסוד לנקוט צעדים משפטיים או משמעתיים נגד חוקריו של העותר, אף שבנקודות מסוימות יופקו לקחים לעתיד. החלטה זו אושרה על ידי היועץ המשפטי לממשלה ופרקליט המדינה דאז. טענתם המרכזית של העותרים בעתירה שלפנינו היא כי ההחלטה האמורה לוקה בחוסר סבירות קיצוני, בפרט בהתחשב בכך שהעובדות המפורטות בתלונתו של העותר לא הוכחשו על ידי המשיבים.

בעקבות הדיון שהתקיים בפנינו ביום 3.3.2014, התבקשו בעלי הדין להציג את עמדתם בנוגע לאפשרות שעניינו של העותר
ישוב וייבחן על ידי המבת"ן, לאור השינוי שחל בשיוכו הארגוני של המבת"ן מאז הוגשה העתירה בחודש יולי 2012. כיום, המבת"ן איננו עוד עובד שב"כ, כי אם עובד משרד המשפטים. יוער, כי מטרת השינוי, שעל הצורך בו עמד גם בית משפט זה, היא לנתק את המבת"ן מהשב"כ כדי להבטיח עצמאות רבה יותר בבדיקת תלונות נחקרי שב"כ (ראו בג"ץ 1265/11 הועד הציבורי נגד עינויים בישראל נ ' היועץ המשפטי לממשלה , פיסקאות כ"א, ל"ג (השופט א '
רובינשטיין ) (6.8.2012)).

ביום 18.3.2014 הודיעו המשיבים 1 ו-2 כי בעקבות המלצת בית משפט זה, החליט היועץ המשפטי לממשלה, על דעת פרקליט המדינה, כי העניין נושא העתירה יובא בפני המבת"ן, בשיוכו הארגוני החדש, לבדיקה נוספת. זאת, לאור הרגישות המיוחדת של הנושא. יש לציין, כי בהודעתם ציינו המשיבים 1 ו-2 שכבר הובא בפני המבת"ן החדש היבט מסוים הקשור לעניינו של העותר, שפרטיו לא הוצגו בפני בית משפט זה. בהודעתם מיום 30.3.2014 התנגדו העותרים לבדיקה נוספת של תלונת העותר על ידי המבת"ן החדש. לטענתם, אין הצדקה לקיום בדיקה מקדמית נוספת לפני פתיחה בחקירה פלילית כאשר התשתית העובדתית מעידה בבירור כי נדרש לפתוח בחקירה, מה גם שהמבת"ן (בשיוכו הארגוני הקודם) כבר בדק את הסוגיה וחלף זמן רב מאז האירועים נושא העתירה, שהתרחשו בשנת 2007. העותרים סבורים עוד שלאור עמדתם של היועץ המשפטי לממשלה ופרקליט המדינה הנוכחיים בעניינו של העותר, שאינה שונה מזו של קודמיהם, בדיקה נוספת שתיערך על ידי גורם במשרד המשפטים תהיה בהכרח נגועה במשוא פנים.

לאחר שעיינו בהודעות בעלי הדין, באנו למסקנה שראוי לאפשר למבת"ן החדש לבדוק שוב את האירועים נושא העתירה, וזאת לאור השינוי שחל בשיוכו הארגוני של המבת"ן, שהביא להפרדתו מהשב"כ. חששות העותרים ביחס לאפקטיביות של בדיקה נוספת שתבוצע על ידי המבת"ן לא נעלמו מעינינו. לאור אופי וחשיבות העניין בו אנו עוסקים, אנו מצפים שהבדיקה תהא עצמאית, יסודית ומקיפה, ולא תבקש אך לאשש את ממצאי הבדיקה הקודמת. יחד עם זאת, איננו סבורים שיהיה זה נכון להניח מראש שמה שהיה הוא שיהיה.

המשיבים יגישו הודעה מעדכנת עד ליום 22.7.2014 באשר להתקדמות הבדיקה. בעקבות הגשת ההודעה ייבחן המשך הטיפול בעתירה.
