העותר עבד לטענתו בשירותה של המשיבה 2 (להלן: המשיבה ) שהתמודדה במערכת הבחירות בעירי ית פתח תקווה. לטענת העותר על פי ההסכם ביניהם הוא היה זכאי לשכר בסיסי של 5,000 ₪ לחודש לתקופת מערכת הבחירות, ולסכום חודשי נוסף של 10,000 ₪ אם הרשימה תזכה בחצי מנדט, או 15,000 ₪ אם תזכה במנדט שלם למועצת העיר. לעומת זאת טענה המשיבה כי ההסכם הקנה למבקש שכר בסיסי של 5,000 ₪, לו יתווסף סכום חד פעמי של 10,000 ₪ או 15,000 ₪, אם תזכה בחצי מנדט או במנדט, בהתאמה.
העותר הגיש תביעה נגד המשיבה לבית הדין האזורי לעבודה בתל אביב ובה עתר להשלמת תשלומי המענק החסרים בגין כל אחד מחודשי עבודתו. לאחר שבחן את טענות הצדדים, דחה בית הדין האזורי את התביעה. על כך ערער המבקש בפני בית הדין הארצי לעבודה, וערעורו נדחה תוך שבית הדין הארצי מאשר את פסק דינו של בית הדין האיזורי מכוח סמכותו לפי סעיף 108(ב) לתקנות בית הדין לעבודה (סדרי דין), התשנ"ב-1991.
על פסק דינו של בית הדין הארצי לעבודה נסבה העתירה שלפנינו.

עתירתו של העותר, המייצג את עצמו, כוללת ערב רב של עילות, חלקן בדיני העבודה וחלקן מהדין הפלילי, לרבות טענות להפרת חקיקת מגן, לזיוף מסמכים מצד המשיבה, להתעלמות בית הדין הארצי מראיות שעמדו בפניו, לטעויות שנפלו בחישוב תקופת עבודתו אצל המשיבה, לטעויות שנפלו בהבנת הפלוגתאות שבתביעה, וכיו"ב טענות מטענות שונות. אציין כי מרבית הטענות האמורות נטענו בצורה זו אחרת לפני בית הדין הארצי, והעותר מצא לחזור עליהן תוך הפניה לסיכומיו בערכאה קמא.

עתירתו של העותר לוקה בחוסר בהירות, בלשון המעטה, היא מנוסחת בלשון משתלחת, תוקפת את המשיבה בטענות של מרמה וזיוף ואת בית הדין האזורי ובית הדין הארצי בטענות קש וגבבה, ודי בכך כדי לדחות את העתירה על הסף.
לכך יש להוסיף כי לא עלה בידי העותר להראות כי העתירה חורגת מעניינו הפרטני וכי נתמלאו התנאים המצדיקים התערבותו של בית משפט זה כשבתו כבג"ץ על פסקי דין של בית הדין הארצי לעבודה, על פי ההלכות הנקוטות עמו מימים ימימה (בג"ץ 525/84 חטיב נ' בית הדין הארצי לעבודה , פ"ד מ(1) 673 (1986)).

העתירה נדחית אפוא על הסף ללא צורך בתגובה. העותר יישא בהוצאות בסך 2,000 ₪ לטובת אוצר המדינה.
