בפסק דין מיום 29.5.2006 חייב בית המשפט לענייני משפחה את המשיב בתשלום מדור עבור בתו הקטינה בסך של 150 דולר לחודש, בכפוף לכך שהאם-המבקשת תציג חוזה שכירות לשנה מראש. המבקשת פתחה תיק הוצאה לפועל למימוש פסק הדין ובמסגרתו הגישה בקשה להגדלת הקרן וצירפה הסכם שכירות. רשמת ההוצאה לפועל (כב' הרשמת ו' שוורץ ) הורתה למשיב להשיב לבקשה. בתשובתו התנגד המשיב למבוקש וטען כי לא צורף לבקשה הסכם השכירות כנדרש. רשמת ההוצאה לפועל נעתרה לבקשה להגדלת הקרן בקובעה כי בניגוד לטענת המשיב, המבקשת צירפה לבקשה את הסכם השכירות. המשיב, מצדו, ביקש לבטל את ההחלטה בטענה שלבקשה שהומצאה לו לא צורף עותק מן ההסכם, ולמעשה מ דובר בהסכם פיקטיבי שכן המשכיר הוא אביה של המבקשת ואילו המושכר הוא חדר בדירה שהמבקשת מתגוררת בה עם בתה משנת 2003. על רקע טענות אלו, קיימה רשמת ההוצאה לפועל דיון בבקשה לביטול החלטתה ובסופו של דבר, לאחר חקירות, הורתה על ביטולה בהחלטה מנומקת, וחייבה את המבקשת בהוצאות בסך של 2,000 ש"ח. הרשמת קבעה כי המבקשת לא עמדה בנטל להוכיח שהיא משלמת דמי שכירות בפועל, ועל כן אין מקום להגדיל את הקרן. המבקשת ערערה על החלטה זו לבית המשפט לענייני משפחה, ובית המשפט (כב' סגנית הנשיא ט' סיוון ) דחה את הערעור בקובעו כי לא קמה עילה להתערבות בהחלטת הרשמת, וכן חייב את המבקשת בהוצאות בסך של 3,500 ש"ח. המבקשת לא השלימה עם ההחלטה והגישה בקשת רשות לערער לבית המשפט המחוזי. בית המשפט (כב' השופט ש' שוחט ) – בהחלטה מקיפה ומנומקת – קבע כי הבקשה שלפניו אינה עומדת באמות המידה למתן רשות ערעור ב"גלגול שלישי" ודי בכך כדי לדחותה, אך הוסיף ודן בטענות לגופן ודחה אותן אחת לאחת. בכלל זה קבע בית המשפט כי לא קמה עילה להתערב במסקנותיה העובדתיות של הרשמת; כי לא נפל פגם בכך שהרשמת החליטה לתקן את החלטתה על סמך תקנה 126א לתקנות ההוצאה לפועל, התש"ם-1979; וכי החלטת הרשמת ניתנה בסמכות.

מכאן הבקשה שלפניי שבגדרה שבה המבקשת, בעיקרו של דבר, על הטענות שהעלתה בערכאות הקודמות. עיינתי בבקשה ובאתי למסקנה שדינה להידחות. עסקינן בבקשת רשות ערעור ב"גלגול רביעי" שנסבה על החלטת רשמת ההוצאה לפועל לבטל החלטה קודמת שנתנה בדבר הגדלת קרן לתקופה של שנה, בסך כולל של כ-4,000 ש"ח. טענות המבקשת – המתמקדות בטעויות קונקרטיות שנפלו לשיטתה בהחלטות הערכאות הקודמות – נבחנו לגופן שלוש פעמים ונדחו. אין מקום להידרש למחלוקת זו בפעם הרביעית, ומן הדין לשים קץ להתדיינות. הבקשה נדחית אפוא. אין צו להוצאות.
