בקשת רשות ערעור על החלטת בית המשפט המחוזי בחיפה (כבוד סגן הנשיא י ' גריל ) מיום 29.5.2013 בה נעתר בית המשפט לבקשת המשיבה והתיר לה לנהל תובענה ייצוגית נגד המבקשת (להלן – החלטת האישור ).

עניינו של ההליך הוא בטענה להפרת סעיף 4ב לחוק חניה לנכים, התשנ"ד-1993. סעיף חוק זה קובע, כי "מקום ציבורי שהגישה הנגישה היחידה אליו לאדם עם מוגבלות היא דרך חניה במקום הציבורי הכרוכה בתשלום, תחול על המפעיל או המחזיק של המקום הציבורי חובה לשלם בעד חניה במקום האמור, בשל האדם עם המוגבלות, ככל שנדרש לאדם כאמור מקום חניה". המשיבה, לטענתה, החנתה את רכבה בחניון המשמש את באי קניון בעיר חיפה. לאחר שסיימה את ביקורה בקניון, נדרשה המשיבה לשלם עבור החנייה ביציאתה מן החניון. דרישתה שלא לשלם עבור החניה בשל נכותה, נוכח הוראת החוק האמורה, סורבה. משכך, הגישה המשיבה בקשה לאישור תובענה ייצוגית נגד המבקשת, צמנטכל ניהול נכסים בע"מ (להלן – המבקשת ). המבקשת, לפי טענתה בבקשת רשות הערעור, היא חברת הניהול של הקניון (יוער, כי בתחילה הוגשה הבקשה לאישור התובענה הייצוגית נגד חברה נוספת, המנהלת את החניון, אולם בהמשך זו נמחקה מההליך). כאמור, הבקשה לאישור התובענה הייצוגית התקבלה, ומכאן בקשת רשות הערעור שלפניי.

דין בקשת רשות הערעור להידחות בלא שראיתי צורך להידרש לטענות המבקשת לגופן. הבקשה אינה באה בגדר המקרים בהם מוצדק ליתן רשות ערעור על החלטה המאשרת תובענה ייצוגית (ראו, רע"א 8761/09 סלקום ישראל בע"מ נ '
פתאל (6.5.2010) (להלן – עניין
סלקום )). לענייננו, אחד התבחינים שנקבעו בעניין סלקום למתן רשות ערעור הוא משמעות קבלת התובענה הייצוגית מבחינת הנתבע. המבקשת לא הראתה כי המשמעות של קבלת התובענה הייצוגית תהא חמורה במיוחד מבחינתה (השוו, בר"ם 3778/13 אלעד נ '
אזולאי (1.10.2013); רע"א 3242/11 אקסלנס נשואה ניהול השקעות בע"מ נ ' פירט (13.5.2013)). טענות המבקשת לעניין המשמעות של אישור התובענה הייצוגית נגדה הועלו בבקשת רשות הערעור באופן כללי, ודי בכך כדי לדחות בענייננו את בקשת רשות הערעור (ראו, רע"א 1926/12 מפעל הפיס נ ' וונדר , פיסקה 3 (9.12.201 2)). כפי שנפסק, לשם מתן רשות ערעור על החלטה המאשרת תובענה ייצוגית, "לא די בטענה הלקונית שהעלתה המבקשת בנוגע להשלכות מבחינתה של ניהול התובענה הייצוגית" ( רע"א 7930/12 מנורה מבטחים ביטוח בע"מ נ '
קידישמן , פיסקה 3 (3.2.2013)). בהקשר זה יוער, כי בבקשה לאישור התובענה הייצוגית, שצורפה כנספח לבקשת רשות הערעור, נטען כי סך הנזק לחברי הקבוצה המיוצגת בשל גביית דמי החנייה בשבע השנים שקדמו להגשת ההליך עומד על כארבעה מיליון ש"ח (כששלושה מיליון ש"ח מהם מהווים "נזק לא ממוני" שלפי הטענה נגרם לחברי הקבוצה). הערכה זו של הנזק לחברי הקבוצה בוססה על הערכה בדבר סך המשתמשים בחניון בתקופה זו (עמ ' 30-29 לבקשה לאישור התובענה הייצוגית). אלא שלטענת המבקשת, החניון משמש למטרות רבות נוספות מלבד ביקור בקניון, בשל קירבת החניון למוסדות ציבור נוספים בעיר חיפה, ואין היא נושאת, לגירסתה, באחריות כלפי מי שעשה שימוש בחניון שלא לצורך ביקור בקניון אותו היא מנהלת. כן טוענת המבקשת כי המשיבה לא הוכיחה שמפעילי החניון הקודמים גבו את אותם דמי חנייה מנכים כמו מפעילת החניון הנוכחית, ואילו מפעילת החניון הנוכחית פועלת במקום החל משנת 2011 בלבד. טענות אלו (אשר יש להניח כי תתבררנה לגופן בערכאה הדיונית), אם תתקבלנה, עשויות להוביל להפחתה בגובה הנזק הנטען על-ידי המשיבה, ויש בכך כדי לחזק את הקביעה שאין מקום ליתן רשות לערער על החלטת האישור.

יודגש, כי אין בדחיית בקשת רשות הערעור כדי להביע עמדה כלשהי לגבי טענות המבקשת. את טענותיה תוכל המבקשת להעלות בבית משפט קמא וכן בערעור על פסק-הדין הסופי בהליך, ככל שערעור כזה יוגש ויהיה בכך צורך.

הבקשה נדחית בלא שנתבקשה תשובה. מטעם זה, אין צו להוצאות.
