השופט ח' מלצר:

עניינה של העתירה שלפנינו בבקשת העותרים כי נורה למשיבים לתת טעם מדוע לא יאפשרו לעותר 2 (להלן: העותר ) להיכנס למדינת ישראל לצורך קיום חיי משפחה עם העותרת 1 (להלן: העותרת ). עוד מבקשים העותרים כי יירשם בתעודת הזהות של העותרת כי היא נשואה לעותר וכן יינתן לעותר היתר כניסה ושהייה בישראל. בגדרי העתירה התבקש גם צו ביניים, שימנע את הרחקתו של העותר ממדינת ישראל עד להכרעה בה.

בעתירה נטען כי העותרת, תושבת כפר-קרע ואזרחית ישראל והעותר, תושב הרשות הפלסטינית, נישאו לפני כשנתיים וחצי ומצויים עתה בטיפולי פוריות בבית החולים הלל יפה בחדרה. לטענת העותרים, הם פנו לגורמים שונים במטרה להסדיר את שהייתו של העותר בישראל ואולם לא קיבלו תשובה מסודרת, כהגדרתם, מכל גורם שהוא, ורק הופנו מגורם אחד לאחר. העותרים טוענים כי נאמר להם שקיימת מניעה משטרתית בעניינו של העותר ואולם לא הובהר להם כיצד ניתן להסיר את המניעה, או ממה היא נובעת.

מתגובת המשיבים, מנגד, מצטיירת תמונה אחרת לגמרי. מתברר, כי במערכת הממוחשבת המתנהלת אצל המפקד הצבאי לאזור יהודה ושומרון רשום העותר כנשוי החל משנת 1983 לאישה אחרת, תושבת האזור, ולהם שני ילדים
משותפים. עובדה זו לא צוינה בעתירה. נתון נוסף שלא נזכר בעתירה הוא כי העותר הורשע בתאריך 6.7.2008 בבית משפט השלום ברחובות בביצוע שתי עבירות לפי חוק הכניסה לישראל, התשי"ב-1952 ונגזר עליו עונש של 30 ימי מאסר בפועל ושישה חודשי מאסר על תנאי למשך שלוש שנים (ראו: ת"פ ( שלום רחובות) 1607/08).
המשיבים מוסיפים ומדגישים כי העותרים לא צירפו לעתירה כל מסמך המעיד כי הם אכן פנו, כטענתם, לגורמים מוסמכים כלשהם וממילא אין כל תיעוד לפניות האמורות – גם אצל המשיבים. עוד נמסר מטעם המשיבים כי העותרים כלל לא הגישו בקשה לאיחוד משפחות, ל פי סעיף 3
ל חוק האזרחות והכניסה לישראל (הוראת שעה), התשס"ג-2003 ואף אם היתה מוגשת בקשה כזו, הרי שכנגד החלטה שלילית בה העותרים צריכים היו לעתור ל בית המשפט לעניינים מינהליים, וזאת בהתאם לסעיף 5(1) ופרט 12 לתוספת הראשונה ל חוק בתי המשפט לעניינים
מינהליים, התש"ס-2000 .
המשיבים מבקשים איפוא כי נדחה את העתירה על הסף, הן מחמת קיומו של הסעד החלופי הנ"ל והן בשל אי-ניקיון הכפיים והסתרת הפרטים המהותיים מצד העותרים, כמפורט לעיל. עוד טוענים המשיבים כי העתירה לוקה גם באי-מיצוי הליכים והיעדר פנייה מוקדמת.

דין העתירה להידחות על הסף
מכל הטעמים שפורטו בתגובת המשיבים. העתירה אכן לוקה בשורה של פגמים, ובראשם, אי גילוי מלוא העובדות הרלבנטיות. כלל ידוע הוא כי עותר המבקש סעד מ בית המשפט הגבוה לצדק חייב לגלות ל בית המשפט את
כל העובדות הרלבנטיות ואי גילוי כזה עלול להוביל לדחיית עתירתו (ראו: בג"ץ 421/86 אשכנזי נ' שר התחבורה , פ"ד מא(1) 409, 410 (1987); בג"ץ 10856/07 קרייף נ' שירות בתי הסוהר
(לא פורסם, 6.1.2008); בג"ץ 7548/10 פלוני נ' משרד הפנים (לא פורסם, 28.10.2010)). העתירה שלפנינו לוקה בפגם זה וכן בפגמים משמעותיים נוספים, כגון אי מיצוי הליכים והיעדר פניות מוקדמות. מעבר לכך, ככל שהעותר מבקש מעמד מכוח חייו המשותפים עם העותרת, או היתר שהייה בישראל מטעמים של טיפול רפואי, מכוח חוק האזרחות והכניסה לישראל (הוראת שעה), התשס"ג-2003 , הרי שאם יקבל סירוב (לאחר פנייה כדין) יעמוד לו סעד חלופי, ב בית המשפט לעניינים
מינהליים, בהתאם לסעיף 5(1) ופרט 12 לתוספת הראשונה ל חוק בתי המשפט לעניינים מינהליים, התש"ס-2000 .

נוכח כל האמור לעיל – העתירה נדחית איפוא. מובן כי לעותרים שמורות כל טענותיהם וזכויותיהם היה ויפנו כדין (או שיוכיחו כי עשו כן) ותתקבל החלטה שלילית כלשהי בעניינם. בנסיבות העניין – אין צו להוצאות.
