החלטה

לפניי בקשת רשות ערעור על החלטת בית המשפט לעניינים מינהליים מרכז-לוד מיום 6.6.2013 (כבוד השופטת מ ' נד"ב ), בה אושרה הגשת תובענה ייצוגית נגד המבקשת.

עניינה של התובענה הייצוגית נשוא בקשת רשות הערעור הוא בשאלת פרשנותו של סעיף 6 לחוק הרשויות המקומיות (ריבית והפרשי הצמדה על תשלומי חובה), התש"ם-1980. בהתאם להוראת חוק זו, אם לא הוחזר לנישום תשלום יתר (כהגדרתו בחוק) "תוך 30 ימים מיום שהאדם ששילמו הודיע בכתב לרשות המקומית שהתשלום שנגבה ממנו הינו תשלום יתר", על הרשות המקומית להשיב את התשלום בצירוף הפרשי הצמדה וריבית כקבוע בסעיף החוק. המחלוקת הפרשנית בין בעלי הדין היא, האם הגשת השגה למנהל הארנונה מהווה הודעה בכתב לצרכי סעיף 6 האמור, כך ששלושים ימים לאחריה, חבה הרשות המקומית בתשלום ההצמדה והריבית. בית משפט קמא אישר את הגשת התובענה הייצוגית, וקבע, כי קיימת אפשרות סבירה כי הסוגיה האמורה תוכרע לטובת הקבוצה המיוצגת. מכאן בקשת רשות הערעור שבפניי.

דין בקשת רשות הערעור להידחות בלא שראיתי צורך להידרש לטענות המבקשת לגופן. בקשת רשות הערעור אינה נמנית עם המקרים בהם מוצדק ליתן רשות ערעור על החלטה המאשרת הגשה של תובענה ייצוגית (ראו, רע"א 8761/09 סלקום ישראל בע"מ נ ' פתאל (6.5.2010) (להלן – עניין סלקום )). אחד התבחינים שנקבעו בעניין סלקום למתן רשות ערעור הוא משמעות קבלת התובענה הייצוגית מבחינת הנתבע. בענייננו, המבקשת אינה טוענת כי המשמעות של קבלת התובענה הייצוגית תהא חמורה במיוחד מבחינתה (ראו, רע"א 4695/13 צמנטכל ניהול נכסים בע"מ נ '
בלוך , פיסקה 3 (25.10.2013), והאסמכתאות שם). סכום התובענה הייצוגית, כפי שצוין בבקשה לאישור התובענה הייצוגית (נספח 8 לבקשת רשות הערעור), הוא 1.7 מיליון ש"ח. נוכח נתון זה ועל רקע כלל הנסיבות יש לדחות את בקשת רשות הערעור.

יודגש, כי אין בדחיית בקשת רשות הערעור כדי להביע עמדה כלשהי לגבי טענות המבקשת. את טענותיה תוכל המבקשת להעלות בבית משפט קמא וכן בערעור על פסק-הדין הסופי בהליך, ככל שערעור כזה יוגש על ידי מי מבעלי הדין ויהיה בכך צורך.
