בקשה לעיון בתיק בית המשפט
החלטה

מונחת לפניי בקשה לעיון בתיק בית המשפט שהוגשה על ידי חברת קו-אופ ישראל רשת סופרמרקטים בע"מ (להלן: המבקשת ). לטענת המבקשת, היא התקשרה בחוזה שכירות ארוך טווח לשכירת נכס המצוי בפרויקט בשכונת מוצא תחתית והיא רואה עצמה כמי שעלולה להיפגע מן התכנית הנתקפת בגדר העתירה. לטענתה, היא מבקשת לעיין בתיק על מנת לשקול את צעדיה - האם להגיש עתירה נפרדת או להצטרך לעתירה זו.

בהחלטתי מיום 5.12.2010 ביקשתי כי הצדדים לעתירה לבקשה זו יגישו את תגובתם לבקשה זו עד ליום 30.12.2010. העותרים אינם מתנגדים כי המבקשת תעיין בתיק בית המשפט, ואילו המשיבים לא הגישו כל תגובה מצידם על אף כי חלף המועד אותו קצבתי להגשת תגובות מטעמם.

דין הבקשה להתקבל. איני סבור כי יש מניעה להתיר את העיון בתיק בהתאם לתקנה 4 לתקנות בתי המשפט ובתי הדין לעבודה (עיון בתיקי בית משפט), התשס"ג-2003 [על זכות העיון בתיקי בית המשפט ראו: בג"ץ 5917/97 האגודה לזכויות האזרח בישראל נ' שר המשפטים (לא פורסם, 8.10.2009)], והצדדים להליך זה אף לא הביעו התנגדות לעיון על אף שניתנה להם ההזדמנות לעשות כן. בנוסף, סבורני כי נימוקי המבקשת אשר נתמכו בתצהיר מלמדים כי יש לה עניין בתיק ולא נראה כי עיון כאמור יפגע במי מהצדדים להליך.

לפיכך, הבקשה מתקבלת ולמבקשת ניתנת הרשות לעיין בתיק בית המשפט בהליך שבכותרת. העיון ייעשה במזכירות בית המשפט בנוהל המקובל. איני עושה צו להוצאות.
