העותר, אסיר המרצה עונש מאסר של 21 שנים בגין ניסיון לרצח החל מיום 19.8.03, עתר בעתירה דכאן כי המשיב "יחזיר עטרה ליושנה" ויאפשר לאמו לבקרו בכלא כל שבועיים כפי שהיה בעבר, במקום אחת לשנה כיום.

דין העתירה להידחות על הסף בשל קיומו של סעד חלופי. העתירה היא ב"ענין הנוגע למאסרו או למעצרו" של אסיר וככזו, יש להגישה ל בית המשפט המחוזי כעתירת אסיר, מכוח סעיף 62א לפקודת בתי הסוהר [נוסח חדש], התשל"ב-1971 (ראו: בג"ץ 9792/09 פלוני נ' מפקד כוחות צה"ל באיו"ש (לא פורסם, 14.12.09) והאסמכתאות שם) (להלן: פלוני ).

כפי שנקבע בעניין פלוני , עתירה מסוג זה יכולה להתברר גם בדרך של עתירה מנהלית, ככל שהיא נסבה על בקשתו של העותר להעניק לאמו היתר כניסה לישראל, מכוח סעיף 3ב(3) לחוק האזרחות והכניסה לישראל (הוראת שעה), התשס"ג-2003.
סעד זה מצוי כיום בגדר סמכותו של בית משפט לעניינים מנהליים כאמור בפרט 12(3) לתוספת הראשונה לחוק בתי המשפט לענינים מינהליים, התש"ס-2000 (ראו גם: בג"ץ 5692/09 אבו אלגדיאן נ' מדינת ישראל (טרם פורסם, 18.11.09)).

סיכומו של דבר, שבפני העותר סעד חלופי, אם על דרך של הגשת עתירת אסיר ואם באמצעות עתירה מנהלית כאמור (וראו עניין פלוני , שם נאמר כי נראה שהמסלול הנכון מבין השניים הוא של עתירת אסיר).
